AUTHORITY: §1.03.010 (A) “The Commission shall have the authority to consider and recommend to the Council
ordinances, amendments thereto, and repeal of ordinances affecting zoning, planning, and building
within the City of Rexburg”
Summary of Information to consider with this request:
• The property is currently a vacant field.
• The annexation and rezone requests apply to approximately 40 acres.
• The property is located between Walmart and the North Rexburg Interchange.
• The Comprehensive Plan designation is Commercial (C). The Comprehensive Plan
designation will not change at this time if the request is approved.
• The current zone is Transitional Agriculture (TAG) and the proposed zone is Community
Business Center (C).
• The adjacent parcels to the east and west are zoned as Transitional Agriculture (TAG),
and the parcels to the south are zoned as Light Industrial (LI) and Regional Business
Center (RBC). The north parcel line borders the Sugar City city boundary.
• A total of 10 hearing notifications were mailed to surrounding property owners.
• Pending public testimony, Staff asks that the Planning & Zoning Commission consider
recommending that City Council approves the application.

Project Description
The applicant is requesting to amend the boundaries of the city limits in order to connect to city
services. The request would bring approximately 40 acres into the city limits. The property is in
the area of impact and adjacent to city boundaries. (See attached vicinity maps)
The applicant is requesting to change the zoning of a 40 acre parcel located at approximately
1600 N 2nd E from Transitional Agriculture (TAG ) to Community Business Center (CBC).
Adjacent parcels to the east, west, and southwest are zoned as Transitional Agriculture (TAG).
Adjacent parcels to the southeast are zoned as Light Industrial (LI). Parcels further to the south
are zoned as Regional Business Center (RBC) and Community Business Center (CBC). (See

The current zoning of Transitional Agriculture (TAG) is a nonconforming zone as it is not allowed
under the Comprehensive Plan Designation of Commercial. The Transitional Agriculture (TAG)
zone allows for maximum density of 1 unit per acre, consisting of detached single-family homes.
Not considering parking, infrastructure, or permissible lot coverage requirements, the maximum
density for 40 acres would be 40 units.
The proposed zoning of Community Business Center (CBC) allows for a general shopping center
complex.
The Comprehensive Plan designation is Commercial and will not change at this time if the
annexation and rezone are approved. The Commercial designation supports the Community
Business Center (CBC) zone request. (See attached current Comprehensive Plan maps)

Considerations for Approval
In evaluating requests for amendments, the Commission shall consider the following:
1. The request’s conformance with the City’s Development Code.
2. The request’s conformance with the City’s Comprehensive Plan.
3. The capacity of existing public streets, water and sewer facilities, storm drainage
facilities, solid waste collection and disposal, and other utilities.
4. The capacity of existing public services, including but not limited to, public safety
services, public emergency services, schools, parks and recreational services.
5. The potential for nuisances or health and safety hazards that may adversely affect
adjoining properties.
6. Recent changes in land use on adjoining properties or in the neighborhood of the map
revision.
Land use impacts that may need to be mitigated by conditions include the following:
1. An increase in daily or peak hour traffic.
2. A change in circulation patterns on or around the property.
3. A significant increase in the demand for parking.
4. A change in the density of people on site.
5. Expansion of the hours of operation.

6. Any increased environmental impact, such as noise or air pollutions; offensive odors;
excessive illumination or glare, etc.
Analysis/Potential Impacts/Recommendation
1. The request’s conformance with the City’s Development Code.
Staff have determined that the request meets the City’s Development Code

2. The request’s conformance with the City’s Comprehensive Plan.

3. The capacity of existing public streets, water and sewer facilities, storm drainage
facilities, solid waste collection and disposal, and other utilities.
Public Works has approved the request. (See Staff Approval Summary)
4. The capacity of existing public services, including but not limited to, public safety
services, public emergency services, schools, parks and recreational services.
The Fire and Public Works departments have approved the request. (See Staff Approval
Summary)
5. The potential for nuisances or health and safety hazards that may adversely affect
adjoining properties.
None identified.
6. Recent changes in land use on adjoining properties or in the neighborhood of the map
revision.
The Teton River Temple subdivision located across 2nd E was recorded February 20, 2024.
The White Owl subdivision, located to the west of the Teton River Temple subdivision
was recorded June 25, 2025.
The Squires subdivisions, located to the south of Moody Road, were recorded December
14, 2023, April 28, 2024, and August 14, 2025.
The TaylorCorp property at 360 Stationery Rd was annexed into the city November 20,
2024.
Staff recommends that pending public testimony, the Planning & Zoning Commission
recommend to City Council to annex the above described properties into the city limits of
Rexburg and change the zoning map from Transitional Agriculture (TAG) to Community Business
Center (CBC).

Decision Options
