ORD INA N C E ZONE CLAR IFIC ATION S JA NU ARY 2026
N OW THE REFOR E, be it ordained by the C ouncil of the City of Rexburg, in the
State of Idaho, as follow s:
SECTION 1: A MEND MEN T “1.04.020 Amendments To This O rdinance”
of the Rexburg Development Code is hereby am ended as follows:
A M E N D M E N T
1.04.020 A mendments To This Ordinance
The Council may, by ordinance, after receipt of recommendation from the Commission and
subject to procedures provided by law, amend, supplement, change, or repeal the regulations,
restrictions, and boundaries or classifications of property. Such amendments may include text
amendments or map revisions.
A.Initiation of Ordinance A mendments. Amendments to this O rdinance may be
initiated in one of the follow ing w ays:
1.A pplication. (See subsection 1.04.010.) B y the filing of an application by a
property ow ner or authorized agent w ith the area proposed to be changed by
the amendment. The applicant shall provide the Zoning Administrator w ith the
follow ing additional information:
a.N arrative Statement. A statement on how the proposed amendment
relates to the Comprehensive Plan, availability of public facilities, and
compatibility w ith the surrounding area and zoning.
b.A rea of Impact. In the event an application for rezoning received by
the Commission requests a rezoning of any lands that lie w ithin one
quarter (1/4) mile of any boundary of the Sugar City A rea of City
Impact, the Commission shall provide the City of Sugar City w ritten
notice of the application for rezoning.

B.Zoning Map R evisions. C omprehensive Plan A mendment. If the request for
zoning amendment is not in accordance w ith the C omprehensive Plan, the
Commission shall consider and the Council may adopt or reject an amendment to the
Comprehensive Plan after notice and hearings as provided in Section 67-6509, Idaho
Code. (See following summary table for allow able zoning in Comprehensive Plan
areas.)

C.C ommission C onsideration. In evaluating requests for amendments, the Commission
shall consider, in addition to conformance with the Comprehensive Plan as required by
Section 67-6511, Idaho code, the following:
1.The capacity of existing public streets, w ater and sewer facilities, storm
drainage facilities, solid waste collection and disposal, and other utilities.
2.The capacity of existing public services, including but not limited to, public
safety services, public emergency services, schools, parks and recreational
services.
3.The potential for nuisances or health and safety hazards that may adversely
affect adjoining properties.
4.Recent changes in land use on adjoining properties or in the neighborhood of
the map revision.
D.Other Material R ecommendations. Follow ing the hearing, if a material change in
the ordinance is recommended, other than that published for the present hearing,

further notice and hearings shall be provided before the Commission forwards its
recommendation to the C ouncil.

D evelopment C ode is hereby am ended as follow s:

The City may be divided into the follow ing zoning districts, the boundaries and extent of
w hich shall be show n on the official Rexburg Zoning Map by the C ity of Rexburg Staff:

SECTION 3: A MEND MEN T “3.02.160 Sidewalks” of the Rexburg
D evelopment C ode is hereby am ended as follow s:

3.02.160 Sidew alks
A.In all zones, all buildings erected, established, or rebuilt shall be required to place
sidew alks per the current City Engineering Standards. (See Appendix.B.)
1.Exempt in Transitional A griculture (TAG ) zones.
B.Mixed Use. Sidew alks parallel to any city street w ithin a Mixed U se (MU) zone shall
be a minimum of eight (8') feet w ide.
C.Sidew alk Access. Projects located w ithin Medium D ensity Residential (MD R), High
D ensity Residential (H D R) or Mixed Use (MU) zones are required to demonstrate

sidew alk access to the B YU -I campus and to the nearest Substantial Commercial
Cluster (See definition in Chapter 2).
D.Parking Lots.
1.Sidew alks. The sidewalk shall be no less than six (6') feet w ide where parked
vehicles overhang the sidew alk.
2.D rainage. Parking lots shall provide adequate drainage w hich shall not run
across or cover a public sidewalk.
E.When a fence is placed adjacent to a public sidew alk in residential zones and no
drivew ay access exists, a one (1') foot landscape strip shall be maintained between the
standard sidew alk and the fence.

4.00.025 R entals
A.R esidential R ental Properties. All residential rental properties within the City in
excess of one rental unit per parcel shall obtain an annual B usiness Registration.

requirements must be met.

available in Madison County, Idaho.

4.00.040 H ome O ccupation
In order to provide for home occupations that are secondary to the use of the premises as a
residence and are compatible w ith the quiet, peaceful nature of a residential neighborhood, no
home occupation shall be permitted without the prior issuance of a Conditional U se Permit or
H ome Occupation Permit or license as required by the type of home occupation desired. Any
business must be registered with the State of Idaho to obtain an EIN number and the City of
Rexburg.

B.Standard Regulations. All Home O ccupations and Businesses, w hether permitted or
conditional, must adhere to the follow ing standard regulations.
1.A ccessory Uses. In all residential zones, home occupations in compliance
w ith the follow ing regulations are permitted as accessory uses.
2.A ppearance. There shall be no change in the outside appearance of the
dw elling or premises or any visible evidence of the conduct of a home
occupation.
3.Boss. The home occupation shall be conducted by the applicant, w ho shall
reside on the premises.
4.D isplay. There shall be no display of products visible in any manner from the
outside of the dwelling.

5.Impact. The home occupation shall not constitute a significant impact on
neighborhoods.
6.In Dw elling or Accessory. A home occupation shall be conducted entirely
w ithin the dwelling or an accessory structure.
7.Interference. N o equipment or process shall be used w hich creates visual or
audible electrical interference in any radio or television receiver off the
premises or causes fluctuations in line voltage off the premises.
8.N uisance. No equipment or process shall be used in a home occupation
w hich creates noise, glare, vibration, or fumes, or odor detectable to the
normal senses off the property.
9.Outside Storage. There shall be no storage of equipment, vehicles, or
supplies associated with the home occupation outside the dwelling.
10.Public Utilities. N o home occupation shall cause an increase in the use of any
one or more public utilities (w ater, sew er, and garbage collection) so that the
combined total use for dwelling and home occupation purposes exceeds the
average for residences in the neighborhood.
11.Signs. There shall be no visible evidence of the conduct of the home
occupation other than one (1) non-illuminating sign not to exceed tw o (2)
square feet in area mounted flat against the dw elling.
12.Traffic. The use shall not create greater pedestrian or vehicular traffic than
normal for the neighborhood.
C.Permitted Uses. Examples of home occupations permitted under this section shall
include but not be limited to:

D.Permitted Use Regulations. A home occupation, which meets the standard
regulations and the following conditions shall be issued a permit by the City Clerk,
upon application and payment of a permit fee, provided that the home occupation is
conducted by the applicant:
1.A dvertising. N o commercial telephone directory listing, newspaper, radio, or
television service shall be used to advertise the location of a home occupation

to the general public.
2.A rea. A home occupation shall be conducted entirely w ithin a dwelling and
shall not occupy more than twenty (20%) percent of the floor area of the
residence.
3.D elivery Services. The home occupation shall not involve the use of
commercial vehicles for delivery of materials to or from the premises other
than vans regularly involved in commercial delivery such as U nited Parcel
Service, Federal Express, or the U nited States Postal Service greater than that
of a standard residential home. The applicant may use his/her personal vehicle,
provided it does not exceed three quarter (3/4) ton, for deliveries.
4.Employees. N o one other than members of the immediate family residing in
the home shall be employed in the conduct of a home occupation.
5.Instruction. If the home occupation is the type in which classes are held or
instruction is given to more than one (1) person at a time, there shall be no
more than six (6) students or pupils in the dw elling unit or on the premises at
any one time. N o more than (2) two sessions shall be held daily. The home
must be ow ner/leasee occupied.
6.Motors. N o motor pow er other than electrically operated motors shall be used
in connection w ith a home occupation. H ome occupations shall not involve
the use of electric motors of more than three (3) h.p.
7.Parking. The use shall not require additional off-street parking spaces for
clients or customers of the home occupation.
E.C onditional U ses. A home occupation w hich does not comply with the Permitted
U ses above may be permitted in all residential zones only if a conditional use permit is
secured. Such home occupations shall comply with standard regulations and the
follow ing regulations:
1.A rea. More than the equivalent of tw enty-five (25%) percent of the floor area
of the residence shall not be associated w ith the home occupation.
2.D elivery. The home occupation shall not involve the use of commercial
vehicles w ith more than six (6) w heels for delivery of materials to or from the
premises. Such deliveries w ould exceed the normal delivery to a residential
home. Deliveries shall be limited to five (5) deliveries per (1) w eek.
3.Employees. N o one other than the residents of the dw elling shall be employed
in the conduct of the home occupation.
4.Hours. No home occupation shall be conducted betw een the hours of 9:00
p.m. and 7:00 a.m.
5.Parking. The use shall not require more than two (2) additional off-street
parking spaces for clients or customers of the home occupation. Such off-
street parking shall not be provided in the front yard unless on a pad existing
prior to commencement of the home occupation.
6.Sales. Unless permitted under the conditional use review process, there shall
be no sales of products or services not produced on the premises.
F.Violation of Standards. If a home occupation permittee violates any of the above
standards as applicable, the home occupation permit may be revoked upon w ritten
notice to the applicant, and the conduct of the home occupation shall cease.

G.A ppeal. To contest a revocation, the applicant shall appeal to the Planning and Zoning
Commission w ithin fifteen (15) days of the date of the written notice.
H.Home Business R equirements. Home businesses are required to have a Conditional
U se Permit and Business License. H ome businesses must meet all the requirements of
the previous H ome Occupations subsection w ith the follow ing exceptions:
1.A ll H ome B usiness applications require a Conditional Use Permit (C UP).
2.H ome businesses are allowed only in the following zones: Transitional
A griculture (TA G) , and Residential Estate (RE), Low Density Residential 1
(LDR1), Low D ensity R esidential 2 (LD R 2) and Low Density Residential 3
(LDR3).
3.A home business may be allowed in up to tw enty-five (25%) percent of the
primary residence or one-hundred (100%) percent of an accessory structure.
4.U p to four (4) non-related employees may be allow ed.
5.Childcare may have up to tw elve (12) children. (The care of additional
children shall constitute a Comm ercial D aycare Center.)
6.The home must be owner/leasee occupied.

C.Setback R equirements.
1.Front Setback. The minimum front yard setback is tw enty-five (25’) feet
from right-of-w ay.
a.Front Yard Reduced Setback. When the street upon which the
parcel fronts has a landscape strip of at least seven (7’) feet, the front
yard setback may be reduced to tw enty (20’) feet from right-of-w ay.
b.R educed Setback for Parking. If all parking spaces are located
behind the building, the front yard setback may be reduced to fifteen
(15') feet.

5.02.070 Lot C onfiguration And D ensity
The follow ing requirements apply to any lot or parcel of land in the TA G zone.
1.Maximum Density. The density shall not exceed one (1) single-family dwelling unit
per five (5) acres.
2.Lot A rea. The minimum lot area allowed is five (5) acres.
a.Exception. Clustering housing of one (1) single-family unit per acre with four
(4) acres set aside for each unit of property is allow ed. (Example: a forty (40)
acre parcel would allow eight (8) one (1) acre lots with homes and the
remaining thirty-tw o (32) acres w ould be restricted from building until
rezoned.)
3.Lot D imensions.
a.Width. The minimum lot w idth allow ed is one-hundred fifty (150') feet.
b.D epth. The minimum lot depth allow ed is one-hundred fifty (150') feet.
c.Frontage. Each lot shall abut a public street for a minimum distance of thirty-
five (35') feet.
4.Permissible Lot C overage.
a.Building C overage. A ll buildings, including accessory buildings or structures
and impervious surfaces, shall not cover more than thirty (30%) percent of the
area of the lot.
(1)Impervious Surface. Concrete or asphaltic cement shall not cover
more than forty (40%) percent of a front yard, fifty (50%) percent of a
rear yard, and one hundred (100%) percent of one (1) side yard.
b.Landscaping. At least seventy (70%) percent of the area of the lot shall be

9.02.050 A pplicability Of Rexburg D evelopment Code In Area O f Impact
A ny zones, w hich are located w ithin the area of city impact, shall be subject to all provisions
of the Rexburg Development Code and any amendments thereto.
A.The follow ing provisions shall apply to TAG zones:
1.D escription of Land and Livestock. Any landow ner having livestock upon
lands located w ithin the area of city impact may, prior to February 15, 1995,
provide to the Planning and Zoning C ommission a description of the land
together w ith a description of the livestock on said lands, w hich shall include
the number of livestock as w ell as the type of livestock located on said lands.
a.Historic Herd Size. The Planning and Zoning Commission shall
review the descriptions as submitted by a land ow ner, and together
w ith the land ow ner determine a historic herd size for the parcel of
land described. The record of historic herd size shall be kept by the
City Clerk and shall be preserved for the purpose of determining
existing land use on said lands as of February 15, 1995.
2.D iscontinued U se. In the event a landow ner shall discontinue the use and
maintenance of livestock on lands described and provided to the Planning and
Zoning Commission for a period of five (5) consecutive years, w hen such use
shall not be reestablished, the uses of the premises thereafter shall be in
conformity with the regulations of the zone district in w hich the land is
situated; provided, that the use and maintenance of a lesser number of the
same general type of livestock on the described lands shall be deemed to
conform to the historic herd size as recorded w ith the City C lerk and will
allow the continued recognition of the historic herd size as the current existing
land use.
3.Expansion or E nlargement of Herd. The expansion or enlargement of a

livestock herd shall be allow ed only by the granting of a conditional use
permit, zone change or variance, as provided by this ordinance and depending
upon the particular circumstances and facts involved.
