MINUTES OF THE PLANNING & 'CONING BOARD MEETING
December 30, 1981
A meeting of the Planning & Zoning Board Meeting, held December 30, 1981, at the City Ha~

Chuck Frost told the board the only item on the agenda was to talk about.a Sub-Division
plat. It use to be called H & R Development, it has a new name now The Fairways at Teton
Lakes. By way of background Chuck. Frost read from previous minutes of the Planning &
Zoning, Novemver 10, 1977,. one from December 14, 1977 and Council minutes of January 4,
1978.. (copies attached) He said it was his understanding that it has been re-worked,
and now they .are anxious to present it again and hope to have this property annexed.
Ross Reese told the board they didn't care one way or another if it was annexed. One of
the big considerations they had to have the. Planning and Zoning and the city addxess was
the sewer and water and whether or°not the city want. it annexed for those services. They will
have to--.consider the distance to it and the fact that it is isolated. They need to take
into consideration the road maintainance and snow removal & weigh the pros and cons, Th
will be asking for city services and want to get sewer and water rates at reasonable cost.
Earl Kemp presented a proposed plat explaining it. (copy on file) It is on,an elevated
bluff next to the-golf course. He said they didn`t have a final plat, before they put
a final plat together they wanted to get the input from the Planning and Zoning so they
didn't design the water and sewer system for a final plat and not. follow in line with:what
the Planning & Zoning Board would like. He explained Area ~~l which has now 72 residential
lots a. little less than the preliminary plat. Area 2, 3, and: 4 are areas for future
:condominiums. There is a double road coming into the sub-division . Iri addition there is
a canal that comes through the golf course, the canal is shown by the easement, that easement
is wide enough for the canal-and for a backhoe: Co go down the north side of it for cleaning
purposes, and for access, .there is also a road that goes through the golf course that comes
out on Hibbard also. There is a road- on the north side of the canal that we have to
maintain and keep open for canal access with a backhoe which is more than 10"feet wide.
There is 10 foot. easement down the back property lines. The only exception to the sub-
division ordinances would be lot 49 which has slightly less than 40 feet but by .the time
you"get the sidewalks in we are up to 69 feet, and by the time you meet the setback.

Earl Kemp said o bring the Planning and Zoning up to date, the property was'
originally owned by Wally Robison and Lucine Howard and they donated about $500,000 worth
of ground to the County for the new City-County Golf Course, at that time they requested
that they be allowed to hook up to city sewer. The council said at that time in return for
the donation they would be able to hook-up to city sewer and possibly city water without
Haying hook-up charges, except for direct cost to the city. .Rose Bagley, City Clerk, said

found. the council will have to act on it again. Earl said originally they did not ask
for city water, but since then the city has a little better water-pressure in the city and
have extended a six inch main out to the sewage treatment plant. Right now they have
put a crossing under the new highway for -sewer and are going to put a lift station in the
sub-division and a pump into the new sewage treatment plant. We were thinking of bringing

will put a well in to supplement fire flow. Chuck Frost ask if there was sufficient
capacity now on the sewage treatment plant to handle this kind of development. Earl
said that it could handle double the population of Rexburg and Sugar City.
Ross Reese said there are two or three things that have been changed since he had taken
over on the thing.

2. They made much bigger lots and fewer of them, because of the nature of the project
and the type of ownership and the price of the lots and being out of .town they are
anticipating three and four car garages, and fronting on the golf course we anticipate
they would be in the medium high range home. They had re-designed the street system
to accommate the canal and the entrance on the front has a common area, which will belong
to the home owners association and will be under the care and keeping of the home ~w~ers
association and their management. It will separate the in-coming traffic and out-going
traffic and provide the four lanes and the other is a safety feature for the golfers
crossing over to the club house and parking area when they finish the course. It will be
landscaped and signed. The streets will be 50 feet streets with concrete rolled edge
curbs and sidewalks which are required in the covents.- In addition to tht the mail
boxes will be on the right hand side of the road going counter clockwise through the
sub-division and they require they be placed on the adjoining property lines, they be
shared with. two or more property owners, they be required to be black in color and the
rural type. The blocks 2, 3, & 4 are designated as multiple properties for the purpose
of building condominium type structures. ,'
Chuck Frost ask Earl Kemp if all the requirements~of the city sub-division ordinance
had been met. Earl said they are met with the exception of lot 49 which was explained earl is
Chuck Frost said the orginal concern that the Planning & Zoning had was access, for
emergency purposes and. .the way it is plated now has solved the problem with the access
on the canal and the division of the four lanes at the entrance.
Ross Reese said the annexation problem is one the Planning and Zoning and the Gty
Council can better address than them`making the request. He said he requested
that if it is not annexed they do not want to pay absorbent fees for water-and sewer
because Robison is still involved in the development and with his memory and with the
commitments made with the rest of them that invested in it, it was'-their opinion that
these concessions had been made with the substantial donation. From a functional
standpoint they are requesting city water water as well as city sewer.
Chuck Frost said the city obligation, if there was an agreement to hook into the city
water,would be to furnish the water, the developer would have to put the lines in the
ground and then if the property was ever annexed the the city would take over maintainance
of the 1_ines. Ross Reese said he was not asking the city to incur any costs, but just
to extend the service. The only other commitment that was made at the time on sewer
was the individual .sewer hook-up fees would be included in the gift, exclusive of city
.costs.
Chuck Frost said that the Planning and Zoning needs to decide if they agree with this
plat and if they do and vote on it and it would still be up to the City Council to
re-affirm any agreements made on water and sewer.
Jim Keller ask if they annex, what other land are they proposing to annex to make
the annexation contiguous, Earl Kemp told him just the golf course.
Ross Reese said they were proposing a t3se Agreement for the city services and then
the city and county need to decide who will maintain the road. A decision would
also have to be made from the city as to who would maintain the water and sewer system,
if it wan not annexed.
A motion was made by Dan Hess that the Planning and Zoing except the proposed plat •
subject to final plat approval with clarification of the agreement of hook-up fees of
sewer` and water and recommend it be annexed to the city and recommend to the council
that they pass a variance of rolled curb if the property is annexed. Seconded by
Bob Purrington. All Aye.
A motion was made by Charles Cole and seconded by Mary Lee Hill to adjourn. All Aye.

Later in the evening Chuck Frost made a motion to reject :~ppx•ova.l of Curetnn's plan
based upon the 2 major variances required (especially lot size) anti also i}~,tt the

map as commercial properties. After some. discussion, the following was
agreed to: Commercial properties will.. be shown on the map for 300' depth
and the width from the existing airport to the edge of the impact. area on the
nr,rth of Highway 88. Mr. Kerb's property on the south-side will also bc;

Sponsored by H & R Development, presented by Bryan Burt. Mr. Burt
presented an updated plan for. asub-division sponsored by H & R Develop-
meat north and west of Rexburg. This property is not continuous with the
City. At the .request of the Planning Commission during last month's
rneet.ing, the owner has re-designed the entrance way so that. there. is
a four-lane rUad leading tq and from the property. ,After some discussion,
the F-'tanning Commission did not feel that this road met the requirements of
a second access, Moved by Alice Tout and seconded by Gale Weber, that the..
proposed plat have two access roads as a requirement. .'The vote was four {4)
in favor and three (3) obstaining, An admendment to the motion was then
mare that the plat. include a permanent emergency access approximately 1 0'
wide 200-300' from the existing entranceway. This admendment was made

that a second access to Highway 88 was urgent, and that Park Street wtnaLd

the provision that there be a second access to the property provided from
I-Iighway 88. This motion passed unanirnously,
