- where no area of city impact has been officially adopted, all plats situate
1 within one fli mile outside the limits of any incorporated city shall first be

submitted to the said city, and approved by the~.council of said city before the
same shall be recorded. Items which may be considered by the city include,
but are not limited 'to, continuity of street pattern, street widths, and
drainage prov:sions. if the r_ity has adopted a subdivision ordinance and/or
a comprehensive plan, then these documents may be used as lruidelines for
approving plats. Such city approval shall be in addition to county approval.
Within` one (1) rr:ile of the city, rt city subdivision ordinance shall prevail
over a county subdivision ordinance unless the city and county mutually
agree upon any differences. Where the jurisdiction of two E21 cities overlaps,
then the jurisdiction shall be assumed by the larger city. (1967, eh. 429,.

5 306A. Vact~tion of plats -Procedure. -When tiny person,
persfirm, association cn• corporation may desire to vacate a_plat or~.ny~
part thereof which is inside or within one (2) mile of the baundaries,,afany
city, it shall, be lawful for such person, persons,. firriz, associaation or
corporation t,o-pr~t.ition the city council to vacate. Such petition ~}a~all set forth
particular circumstances of the requests to vacate; contain a legal.
description of the p'1att,~d area or property to be vacated; the names of the
persons aff'sctecl thereby,"a~td said petition shall be,,fi`led with the city clerk.
Written notice of public hearing on said petition shall be given, by
certified mail with return receipt, at least Len E.10) days prior to the date of
public hearing to all property owners within three hundred (;3f)fli feet of the
boundaries of the area described in the petition. Such n<,tice of public
hearing shall also be published once a week for two (2) successive, weeks in
the offrcial newspaper of the city, the last ofwhich shttll be not less than
seven (7) days prior. to the date of said heating.
When the procedures set forth herein }utvE: been fulfillc;d, the city council
rrtay grant .the request to vacate with such restrictions as they deem neces-
nary in the public interest,.
When theplatted area lies more than one (1) mile beyond the city limits,
the procedures .set forth herein shall be followed with the county
commissioners of the county wherein the property lies. The county
commissioners shall have authority, comparable to the city council, to grant
the vacation, provided, however, when the platted area lies beyond one (1}
mi]e Uf the city limits, but adjacent to a plaited area within oxie t ll mile of
the city, consent of the city council of the affected. city shall be necessary in
granting any vacation by the county commissioners.
