Those Present: Chuck Frost - Chairman Dan Hess Glen Pond Charles Cole Leonard Longhurst Mary Lee P?i11 Chuck Frost called the meeting to order and dispensed with the reading of the minutes of the previous rleeting. Chuck Frost said that he and Charles Cole had attended the last City Council meeting and were-asked to continue their meetings on the trailer overlay and give recommendations to the City Council. Chuck Frost reviewed the Ordinance passed in 1969 by the City Council and then reviewed the Ordinance passed in 1974 superceeding the 1969 Ordinance which stated in part that mobile homes are allowed only in authorized trailer parks. But after the Teton Dam flood in 1975, the city council granted temporary' perm~_ssion for mobile homes to be parked on private property inthe city for a one year time limit. Chuck Frost mentioned some alternatives: 1. 2 3 ~; L To rec]uire trailers not on a permanent foundation to i be in trailer parks. To modify the Trailer Overlay. Make the trailer overlay zone in different areas of the city. Chuck said the city council can't continue to deal with these cases on a case-by-case basis, other alternatives would be to continue the present system of temporary permits, strictly enforce the 1974 ordinance or to legalize mobile homes in all areas of the cite. Chuck told the people at the meeting that the commission were not trying to make a decision tonight, that they were still gathering information. Chuck Frost read letters that had been received concerning the overlay, copies are attached to the minutes. Letters received from: Janet McCullock, Glen Stelzer, Norman & Bernice Ricks, Ellen Nyquist, Donald iQ. Jensen. Dan Hess said people that have established homes and have well landscaped yards are concerned, they do not want to make a modge podge of our city. Some complaints were voiced on lots needing. weed mowing, Chuck advised the people that letters were being sent to the owners by the City Clerks office. The matter of Dale McIntire of 144 N, 3rd West keeping goats at his pla~ was brought up. Chuck asked Marie to bring this matter to the attention of the City Council. Chuck asked for comments from the visitors at the meeting. ~~~' MINUTES OE PLAN?SING ~ ZONING June 24, 1081 ~, Page 2 ' • Sylvester_Cooper, ?_71 N. 3rd iaest, said they built their new home years ago in this area with the understanding that the trailers would only be allowed for one year. Scott_Blackham, 411 W. 5th S.,~who is a trailer home owner said that if he^h ad a^nice home he would not want a trailer moving in next to him, but he felt that mobile homes should not be limited to one area of the city. Jared_Hepworth, 275 N. 2nd W., said there would be better neighborhoods without trailers, he objects to them in his area. Bob_Bell, 252 W. 2nd PI., is against the overlay, and complained about the vacant lot next to them that is very rnesay, also four trailers on the lot at 2C7 N. 2nd W. ' Rand~_Le~,~7is, 131 N. lst W., said that he'had been_ living at that same address for 29 years, it used to be a nice residential area but has changed to comrlercial and has the smell from Quality Pak and from Tri State Tire when they burn their old tires, and the city does nothing about that, and he reels that they (the city) should not be able to tell them where they may or may not live. He also said that people have a constitutional right to live .where or in whatever they choose, unless they infringe on the rights os others. Mrs. Randy Lewis .said that after the flood, they inherited their property, • ~he~^did^not receive money to rebuild, since they did not have ahome to start with. Young couples do not have the money to build homes, so they go to trailers. She said the commission would be defeating its own purpose by requiring mobile homes to be put on permanent foundations. Once a permanent base is put under a mobile home, it will be expensive and very difficult to move the structure to make way for a regular home, which ,she says .seems to be the goal of the city. She feels that the city is thinking more of the homes than the people. Bernice_Ricks, 174 N. 3rd W., said that the Lewis`s are in a Commercial Zone and she felt the situation was different for them. She said most of the mobile homes she was objecting to were not being lived in by the property owners, but were being rented to people who only stay for a short time and they are not keeping the homes and yards cleaned up. She also mentioned the trailer house that has been setting on the Mitchell property at South 4th East for five years with nothing done with it, also they have moved a house on the same property with windows. knocked out which is a hazard, also there is a small shack in back with paint in that children can get at. She mentioned the two homes just north of 118 N. 3rd W. that Mr. Rodriquez started building and never finished and nothing has been done with them. Chuck advised the visitors to let the City Hall know on the unkept homes. Clara Beesley, 8C N. SCth W., objected to the overlay eliminating her • block because she had been wanting to put in a trailer court on her property, but that she would see that it was kept up. She complained of there bloc:lc being very messy, with empty lots, trailers and a business, also a vacant basement that. needs to be taken care of. MINUTES OF PLANNING & ZONING June 24,.1981 P}a g e 3 Mrs. Hokanson, 311 N. 2nd W., said she felt that trailer houses should • be in~trailer courts, but if people are in trailers now they should be able to stay but not let new ones buy and move trailers on. Janet_McCullock, 270 W. 2nd N:, said she didn't understand why Salem Ave.^was considered R2 when all of the homes have been moved in. and refurbished and how come Cul-de-sac is R3 instead of R2. Chuck Frost said that that was a separate issue and would be covered at another meeting. John_Haeberle, 328 Cul de sac, felt that an overlay zone would result in~even more^vacant lots filling up with trailers and he doesn't like this idea of the value of his new home diminishir_g because of the mobile homes nearby. _ Mrs. Sylvester_Cooper, 271 D1: 3rd West,~•_was against the overlay, she does not object to the double wide homes that are on a foundation, but she does object to the "Cracker box type" that are less than 700 square feet. She referred to the 1974 Ordinance and said she felt it should be strictly enforced because it forbids trailers any where but in authorized parks. She said "Homes look best by hoTmes, and trailers look best by trailers." Randx Lewis asked Mary Lee Hill, a member of the planning commission and a^real estate agent *.ahy mobile homes depreciate neighboring property. Mrs. Hill said that it is a fact trailers do depreciate property. Norman Ricks, 174 N. 3rd W., said that he had carried a petition to all thelpeople~on N. 3rd W, to have it rezoned to R2. Trailers should not be in R2 zone. When the year was up the trailers should have been moved. Mr. Blackham_ said that trailers are more than just trailers, he said his is his home not just a trailer. ?~Irs. Lewis felt the problems boiled down to problems eaith individuals who don't keep their trailers and yards in good condition. She suggested cleaning up the problem areas and to "leave the rest alone." She felt they should not have to sell their lot and move into a trailer park. Mrs. Ricks asked if the commission had done a survey as to who is living in the trailer homes, if it is the owner or just rented. The commission said they had not. Chuck_Frost brought the questionan~3 answer session to a close and told the visitors they were welcome to stay if they like, that the commission were going to go over and review the material that had come in. He said the commission is still accepting comments and told the visitors to tell their friends and neighbors to call or write. to express their views Glen Pond said we don't want to have to make individual situations. Chuck Frost said he wondered if the trailer overlay was the right was t~ go. There is alot of opposition to it. The commission agreed, they have to come up with a solution "so the council doesn't have to wrestle ~4INUTES OF PLAN:~IING & ZONING June 24, 1981 ' Page 4 • with this for the next 10 years." He noted that the, home owners could go to court now and force the city to stick to the 1974 Ordinance, which would require mobile homes to be moved into trailer parks. Another .alternative would be a modified .ordinance to allow double-wide homes, if they are placed on permanent foundations and occupied by the o:aners, those not meeting these specifications would have to be moved to mobile home parks. At the same time trailer parks would be forced to meet cit;~ regulations and be cleaned up. The commission felt they should have a list compiled of mobile homes that were parked under temporary permits. The Commission will continue to gather input on the overlay zone and expect to make a recommendation to the .city council at the commissions July 22 meeting. A motion-was made by Chuck Frost to adjourn seconded by Dan Hess.
