Hi Steven,
Just checking in to see if you have an update on the Teton Vu Estates plat. Has the
Development Agreement been signed and returned to the city? Have the fees been paid yet?
Have mylars been printed yet?
The recording extension will expire April 2, 2026, so the plat will need to be recorded with
Madison County prior to that date.

Katie,
Here is what we say in the development agreement about payment of fees. The agreement will
need to be signed before the plat is signed or any construction starts.
11. PHASING: The Developer has proposed to plat the entire development, but to construct
the proposed buildings in phases as shown on Exhibit A-2. The City agrees to the following
schedule for payment of development agreement fees:
Prior to the City signing the approved plat: 20% of fees = $23,120.54
Prior to issuance of building permits for Phase 1: 20% of fees = $23,120.53
Prior to issuance of building permits for Phase 2: 20% of fees = $23,120.53
Prior to issuance of building permits for Phase 3: 20% of fees = $23,120.53
Prior to issuance of building permits for Phase 4: 20% of fees = $23,120.53
Any remaining development agreement fees will become due 5 years after the effective date of
this agreement, regardless of whether all phases have been constructed.

Hey Katie! We're about to finalize the lending which will get all our soft costs- including
the first payment for the development agreement. Then we'll have the use fees and
second payments made prior to getting our CO on the first two buildings, and the third
payment prior to the CO on the next two, and moving forward from there.
I appreciate your patience and will send confirmation and get the payment sent in for the
first draw.

City Council approved the six month plat recording extension. The new plat expiration date
is April 2, 2026. Prior to April 2, 2026, the development agreement will need to be signed,
the development agreement fees paid, and the mylars printed, signed, and recorded.

Extensions allow an additional 6 months to sign Development Agreements, pay
Development Agreement fees, collect signatures and record the mylars.
The following is from the Mylar instructions.
Please keep in mind that per Rexburg’s adopted code, the Plat must be filed with the
County Recorder within 6 months of City Council’s approval. Failure to do so will
render the approval null and void. If an approved Plat expires, a new application
must be submitted and processed for reconsideration. If there are complications
that will prohibit the Plat from being recorded within 6 months of City Council
approval, an extension may be requested (please communicate with the Planning
and Zoning department for the stipulations of the extension).

Hi Steven,
Just a reminder that the City requires the Development Agreement to be signed and the
Development Agreement fees to be paid before the City will sign the mylars.
Mylar instructions are below:
10.03.070 Request For Mylar
Once all revisions from staff reviews, County Surveyor, Commission and/or Council
amendments have been made to the Plat, the City of Rexburg Staff will request the final Mylar
be printed. The final Mylar shall show all revisions.
1. All plats to be offered for recording shall be on transparent tracing(s) that show all
pertinent information that was approved on the Plat.
2. The approved Plat is to be recorded on clear Mylar silver emulsion with an overall
dimension of eighteen (18”) inches by twenty-seven (27”) inches. (Idaho Code 50-1304)
3. Required Certifications.
1. Signature of the following show approval or completion. Please seek signatures in
the order they are listed.
1. Professional land surveyor – Surveyor shall state on plat that plat is correct,
accurate, and monuments described have been located, installed, and
described
2. Examining Land Surveyor (Madison County)
3. Sanitary restriction being lifted (Health Department after approval by
D.E.Q.)
4. Treasurers Certification of taxes paid
5. City Planning & Zoning Administrator
6. Certification of plat approval by the City Engineer
7. Certificate of approval by the City Clerk
8. Certificate of approval by City Council (Mayor)
9. Recordation by County Recorder
1. Development Agreement. Before the Plat will be signed by the City, the Development
Agreement shall be executed and the Development Agreement fees shall be paid.
Madison County will require 1 mylar and 1 paper copy of the plat for recording. After the
Development Agreement has been signed and the fees have been paid, please bring the
plans in to Planning & Zoning for signatures 5-8. After the plat has been recorded with
Madison County, please provide a copy of the recording information in order to finalize
the permit.
Please keep in mind that per Rexburg’s adopted code, the Plat must be filed with the

Hey Katie! We are moving forward on it soon. I am expecting our funding to come
in by mid July and we’ll have everything up and running shortly after that! I’m
working with a different contractor, and they’ll be running things for our project
moving forward. It’s New Peak.
Once this all happens, we’ll move forward with the all the Mylar prints and getting
the development fees paid up. I’m guessing we should have it all done within the
next 30 to 45 days.
