Meeting held June 14 , 19 78_, at the City Council Chambers , City of Rexburg .
Meeting called to order at 7: 3 0 p . m . by Chairman Jim Keller .
Minutes of the meeting held May 10 , 19 7 8 , were read , corrected and approved .
Follow-up Items from the previous minutes:
1 . The City Building Inspector should check the size on the Hathaway 4-plex
(~' ~~~ ~~~ at 1st North 4th East .
2. The City Building Inspector should check the height on the fence at the
C~1=r Ferguson home south of the Madison County Hospital.
~~~~; 3. Annexation of the property south of Rexburg, Item #5 from the May 10
meeting, is to be held pending a decision by Ricks College whether to •
annex their property into the City.
~;~-~- 4. Mary Smith, the City Attorney, has ruled the following:
The open set back in an R-2 zone in front of a building does not include
space for parking. The back yard set back in an R-2 zone is allowed for
parking .
New Business:
Item $k 1
Ned Sauer from H & K Contractors was present to explain their intent to build
a 24 x 48 ft. shop on property owned by H & K north of the Ricks-Wade sub-
division. In his presentation, Mr. Sauer made the following points:
1 . Their intent is to fill in the existing open gravel pit with construction
debris over the next few years .
2 . They will build a small shop 24 x 48 ft . which will be used as a
construction headquarters for their heavy equipment .
3. They will establish a construction yard with a 6 ft. fence for parking
of their heavy equipment .
4. The race track and the proposed extension of 5th West goes between •
their property and the city shops .
5. The property in question is not annexed as part of Rexburg City.

6 . H & K has given the County Fair Board an easement to extend the
race track across their property.
7 . H & K intends to bury a 10, 000 gallon diesel fuel tank to service
their vehicles .
8. If possible, H & K would like to have city services .
Mr. Samuel Gardner, as a spokesman for the local property owners, presented
a petition signed by 87 of the owners who are opposed to construction of comm-
ercial property in the area . A copy of the petition is attached . Their concerns
centered around two areas:
1 . They object to the potential for noise , dust and danger to their children
all caused by heavy equipment operating in the area .
2 . They feel that the Rexburg Master Plan should be followed where the
ultimate goal would be to have this area zoned residential, either
R-1 or R-2.
Chairman jim Keller stated that the impact area only deals with sub-divisions of
four or more divisible parcels of land and that H & K would not fall under this
ruling if they intend to keep the parcel intact .
Mayor Porter stated that the airport and the golf course are properties owned by
~. the city but not annexed into Rexburg City. His feeling was that H & K be issued
a temporary use permit for five to six years in order to fill in the hole and then the
property should be annexed as R-1. Mr. Sauer felt that this kind of arrangement
could be worked out with his company aiZd he would approach th e president of the
company to see if this would be agreeable. If it is agreeable, Mr. Sauer would
request annexation of the property into the City of Rexburg with anon-complying
use permit which would expire when the gravel pit is filled . Moved by Wood
Miller and seconded by Jim Morris that the matter be tabled pending the request
from H & K for annexation. Passed unanimously.

Boyd Clark has constructed a 4-plex on property south of the Rexburg City
Post Office. A question has been raised by the City Building Inspector con-
cerning parking to the east of the 4-plex where access must come across the
sidewalk area . Apparently, there has been problems during the last winter
with the sidewalk being blocked by people using the parking area. Mr.Clark
felt that parking in front of the 4-plex on the east side was approved by the
Planning and Zoning Commission in a meeting held September 8, 1977. A
review of the minutes did not clearly show what decision was made in the
September 1977 meeting. A review of the minutes in December of 1977 showed
that the Planning and Zoning informed Mr. Clark his property must meet all
requirements for an R-2 zoning . R-2 zoning will not allow parking in front
of the complex without proper setbacks from the street. Mr. Clark felt since
there were many violations of this regulation, that he should be allowed a
variance in order to park in front of his property. After considerable dis-
cussion, it was moved by jim Flamm and seconded by Gale Weber that Mr.
Clark's request for a variance to park in front of the 4-plex be denied . The
vote was 5 in favor of denial and 2 abstained .

Item #3
Lyle Thompson presented the Sherwood Hills Estates sub-division plat
requesting consideration of a 60 ft. right-of-way instead of a 65 ft. right-
of-way on 5th South and with an alignment modification in order to get
around an obstacle at 5th South and 2nd East. He also requested that the
Rolling Hills sub-division have 5th South designated with a 60 ft. right-of-
way. After discussion with the Planning and Zoning Commission, he agreed
to go a 44 ft . wide street , curb to curb , on 5th South with a 10 ft . utility
easement on the front of the lot adjoining 5th South and a 60 ft. right-of-way.
He also agreed to a 100 ft . tangent modification on the curve to avoid the
obstacle . In addition, he agreed to one access going south from 5th South at
Yale Avenue . Moved by Chuck Frost , seconded by Whitey Brock , that tl~e se
changes be incorporated in revised preliminary plats to be re-submitted to
the Planning and Zoning Commission. Passed unanimously. This information
will' supersede previous: minutes of December 14 , 1977 , Item $k4 .

Venla Wright owns property at 2nd South and across from College Avenue , the
old brown photograph studio. She has had problems with mud and water getting
into her house at the back when it rains , and proposes to fill in the area with
a concrete floor and add 2 bedrooms for her personal use. She does not intend
to rent the bedrooms out. Moved by Alice Tout, seconded by Wood Miller that
a building permit be issued for her to build the two bedrooms : Five in favor,
one opposed.

areas to be used in the vicinity of the Fine Arts Building. After a lively dis-
cussion, the Planning and Zoning Commission felt that .parking in the vicinity
of the Fine Arts Building could be very tight and may present problems when
simultaneous events are held at the Campus in both the P.E. Building and the
Fine Arts Building. This information will be relayed to College officials for
their consideration. Chuck Frost also presented information concerning 9th
South versus the 7th South access into the Campus . Chairman jim Keller
felt that the College should carefully consider access at 7th South and the
way it would tie the Campus into the rest of the City. The Planning and
Zoning Commission was informed that President Hafen of Ricks College was
meeting with the Executive Committee and the Board of Trustees at Ricks to
discuss .the access to the College at 7th or 9th South. The Planning and
Zoning Commission was also told that the Board of Trustees for Ricks College
are very hesitant to open up a major thoroughfare through the Campus at 7th
South, but that the Trustees may look favorably on working with the City and
the County for a route at 9th South, crossing the College property. President
Hafen will report back to the City Council and the Mayor the results of his
conversation with the Board .
