The property is located behind the ICCU on 2nd E, at the west end of 7th North. The annexation applies to a total of approximately 300 acres. The Comprehensive Plan designation is Industrial, and the zoning is Heavy Industrial (HI). Neither the Comprehensive Plan designation nor the zone will change at this time if the annexation is approved. A total of 21 hearing notifications were mailed to surrounding property owners. Pending public testimony, Staff asks that the Planning & Zoning Commission consider recommending that City Council approves the application. Project Description The applicant is requesting to amend the boundaries of the city limits and is connected to city water. The request would bring approximately 300 acres into the city limits. The property is in the area of impact and adjacent to city boundaries. (See attached vicinity maps) The property is zoned as Heavy Industrial (HI). The Comprehensive Plan designation is Industrial. Neither the Comprehensive Plan designations nor the zoning will change at this time if the annexation is approved. (See attached current zoning maps) Applicable Laws and Codes State Statutes: §50-222 City of Rexburg Ordinance 1200 Development Code Considerations for Approval In evaluating requests for amendments, the Commission shall consider the following: The request’s conformance with the City’s Development Code. The request’s conformance with the City’s Comprehensive Plan. The capacity of existing public streets, water and sewer facilities, storm drainage facilities, solid waste collection and disposal, and other utilities. The capacity of existing public services, including but not limited to, public safety services, public emergency services, schools, parks and recreational services. The potential for nuisances or health and safety hazards that may adversely affect adjoining properties. Recent changes in land use on adjoining properties or in the neighborhood of the map revision. Land use impacts that may need to be mitigated by conditions include the following: An increase in daily or peak hour traffic. A change in circulation patterns on or around the property. A significant increase in the demand for parking. A change in the density of people on site. Expansion of the hours of operation. Any increased environmental impact, such as noise or air pollutions; offensive odors; excessive illumination or glare, etc. Analysis/Potential Impacts/Recommendation The request’s conformance with the City’s Development Code. Staff have determined that the request meets the City’s Development Code requirements. (See Staff Approval Summary) The request’s conformance with the City’s Comprehensive Plan. (See Staff Approval Summary) The capacity of existing public streets, water and sewer facilities, storm drainage facilities, solid waste collection and disposal, and other utilities. Public Works has approved the request. (See Staff Approval Summary) The capacity of existing public services, including but not limited to, public safety services, public emergency services, schools, parks and recreational services. The Fire and Public Works departments have approved the request. (See Staff Approval Summary) The potential for nuisances or health and safety hazards that may adversely affect adjoining properties. None identified. Recent changes in land use on adjoining properties or in the neighborhood of the map revision. New developments further north along 2nd E such as Winco Foods, the new temple, and the Homestead assisted living. Staff recommends that pending public testimony, the Planning & Zoning Commission recommend to City Council to annex the above described properties into the city limits of Rexburg. Decision Options The Planning & Zoning Commission may recommend Approval of the application, recommend Approval with Conditions, or recommend Denial of the application.
