Vacating "Sky Meadows" Plat
AN ORDINANCE VACATING A PORTION OF THE PLAT KNOWN AS
"SKY MEADOWS" IN THE CITY OF REXBURG, IDAHO; PROVIDING
FINDINGS; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, an application requesting vacation of a portion of the
recorded plat known as Sky Meadows, located at approximately 1228 Stone Dr in
the City of Rexburg, Idaho, (26-00383) was submitted by Sky Meadows
Development, LLC; and
WHEREAS, the City Council has reviewed the application and all
materials submitted in support thereof; and
WHEREAS, notice of a public hearing was provided in accordance with
the requirements of Idaho law; and
WHEREAS, the Rexburg City Council conducted a duly noticed public
hearing on June 17, 2026, at which all interested persons were afforded an
opportunity to be heard; and
WHEREAS, after considering the evidence and testimony presented, the
City Council finds that the requested vacation is consistent with applicable
provisions of Idaho law and serves the public interest.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY
COUNCIL OF THE CITY OF REXBURG, IDAHO:
SECTION I. FINDINGS OF FACT. The Rexburg City Council hereby
finds:
1. The application for plat vacation has been processed in accordance
with the requirements of Idaho Code and applicable ordinances of
the City of Rexburg.
2. Proper notice of the public hearing was provided.
3. The proposed vacation will not adversely affect public health,
safety, or welfare.
4. The proposed vacation will not unreasonably interfere with existing
access rights, utility facilities, drainage facilities, or public
infrastructure.
5. Any necessary utility easements and public rights have been
preserved, relocated, or otherwise addressed to the satisfaction of
the City.
6. The proposed vacation is in the public interest and should be
approved.
SECTION II: CONDITIONS OF APPROVAL. This plat vacation is
approved subject to the following conditions:
1. All required signatures and acknowledgments shall be obtained prior to
recordation.
2. Any utility easements intended to remain in effect shall be preserved by
separate instrument or shown on the vacation document.
3. The applicant shall be responsible for all recording fees and associated
costs.
4. The applicant shall comply with any additional conditions imposed by the

City Council during approval of the application.
SECTION III: VACATION APPROVED The City Council hereby
vacates the following portion of the recorded plat:
Legal Description:
LOTS 1-5, BLOCK 1; LOTS 1-20, BLOCK 5; LOTS 9-18, BLOCK 4; AND LOTS 1-9 AND
16-22, BLOCK 4, FINAL PLAT OF SKY MEADOWS, LOCATED IN THE SOUTHWEST
1/4 OF THE SOUTHWEST 1/4 AND THE SOUTHEAST 1/4 OF THE SOUTHWEST 1/4 OF
SECTION 32, TOWNSHIP 6 NORTH, RANGE 4o EAST, BOISE MERIDIAN, MADISON
COUNTY, IDAHO
The area vacated by this Ordinance is depicted on the map below.
SECTION IV:SEVERABILITY. If any section, subsection, sentence,
clause, phrase, or portion of this Ordinance is for any reason held invalid or
unconstitutional, such decision shall not affect the validity of the remaining
portions of this Ordinance.
SECTION V. EFFECTIVE DATE. This Ordinance shall be in full force
and effect upon its passage, approval, publication, and recordation as required by
law.

MAYOR on this 15th day of July 2026.
