HomeMy WebLinkAboutP&Z MINUTES NOVEMBER 8, 1978 MINUTES OF REXBURG CITY PLANNING & ZONING COMMITTEE PRESENT: Jim Keller, Chairman Alice Tout , Whitey Brock Bob Purrington Leonard Longhurst Gale Weber Chuck Frost Meeting called to order November 8 , 19 78 , at 7:05 p . m . at City Council Chambers by Chairman jim Keller. A public hearing was held concerning zoning proposed for annexation of south part of Ricks College, Cresthaven Subdivision and five pieces of private property. Chuck Frost stated that Ricks College had no particular zoning in mind, only that (1) their property be reserved for education use (including possible livestock and farming operations) and (2) no-roads be platted through the College property except with the written authorization of the Board of Trustees . Kent Jolley stated that Cresthaven Subdivision should be zoned R-1 together with the five pieces of private property . He felt the requests of the College should be honored as part of the annexation agreement . Mayor Porter stated that there was no difficulty with sewer and water connections • for the proposed annexed area . All of the property owners expressed a desire for City sewer services. Some of the property has private wells and some already are connected to the City water mains . Jim Morris stated that annexation of the properties should be clearly spelled out so that both the City and the property owners know what is included as part of the annexation. For example: if roads are to be platted through Ricks; if sewer hook- ups are allowed and how much per hook-up to charge for connections; are roads , curbs and gutters to be required in annexed property or do owners pay for them with an LID; are Rexburg City subdivision ordinances to be required in annexed property? Adjourned hearing and started Planning and Zoning at 8:00 p.m. Minutes of Planning and Zoning Meeting held October 11, 1978, .were read and approved . New Business: 1. Dr. Jeff Mix presented a proposal to re-zone the R-3 property east of Srd East to 4th East and from 5th South to approximately 7th South. He requested a R-1 _ ~. zone for single family residential use . A petition was presented representing eight property owners in the area requesting the change . Two adjoining owners not directly involved in the property would prefer an R-2 zone . • r (~ -2- ~~ Moved: Chuck Frost Second: Whitey Brock That the property be re-zoned to R-1 and the City Council be requested to approve a hearing on the issue in the next Planning and Zoning on December 6 at 7: 00 p . m . Passed 6-0 in favor. 2. Doug Rasmussen presented a request for either a variance or a spot zone change on property at 354 W. Main. He desires to build a boarding house/training school for the Diet Center. The existing boarding house for 14 people on the R-2 property is already in violation of city zoning laws . Mr. Rasmussen was told that a complaint from neighbors .probably would shut down his business since boarding houses are allowed only in C-1 zones . On the property of 132' x 180' , he proposes to build the. Diet Center school. Moved: Gale Weber Second: Leonard Longhurst That the spot zoning change to C-1 be denied and a variance for commercial development in an R-2 zone be denied because of the basic residential character of the neighbor- hood. 5-0 in favor 2 abstaining. 3 . Gale Weber reported on subdivision check lists for preliminary and final platts . The Jefferson and Bonneville County check lists appeared to be excellent and could be adopted to Rexburg City Planning and Zoning use . Gale was asked to draft a check list for consideration at our next meeting. Leonard Longhurst will contact Kent Marlor about making a guide to planning, zoning, building in Rexburg. Gale was complimented on a good report. ~• 4. Annexation of Ricks property, Cresthaven and five private property owners was discussed . Jim Morris to set up a meeting to hammer annexation agree- ment with all parties concerned . Meeting adjourned 10:2 0 p . m .
