HomeMy WebLinkAboutOrd 1344 Annexation & Rezone to CBC of 1600 N 2nd E/ ORDINANCE NO. 1344 Annexation of Approximately 1600 N 2nd E in the Impact Area of the City of Rexburg into the City of Rexburg, Madison, Idaho and Rezone from Transitional Agriculture (TAG) to Community Business Center (CBC) Zone AN ORDINANCE ANNEXING CERTAIN LANDS TO THE CITY OF REXBURG, IDAHO; DESCRIBING SAID LANDS AND DECLARING SAME A PART OF THE CITY OF REXBURG, IDAHO; AND AMENDING AND CHANGING THE ZONING MAP OF THE CITY OF REXBURG, IDAHO, AND THE CLASSIFICATION OF THE SAME UNDER THE ZONING ORDINANCE OF THE CITY OF REXBURG, IDAHO; AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE. BE IT ORDAINED BY the City of Rexburg, Idaho: WHEREAS, the lands hereinafter described are contiguous and adjacent to the City of Rexburg, Idaho, and have been laid off, subdivided or platted, and/or the City has been requested to annex the same to the City of Rexburg, Idaho; and WHEREAS, it appears to the Mayor and City Council of the City of Rexburg, Idaho, that the hereinafter described properties is subject to annexation to the City of Rexburg under and pursuant to the provisions of Section 50-222 Idaho Code, and that said lands should be annexed to and become a part of the City of Rexburg, Idaho; and WHEREAS, the City Council referred the zoning of the affected territory for report and recommendations to the Planning and Zoning Commission, and the Planning and Zoning Commission made its report and recommendations for zoning classification of the hereinafter described properties proposed to be annexed; and WHEREAS, the Council has determined that the proper classification under the Zoning Ordinance of the City of Rexburg, Idaho, for the properties to be annexed is as hereinafter set forth. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF REXBURG, AS FOLLOWS: The property located at approximately 1600 N 2nd E in the Impact Area of the City of Rexburg. This property is hereby annexed to the City of Rexburg and are hereby declared to be a part of the City of Rexburg, Idaho (#25 01351). The property will be rezoned from Transitional Agriculture (TAG) to Community Business Center (CBC) zone. The property is described as follows on the updated Annexation Map: Legal Description: A parcel of land being in the North half of the southwest quarter of Section 8 of Township 6 North, range 40 East of the Boise Meridian, Madison County, Idaho being further described as follows: Commencing at the West quarter corner of section 8 of Township 6 North, Range 40 East (from which the center quarter corner bears N 89°48'54" E 2632.25 feet) thence N 89°48'54" E 93.21 feet along the latitudinal centerline Of the said section 8 to a point on the East Right-of-way line of North 2nd East point being the point of beginning: Thence N 89°48'54” E 1320.44 feet along the latitudinal centerline of said Section 8; Thence S 00°14'21" E 1315.17 feet to a point on the South l/16th line of the said Section 8: Thence S 89°46'29” W 1363.78 feet along the said South 1/16th line to a point on The East Right-of-way line of North 2nd East; Thence N 00°14'02" W 30.00 feet along the East Right-of-way line of North 2nd East to a point on the South boundary of the lands described in deed Filed as Instrument No. 246171; Thence N 89°46'29" E 203.71 feet along the South boundary of the lands Described in deed filed as Instrument No. 246171; Thence N 00°14'02" W 208. 71 feet along the East boundary of the lands Described in deed filed as Instrument No. 246171; Thence S 89°46'29" W 203. 71 feet along the North boundary of the lands Described in deed filed as Instrument No. 246171 to a point on the East Right-of-way line of North 2nd East; Thence N 00"14'02" W 649.02 feet along the East Right-of-way line of North 2nd East; Thence N 05"31'35" E 430.54 feet along the East Right-of-way line of North 2nd East to the point of beginning. Description contains 40.000 acres more or less. Record of survey# 470291 SECTION I: That the above described property hereby annexed to the City of Rexburg be, and the same is hereby classified under the Zoning Ordinance of the City of Rexburg as above set forth; that the Zoning shall be amended to show this annexation and classification of the above described property so annexed and that said amendment shall be certified to and declared to be the official Zoning Map of the City of Rexburg by a certificate of the Mayor and Council of the City of Rexburg endorsed thereon. SECTION II: This ordinance shall be in full force and effect from and after its passage, approval and due publication.
