HomeMy WebLinkAboutJonathan & Barbara Goss - Dispute LID Charges August 3, 1926 To: The City Council We would like to dispute the charges that are being levied against 539 South 5th West as per letters dated 16t" day of July 2026 regarding 539 S 5t" W Item #91 for the amount of $372.72 21St day of July 2026 regarding 539 S 5t" W Item #91 for the amount of $3,478.72 During the original L.I.D. 54 meetings we were told that we would not have any costs incurred due to the fact that our properties (which include 509 South 5th West and 525 to 539 South 5th West) were actively listed for sale giving us a few years to pursue that outcome. This would be saving us the cost of a huge expense for cement work that would be torn up and redone when these properties sell. While H&K was doing the excavation, we told many of their employees, including Tom Millard, repeatedly that they were not supposed to be doing any work on our properties and that the city had granted us permission to wait. We asked them several times to call Keith or Brett to verify what we were telling them. To our knowledge no phone calls were ever made. The contractors continued excavating so one day when we saw Brett McDermott on the road visiting the project, we asked him to explain to the contractors to not do any more work on our properties and to fix what had been done. He reiterated to both of us not to worry, that it would not be our responsibility to pay for any of the work done. He told us and H&K employees that it was a miscommunication between the City and H&K and that they were not supposed to be doing any approach or sidewalk work on our properties, that the City would pay these costs due to the misunderstanding between them and the contractor. Thank you for your consideration in this matter. Jonathan & Barbara J. Goss Jenco Enterprises Barbara J. Goss General Partner
