To the City Clerk, City of Rexburg,
and the Rexburg City Council:
On behalf of Summerfield PUD Homeowners Association, Inc., a nonprofit homeowners
association, this letter serves as a formal written protest and objection to the creation of Local
Improvement District No. 55 (LID 55) and to the proposed assessment of costs to the Association.
Summerfield PUD Homeowners Association, Inc. is a nonprofit entity that exists solely to maintain
common property for the benefit of its members. The Association does not generate profit, does
not maintain unrestricted reserves for public infrastructure projects, and has no independent
revenue source other than assessments collected from homeowners for routine maintenance and
operations. The Association does not have the financial capacity to absorb or finance City -
mandated public improvements of this nature.
The improvements proposed under LID 55—including sidewalk, curb, gutter, driveway approach,
and ADA upgrades —are being initiated as part of a city street improvement project and are
required to meet current City and federal standards. These improvements were not requested by
the Association, nor are they discretionary improvements intended to benefit the Association
beyond compliance with updated municipal requirements.
Accordingly, the Association objects to the proposed assessment on the grounds that:
1. The improvements constitute City -driven public infrastructure upgrades, not Association -
initiated projects.
2. The Association is a nonprofit organization without the financial ability to fund or finance
the proposed assessment.
3. The proposed assessment places an undue and disproportionate financial burden on a
nonprofit homeowner's association that lacks taxing authority or alternative funding
mechanisms.
4. If the City determines that these improvements are required to meet current standards, the
Association believes the cost of such improvements should be borne by the City, rather
than assessed back to a nonprofit entity.
The Association respectfully requests that the City Council consider this objection and either:
1. Remove Summerfield PUD Homeowners Association, Inc. from the assessment roll for LID
55, or
2. Fund the required improvements without assessing costs to the Association.
This written objection is submitted to be entered into the official record and considered by the
Rexburg City Council at the public hearing regarding LID 55. The Association submits this protest
to preserve all rights and objections available under applicable Idaho law.
