NOTICE IS HEREBY GIVEN, that on August 20, 2026, at 6:30 pm a Public Hearing will be
held before the Planning & Zoning Commission of the City of Rexburg, Idaho, at City Hall located
at 35 North 1st East, Rexburg, Idaho, regarding a Conditional Use Permit (CUP) (#26 00649) to
permit a cell tower within Regional Business Center (RBC) zone, per the Rexburg Development
Code as a Conditional Use. The said property is located at approximately 1450 N 2nd E in Rexburg,
Madison County, Idaho, and more particularly described as follows:
Legal Description:
A parcel of land located in Lot 1, Block 1, Moody Creek Subdivision, Instrument No. 399738,
records of Madison County, Idaho, in the Southwest Quarter of Section 8, Township 6 North,
Range 40 East, Boise Meridian, Madison County, Idaho, more particularly described as follows:
Commencing at the northeast corner of Lot 4, Block 1, Moody Creek Subdivision, from which the
southeast corner of Lot 3, Block 1, said Moody Creek Subdivision bears South 00°15’00” East, a
distance of 508.30 feet; Thence South 88°22’22” East, a distance of 928.89 feet to the Point of
Beginning; Thence North 00°00’00” East, a distance of 60.00 feet; Thence South 00°00’00” East, a
distance of 35.00 feet; Thence North 00°00’00” West, a distance of 60.00 feet; Thence North
00°00’00” East, a distance of 35.00 feet to the Point of Beginning; Containing 2,100 square feet or
0.048 acres, more or less.
SUBJECT TO:
Existing rights-of-way and easements of record and or appearing on said above described parcel.
At such hearing the Planning & Zoning Commission will hear all persons and all objections and
recommendations relative to such proposed permit. The City Clerk will also accept written
comments at City Hall or emailed to clerk@rexburg.org prior to 4:00 p.m. on August 19, 2026.
This notice is given pursuant to the provisions of Section 67-6509 and 67-6511 Idaho Code, and all
amendments thereof.
