MINUTES OF THE REXBURG CITY
PLANNING AND ZONING COMMISSION

Meeting held Wednesday, July 121978 at City Council Chambers, City of Rexburg.
Meeting called to order at 7:40 p. m. by Chairman, Jim Keller.
Minutes of the meeting held June 14, 1978, were read and approved with minor
changes. '.
Follow-up Items from the Previous Minutes:
1. The City Building Inspector should check the size on the Hathaway
four-plex at lst North and 4th East.. The results of his inspection
should be given to the Planning and Zoning Commission.
2. The Boyd Clark four-plex south of the Rexburg City Post Office
continues to have cars parked in front of the building in violation
of the City ordinance. This item was discussed in the meeting of
June 14. The Planning and Zoning Commission recommends that
the City Council authorize the Rexburg Police to ticket cars parking
illegally in front of this building.
New Business
Item #1
Lyle Thompson from Thompson Engineering presented the Rolling Hills Sub-
division plat. This plat was studied in previous Planning and Zoning meetings.
A ten-foot construction easement needs to be shown along both sides of 5th
South. The City should also request from .Don Hammer that aten-foot con-
struction easement be continued on 5th South east of 4th East. Moved by
Whitey Brock and seconded by Alice Tout that the Rolling Hills Sub-division
plat be approved with aten-foot easement on both sides of 5th South and that
the sub-divider wi1.1 provide a water distribution system which will have 20
PSI fire flow when a hydrant is open. The vote was 6 to 0 in favor.
Item rr 2
Dean Hollist presented a request to construct atravel-trailer park on his
property at 2nd East and 1st North, the southeast corner. He wanted to put
in 4 travel-trailer stalls plus a dump station. His intention is to use the
existing sewer connection on the property for the dump station. This request

was denied because it is in violation of the travel-trailer park ordinance as
r.. approved by the City of Rexburg on April 3, 1974. On page 10, Sec. 7,
Paragraph A and B, it states that atravel-trailer park must be 2 acres or
more. The property in question does not contain 2 acres.

Frank Jenkins appeared before the Planning and Zoning Commission again
to discuss a variance or a zone change on his property at 339 West 2nd South.
This item was discussed in a meeting held last winter and Mr. Jenkins was
given authorization to approach the City Council for a zoning hearing to
change from R-2 to R-3 in order to build an eight-plex. Mr. Jenkins failed
to request the hearing from the City Council and continued construction on
his property. The eight-plex which he has built is in violation of the R-2
zoning requirements and last week the City Building Inspector put a red tag
on the project.
Mr. Jenkins was advised to approach the City Council again for scheduling
a hearing on a zoning change. Mr. Jenkins asked about the possibility of a
variance for the property in question since the City Building Inspector did
not stop his construction when the foundations were first poured for the
eight-plex. Moved by Chuck Frost seconded by Gale Weber that a variance
not be issued on this property. That the Jenkins, Virgin, and Shirley prop-
erties be re-zoned to R-3 in order to avoid spot zoning. This motion carried
~, 6 to 0. In conclusion, Mr. Jenkins showed a signature sheet from property
owners in the neighborhood listing their approval for either a variance or an
R-3 zoning change. The next work is up to Mr. Jenkins to schedule a zoning
hearing before the Rexburg City Council.

Several items in the City need to be checked by the City Building Inspector.
These items have been referred to the Planning and Zoning members during
the past month. '"
1 . The City Building Inspector should check Tom Mathews new garage
at 349 South 3rd East to see if it is in compliance with the front yard
setback. There is some question that it is too close to the street.
2. At 210 South Cornell Avenue, the Morrell Allred home needs to be
checked for proper setbacks and side yards. There is some question
that the zoning ordinance for proper side yard and setback clearance
is not met on this new construction.
3. There is a traffic safety hazard at lst South and 1st East by Dr. Mabey's
office. A bush on that corner obstructs the view of traffic coming down
• the street. The Planning and Zoning Commission recommends that the
Traffic Safety Committee look at this problem and make recommendations
to the City Council.

Item # 5
The Plannin and Zonin Commission received a request from the Federal

Housing Administration for an A-95 clearance for a new sub-division south
of Rexburg. The chairman of the Planning and Zoning Commission, Jim
Keller, -was given authorization to sign the documents that the sub-division
in question meets applicable Rexburg City sub-division ordinances.
