HomeMy WebLinkAboutP&Z MINUTES AUGUST 25, 1972The Planning Board met in a special session on August 23, 1972 at 7:30 p.m. Members present were Larry Perkins, Gale Weber, Blair I~fanwaring, Wood Miller, Glenn Petersen, Max Brinton, and Lenore Passey. Guests were Arlo Nelson, Clyde Anderson, Brent ~.mes, Kent Jolley, Lester Petersen and Lyle Moon. The first item of business was the telephone company office in the Professional Plaza. Mr. Jolley discussed the type of business which would be cared on in this office. He introduced Clyne Anderson, telephone company manager, who outlined a typical day in their off ice, based on statistics gathered from the preceding year. He stated that the office would have about nine women employees. The Rexburg office is the area headquarters for both fit. Anthony and Rigby. Records would be dept here and eallections made from customers. Approximately 40 customers co~ild visit the office daily in peak season. ~,ch customer averages about five minutes spent in the office. There would be the regulation Mountain Bell sign approximat e 1~ Feet in height on the building. There would be no lighted signs. ~Ir. Jolley said that sore federal offices might soon be established in the Plaza. The Board suggested to the owners of the Plaza that they 'set up Restrictive Covenants in order to set the pattern of land use. NIr= Arla~:Nelson suggested that such an area as the Plaza now occupies should be designated as a limited office district where retail businesses and personal service establishments be prohibited. Real estate offices are oauestionable in such a district. ~trin.gent sign control must be in effect. Mr. Jolley was willing to enforce Protective Covenants. It was ...pointed out that the city must not enter into enf oreement of Protective versants. ~r. Nelson stated that in a limited office district or conditional _~.trict, professional offices or multiple use buildings could _~_ be permitted. Ordinances must have flexibility in order to allow design for planned unit development. The land uses must be compatible with each other. The concept should be desirable. Ordinances should. challenge the Planning and Zoning Board to create desirable communities. Next on the agenda was the problem of mobile homes. NSr. Nelson advised that a mobile home zone or district be specified _ for a particular area tather than permitting mobile homes to be placed at random throughout R 3 ar Commercial Zones. He said they definitely shouldn't be in Tndustrail areas. He suggested the creation of mobile home developments, wither parks or sub-divisions (which would follow the sub-division ordinance). The regulations for these developments would differ from single family home areas.. Construction of fences or some type of view-abscuring landscape buffers should be mandatory. The Uniform Building Code is a weak tool for mobile homes. This Code should, be amended. If permission is granted to place a mobile home in an unauthorized zone, it should be specifically stated that at the end of a limited number of months it must be removed. however, the permit could be renewed for a short period thereafter. City ordinances should be updated to allow for comprehensive uses. There should be a direction of policy or policy statement for the comprehensive plan. Neither the Planning Board nor the City Council can change zoning without proper hearings. Neither can they permit the breaking of any existing ordances. Use variances must only be allowed because of unusual circumstances and can't create their own hardship. Ordinances should cover a specif is time. dome ordinances should cover only the older sections of town with new ordinances for the new or future developments. There should be a Hoard of Ad3ustment to solve the inequities. Ordinances should rely on related land uses. Conditional uses, _3_ ` distinct in character but related to other uses, require a public hearing of all residents within 300 ft of the area in question. Residents should be notified by registered letter. A Hearing is necessary so that uses can be made compatible. The Planning Board can rule on conditional uses. A design review is advisable as it creates felxibility. ~i°"Glenn Petersen made the follow~.n~ motion, seconded by Blair 'Nanwaring Regarding any further construction in Professional Plaza the plan plan should be presented to the Planning Board and the City Council. In the discussion with the owners of Prafessional Plaza it was decided that R 1 requirements apply to the entire plaza in that the city hays I no Qrdinance to cover this particular type of development. Mr. Jolley agreed with this decision. The Planning Board could then take under consideration any variances which might occur in further construe ' tiara and make recor~mendatzons to the City Council. ., ,A vote of the Planning Board members was taken on the telephone company office being constructed in the plaza and the folloUring members voted. in fa~ror of it :: t~taod, Blair, Glenn, Lenore and Gale. ~r~e therefore recommend acceptance to the City Council. ~Iax was requested to cheek ors changing the cross walk on T~?ain attest just east of College Avenue. The present cross vralk restricts traffic attempting to turn east. Meeting adjourned at 11:30 p.m.
