Meeting held April 12 , 19 78 , at the City Council Chambers , City of Rexburg .

Minutes of the meeting held March 8, 1978 were read and approved.
Follow-up items from the previous minutes:
1 . The construction on the Mill Hollow Mobile Home Park is now beginning .
The land will be leased to the owner, Gene Palmer, by the BOR on July 1 .
Curb and gutter installation has been started .
On April 3, 1978, a public hearing for annexation was held on the Zachreson
subdivision. There were no objections held at this hearing and the matter
will be presented to the Planning and Zoning Commission.
New Business:

The Rolling Hills Estates subdivision was presented by Thompson Engineering,
owner, Vilda Clark. There was some discussion concerning the water pressure

Bench and there is inadequate water pressure from the current Rexburg City
water system . Any property owners in the new subdivision will have to have
either a pressure tank in their home or else the entire subdivision will have to
have a special cistern pump pressure system. The subdivider understands this
problem. Letters were presented to the Planning and Zoning Commission from
the owner and a reply from Rexburg City Mayor John Porter concerning the pressure
system and sewer hook-ups . The Mayor has committed sewer hook-ups in the
subdivision to the subdivider. See copies of letter attached. The street access
to the subdivision was discussed to some length. The subdivision plat needs to
have a 65 ft . right-of-way for 5th South Street with a 5 0 ft . street . Street signs
will also be required . A motion by Bob Purrington, seconded by Whitey Brock
was discussed. The motion is as follows: The developer will follow the restrictive
covenants as recorded for Division 1 of the Rolling Hills subdivision and use the
same covenants in Division 2. Further, that the subdivision plat be approved as
drawn except that 5th South be 65 ft . in the right-of-way and 50 ft . curb to curb .
This motion passed unanimously.
Item $k2
A 4-plex for 122 North 4th East presented to the Commission by Gill Hathaway
Construction Company, Owner, Donald Donahue . This property is currently •
zoned R-2. The 4-plex as presented was 780 sq. ft. The code requirements
specify a minimum of 800 sq. ft. There was also some question whether the

lot size met the minimum requirements as outlined in the City codes . The
property line on the street may be 20 or 30 feet behind the curb. Moved by
Jim Morris , seconded by jim Flamm that the 4-plex be denied until more data
can be obtained on the plot plan showing the deeded property lines . Further,
that the denial specify that future submittals must have an 800 sq . ft . minimum
floor space per unit. This motion passed unanimously.
Item $k3
A commercial property development at 5th South and 2nd West presented by
Bryan Burt, owner Bowen, Thomason, Lee and Seeley. This commercial sub-
division plat consists of approximately four square blocks bounded on the
south by 7th South, on the north by 5th South and the west by 3rd West and
on the east by approximately lst West. After some discussion, the following
items were determined: Sewer hook-ups in this subdivision have not been
approved by the City. The subdivision plat needs to have a connection at
6th South going. west to 2nd West Street. This connection should be 70 feet
right-of-way with a 60 ft . curb to curb street . Motion by Chuck Frost , seconded
by jim Morris that the subdivision plat be approved as noted except that there be
a 15 ft. easement at 3rd West and a 15 ft. easement at 6th South for existing
utility lines and that the 6th South be drawn in the subdivision plat at 70 ft .
right-of-way, 60 ft. curb to curb street dimension.

~~ The Zachreson subdivision located approximately at 5th West and Park Street
presented by Bryan Burt, owner Mr. Zachreson. After some discussion con-
cerning access to the property, the following points were established:
The street width should be 65 ft. right-of-way. There is a possibility of
a platted street into the property at 3rd South which is not shown on the
proposed subdivision plat . This question will be investigated by Alice
Tout. The west edge of the property should include an easement through
..:~ ;light Cook's land in order to get to the new church property. This item
'~ ~ °" ~ ~ was tabled for further study .

A request to re-zone 3rd North Street between 2nd and 3rd West on the north side
from industrial to R-3 presented by Alan Croshaw representing a group of the local
property owners . After some discussion, it was determined that this area presently
zoned industrial is shown on the comprehensive master plan to be R-3. Mr.
Croshaw was informed that down zoning the property at this time would be a very
difficult situation since commercial developers may have purchased property in
the block, planning to construct businesses there. While the Commission sym-
pathized with the problems of Mr. Croshaw, it does not seem, at this time,
feasible to try and down zone the property. However, Mr. Croshaw could go
ahead with a re-zoning petition if he so desired, or he was given the option of
waiting until the comprehensive master plan is adopted as an ordinance and then
try to make the change .

Teton Villa presented by Terry Kidd, owner is OMD Corporation, Salt Lake City,
They requested permission to construct a convenience store in the Teton Villa
housing development for use of patrons living in the area. Mr. Kidd was in-
formed that the zoning ordinance prohibits commercial development in R-3 zones .
The new comprehensive plan may allow it as a neighborhood commercial area when
the comprehensi~re plan is adopted . However, at this time , there is no possibility
of changing the zoning for a convenience store in that housing complex without a
complicated and protracted zoning hearing. Mr. Kidd will inform the owners of
Teton Villa that this approach is probably not practical at this time .
Other Business
Item #1
The Planning and Zoning Commission recommend to the City Council that the
Dunn Trailer Court on 3rd North be reviewed for compliance with the R-3 zoning
requirements and also for compliance with the trailer court ordinance as listed in
pages 9 and 10. There should be specific attention made to compliance with public
health codes. Neighbors living in the area of the trailer court have complained
about the appearance and organization of that trailer court .

The Planning and Zoning Commission recommend to the City Council that the
comprehensive master plan be adopted along with the impact areas as defined
in maps a , b , and c , at the end of the document . The Commission further
recommends to the City Council that the mandatory referral area outside of the
Rexburg city limits be negotiated with the Madison County Planning and Zoning
Commission. This would enable the City of Rexburg and Madison County to
cooperatively work together for approving of subdivision platts that are immediately
outside the city limits of Rexburg City. This would insure that future subdivisions
would meet Rexburg city Subdivision ordinances and would tie in with all city
services required . We also recommend that the City Council adopt the boundary
line designation shown on map b, defining areas between Rexburg City and Sugar
City .
The meeting of the Planning and Zoning Commission was adjourned at 11:05 p.m.
