Bob Purrington Alice Tout Leonard Longhurst Chuck Frost Wood Miller LJhitey Brock Gale Weber Meeting held December 14, 1977, at the City Council chambers - City of Rexburg Meeting called to order at 7:38 p.m. by Chairman, Jim Keller Minutes of the previous meeting were read and approved Follow-up assignments were as follows: Leonard Longhurst will invite the Fire Chief to the next regular meeting to discuss the 20' set-backs on the~rear of building lots and the necessity of fire access. r~~ LJ Alice Tout to check with the City Attorney on the access to the Wally Robison PUD. Wood Miller to check with Frank Jenkins to see if the hearing is scheduled through the City Council. Jim Keller to check with the Mayor on the Bob Cureton property to see if permission was given to begin construction. City Council Gave Authorization. Jim Keller to check to see if the Council Member from the City Council will attend future planning meetings. The following items were discussed with decisions reached during the planning meeting: 1. A Request to re-zone Block "25" west portion R-7_ Sponsor, Citizens Group/Norman Ricks, presenter, Ciiuclc Frost. The Citizens Group representing all of the property owners on the caest-side of block "25" have requested that their property be re-zoned from commercial R-2. This zoning request change is made by the citizens in order to protect the future property values on their new homes. .Moved by Gale Weber and seconded by Wood Miller that this zoning request be approved. It was passed unanimously. A hearing will now be recommended to the City Council for public input. Hearing Feb. 1 City Council Chambers. • 2, Zoning Variance on Property at 2nd East and 3rd South Sponsored by Don Packer, presented by Don Packer. It is approximately. 50' deep and 135' wide. He requested a zoning variance to build a house on the land. The house would be located 31' from the east sidewalk and 31'6" from the south sidewalk. He would declare the area by the alley-way as a back yard and would have parking for one apartment with entrance off the alley-way. Mr. Packer decided to have his home plus an apartment for students included in the building plans. He asked the planning and zoning commission to consider -2 - 3. 4. the variance which would allow him to build on a 50' wide lot. The minimum • required Iot under current law is 60'. A motion by Whitey Brock and seconded by Alcie Tout and was passed uanimously that he be allowed the requested variance. Medical Center Proposal Millhollow Drive Sponsored by Jack Randall, presented by Roger Hoopes. Mr. Randall proposes to build a medical clinic on the property located east of new Madison County Hospital_ This item was presented to the Planning and Zoning Commission on September 20, 1977. At that time, the recommendation was made that a hearing could be held, but that Mr. Randall should submit plans to the board detailing how he intends to use the property. Mr. Hoopes was advised that this planning should be completed and that a plot plan be made for a presentation to the Planning Board on January 11, .1978 meeting. - Sherwood Hi11s Apt. Sponsored by Dave 1tiTeston and others, presented by Lyle Thompson. This plat is located between 5th South and 4th South at the southern terminus of Harvard Avenue. It is in the area just to the east of the existing Mansard Village. Parking for the condominiums included as part of the design needs to be considered. The Harvard street must have a continuation with the standard width from 4th So. to 5th So. The City has already been obligated to extend 5th So. into the property connecting at Harvard Avenue. The developer then will assume the responsibility for completing 5th So. from. Harvard Avenue to the east end for the proposed plat. Easements throughout the plat plan are planned for 10' on each side of the property line or a total of 20' easement. Mr. Weston.._i is concerned that sewer connections have been promised to other developments in land annexed to the City. He feels that sewer connections for his property which has been within the City limits for many years should have first priority. The recommended street widths are 40' for Yale Avenue and 3rd East and 50' for 5th South (See minutes 6/12/78 Item 1~3 for revision) and Harvard Avenue. Each street would have sidewalks. Mr. Weston would also like to have town houses approved for several lots within this property. The general layout of the Sherwood Hills subdivision was deemed suitable and the proposed project looked good to the Commission. Moved by Leonard Longhurst and seconded by Chuck Frost that the plat as designed be accepted and presented to the City Council for approval. This motion was passed unanimously. 5. Commercial Property Designation for Land West of Airport on Highway 88 Sponsored by Jack Kerbs, presented by Jack Kerbs. Mr. Kerbs owns property on the south side of Highway 88, approximately the area where the future new highway will cross Highway 88. In fact, the proposed interchange will be in the middle of his property. He will have 25 acres on the left side of the interchange and 8 acres on the east side of the interchange. Mr. Kerbs was concerned that the map showing proposed land-use planning listed his property as residential R-l, and he requested that the land be shown on the map as commercial properties. After some discussion, the follotaing was agreed to: Commercial properties will be shown on the map .for 300' depth and the width from the existing airport to the edge of the impact area on the north of I-Iighway 8$. Mr. .Kerb's property on the-south side will also be shown as commercial • property to the relocated canal. These changes to the proposed land-use plan. will be made by Jim Keller prior to the publication of the drawing in the paper. ,! .~~: L' -3J- Sub-Division Plat Sponsored by H & R Development, presented by Bryan Burt. Mr. Burt presented an updated plan for a sub-division spon"sored by H & R Development north and west of Rexburg. This property is not continuous with the City. At the request of the Planning Commission during last month's meeting, the owner has re-designed the entrance way so that there is a four-lane road leading to and from the property. After some discussion, the Planning Commission did not feel that this road met the requirements of a second access. moved by Alice Tout and seconded by Gale T,deber, that the proposed plat have two access roads as a requirement. The vote was four (4) in favor and three (3) obstaining. An amendment to the motion was then made that the plat include a perrianent emergency access approximately 10' by Chuck Frost and seconded by Leonard Longhurst, The vote was five (5) in favor and two (2) obstaining. As a result. of these discussions, Mr. Burt will go back to the owners and discuss the problems of providing adequate access from a second roadcaay on this project. Second: road drawn in and platt approved by City Council. 7. 11th, 12th, 13th Ward Plat Sponsored by Rexburg Stake, presented by Bryan Burt, The proposed plat for the new church was discussed, The Planning and Zoning Commission felt that a second access to Highway 88 was urgent, and that Park Street would not carry the traffic that will be generated by the church. Moved by Wood Miller, seconded by Gale Weber that the plat as presented be approved with the provision that there be a second access to the property provided from Highway 88, This motion passed unanimously. g, Commission Business a. A question caas raised concerning caho should rule on various annexations zoning actions. Does the Planning and Commission Board conduct hearings on annexation or zoning actions? Does the City Council conduct hearings on zoning requests or should the Planning and Zoning Commission do that? Alice Tout will check these issues with the City Attorney. P & Z commission conducts annexation hearings. City Council conducts zoning actions. b. Regional. land-use planning and the proposed impact area map Baas discussed. The changes made in the map during tonight's meeting will be completed by Jim Keller. Members of the Planning and Zoning Commission will meet on Wednesday, December 21 at 7:30 p.m. to compile questions to be used during a full-page advertisement. This meeting will be held in-the Mayor's office. Reviewing dates on the regional land-use will be scheduled for January 12 and January I9 at 7:30 p.m. in the town court house. Chuck Frost will arrange for these meetings. A greenbelt/flood plain needs to be indicated on the regional land-use map for a space of about 200'. on either side of the river. In addition, a commercial zone should be shown on the north side of Rexburg rather than an industrial area. On the south side of Rexburg on Highway 19I leading into town should also be shown as a commercial area and not an industrial area. Moved by Bob Purrington, seconded by Alice Tout that the Planning and Zoning Commission agree to the land-use map with the changes mentioned in these minutes, This motion passed unanimously.
