NOTICE OF PUBLIC HEARING
FOR AN ANNEXATION AND REZONE IN THE REXBURG IMPACT AREA IN THE CITY OF REXBURG
Public Hearing: February 18, 2026, at 6:30 pm to be held before the Rexburg City Council, in the
City Council Chambers of the City Building at 35 North 1st East, Rexburg, Idaho, to Annex property
in the Impact Area at approximately 1600 N 2nd E into the City of Rexburg and to rezone the
property from Transitional Agriculture (TAG) to Community Business Center (CBC) zone, file #25
01351.
Legal Description:
A parcel of land being in the North half of the southwest quarter of Section 8 of Township 6 North,
range 40 East of the Boise Meridian, Madison County, Idaho being further described as follows:
Commencing at the West quarter corner of section 8 of Township 6 North, Range 40 East (from
which the center quarter corner bears N 89°48'54" E 2632.25 feet) thence N 89°48'54" E 93.21 feet
along the latitudinal centerline Of the said section 8 to a point on the East Right-of-way line of
North 2nd East point being the point of beginning:
Thence N 89°48'54” E 1320.44 feet along the latitudinal centerline of said Section 8; Thence S
00°14'21" E 1315.17 feet to a point on the South l/16th line of the said Section 8: Thence S
89°46'29” W 1363.78 feet along the said South 1/16th line to a point on The East Right-of-way line
of North 2nd East; Thence N 00°14'02" W 30.00 feet along the East Right-of-way line of North 2nd
East to a point on the South boundary of the lands described in deed Filed as Instrument No.
246171; Thence N 89°46'29" E 203.71 feet along the South boundary of the lands Described in
deed filed as Instrument No. 246171; Thence N 00°14'02" W 208. 71 feet along the East boundary
of the lands Described in deed filed as Instrument No. 246171; Thence S 89°46'29" W 203. 71 feet
along the North boundary of the lands Described in deed filed as Instrument No. 246171 to a point
on the East Right-of-way line of North 2nd East; Thence N 00"14'02" W 649.02 feet along the East
Right-of-way line of North 2nd East; Thence N 05"31'35" E 430.54 feet along the East Right-of-way
line of North 2nd East to the point of beginning. Description contains 40.000 acres more or less.

At such hearing the City Council will hear all persons and all objections and recommendations
relative to such proposed annexation. The City Clerk will also accept written comments at City Hall
prior to 4:00 p.m. on February 17, 2026. This notice is given pursuant to the provisions of Section
67-6508, 67-6509 and 67-6511 Idaho Code, and all amendments thereof.

PUBLIC HEARING INSTRUCTIONS
1. Please sign the list in the lobby to ensure you are permitted to speak.
2. The applicant will come forward, providing his/her name and residential mailing address for
the record and the Council will ask clarifying questions of the applicant.
3. The members of the Council may ask Staff about anything they feel will help clarify the
proposal.
4. The public hearing will be opened by the chairman. At this time, the public may testify to
the Council their views for this proposal.
5. The Council president will officially recognize the speaker.
Please come forward:
• State your name
• Address
• Affiliation to the proposal (neighbor, business associate, interested citizen, or other)
• The Council will not interact with anyone in the audience during Public testimony
(no questions) and we would also ask, out of courtesy to the Council, if you would
please not repeat any like testimony, but rather say you agree with what has been
stated and then give additional testimony.
• Try to focus on the facts and potential impacts.
• Speak to the decision makers – Council members
• The time limit for oral testimony is 5 minutes.
6. The Council members may address questions to the speaker.
7. We will hear testimony in the following order:
• First, from those who are FOR the proposal
• Second, those who are NEUTRAL, neither for nor against
• Third, those who are AGAINST the proposal
• Introduce any written input into the record during appropriate testimony
• If any testimony is given against the proposal, the applicant will then have an
opportunity for REBUTTAL
8. The Public hearing will then be closed. Once the hearing is closed, no public participation
can occur.
9. The Council president will ask Staff to present their report and findings.
10. (Any declarations of Conflict or perceived Conflict of interest by the Council members)
11. The Commission will then discuss the proposal and make a recommendation.
12. The Council will make a motion declaring the reason for their decision.
13. The Council will deliberate on the motion.
14. Lastly, The Council will vote on the motion.
