Meeting called to order 24 October 1979 by Jim Keller at 7:30 p.m,
1linutes of 26 September 1979 were read and approved as amended.
BTJSINESS:
1. Jim Flair volunteered to contact the County Commissioners about adoption of
the Madison County-Rexburg Comprehensive Plan.
2. Discussed whether to urge adoption of proposed zoning ordinances and sub-
division ordinances. Dan and Leonard to complete instruction booklet for
educating people on new building plans.
3. Jim Keller to submit forms for approval of preliminary building plot plan to
the City Council.
• 4. Gene Dunn appeared before 'the Planning and Zoning to discuss a proposal to
connect ,two homes together at 367 Salem Avenue raith a common carport. The
area is currently zoned R2 and Mr. Dunn felt that a tri-plex or four-plex
could be constructed on the property. A group of concerned neighbors from
Salem Avenue also met with the Commission to voice their concerns about the
proposed construction. The existing home at 367 Salem Avenue was damaged
- during the June 1976 flood. Repairs to this home have never been completed
and the neighborhood contends that it is a public nuisance and a safety hazard:
The property is approximately 114' frontage by 136' deep. The second home on
the property taas been stored there since the middle of May 1979. This house
is still on blocks where the house movers left it. Both homes can be easily
entered either through open basement windows in the existing home or unlocked
entrances in the moved in home. The property has not been maintained and is
strewn with weeds, old pieces of pipe, scrap lumber and other debris.
Mr. Dunn's proposal was vigorously opposed by the group of neighbors because
of the following reasons:
1. There has been an apparent lack of commitment from Mr. Dunn to complete
repairs to the existing home at 367 Salem Avenue, Little, if any work,
has been done to-the home in the last three years.
2. The neighbors feel that joining the two homes together would detract from
the essential residential area of the neighborhood. They also feel the
two homes cannot be joined together in such a way as to create an
• attractive tre-plex or four-p1ex,

The Planning & honing Commission reviewed the Rexburg City Zoning
Ordinance and feel that the proposed project is in violation in several
points:
1. The home was moved onto the property without issuing a city
building permit as required on Page 30 of the Ordinance. There has
never been a plan presented for approval to the City,
Z. The existing home is also in violation of the Ordinance on Page 30
wherein the landscaping around the existing home and weed control has
not been done.
The recommendation of the Planning and Zoning Commission is that the City
Council advise Mary Smith to take the steps necessary to inform Mr. Dunn
that he is in violation of the City Zoning Ordinances and that he take immediate
steps to complete the building project or remove the flood damaged homes.
The property is a public nuisance as it now stands. If Mr. Dunn is issued a
building permit for construction of a tri-plex or four-plex (a tre-plex or four-
plex is permissible in an R2 zone) the planning and Zoning Commission
further recommends that Mr. Dunn be required to post a completion bond with
the City. This bond would insure that the project be carried to completion and
not left in an unresolved state as it has been during the past three years.
This problem urgently requires resolution before the issue ends up in litigation.
There are several other homes in Rexburg in the same condition and a definite
stand needs to be taken now in order to encourage the clean-up of the
remaining flood damaged homes.
