HomeMy WebLinkAboutRes. 03.02- Creation of LID 33 for 2003RESOLUTION NO. 2003-02 A RESOLUTION DECLARING THE INTENTION OF THE CITY OF REXBURG, IDAHO, TO CREATE LOCAL IMPROVEMENT DISTRICT NO. 33 FOR THE PURPOSE OF CONSTRUCTING AND INSTALLING CERTAIN PUBLIC IMPROVEMENTS; DESCRIBING THE BOUNDARIES OF THE PROPOSED IMPROVEMENT DISTRICT AND THE PROPERTY PROPOSED TO BE ASSESSED FOR THE COSTS OF THE IMPROVEMENTS; GENERALLY DESCRIBING THE IMPROVEMENTS PROPOSED TO BE CONSTRUCTED AND THE ESTIMATED COSTS AND EXPENSES OF THE IMPROVEMENTS; STATING THE PORTION OF THE TOTAL COST WHICH WILL BE PAID FROM A LEVY OF ASSESSMENTS ON PROPERTY BENEFITTED BY THE IMPROVEMENTS AND THE PORTION PAYABLE FROM OTHER SOURCES; STATING THE METHOD OF DETERMINING ASSESSMENTS; FIXING THE TIME WITHIN WHICH AND THE PLACE AT WHICH A PUBLIC HEARING WILL BE HELD TO CONSIDER SUCH PROTESTS; PROVIDING FOR RELATED MATTERS; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Rexburg, Idaho (the "City"), is a municipal corporation operating and existing under and pursuant to the laws of the State of Idaho, and as such is authorized and empowered to create local improvement districts to construct improvements pursuant to Title 50, Chapter 17, Idaho Code; and WHEREAS, the City Council (the "Council") of the City has authorized initiating the creation of a local improvement district for a particular district; and WHEREAS, the Council is of the opinion that it is in the best interest of the owners of property and of the inhabitants within the proposed Local Improvement District No. 33 ("LID 33"), and within the City, that the proposed LID 33 be formed and the proposed improvements as hereinafter described be constructed. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF REXBURG, IDAHO, as follows: Section 1: The Council hereby determines and states that it is its intention to form a local improvement district, to be designated LID 33 to make the improvements as hereinafter set forth. Section 2: The boundaries of the proposed LID 33 and of the properties to be assessed are generally described in "LID 33 Estimated Assessment Role" which is annexed hereto and by reference incorporated herein. Section 3: A general description of the improvements to be constructed (the "Improvements") is as follows: the installation and/or replacement of streets, curbs, gutters, sidewalks, water lines, sanitary sewer lines, storm sewer lines and other improvements as necessary, together with related improvements and costs of engineering, legal services, publication, interest on borrowed funds during construction, bond issuance costs and reserves, and other related expenses. Section 4: The estimated total cost of the Improvements is approximately $300,000. Approximately $100,000 will be paid by the City, representing the amount of benefit to the general public resulting from the Improvements. The balance of the cost will be paid by a levy of assessments on the property benefitted. Section 5: The assessable portion of the costs and expenses of the Improvements shall be assessed against the tracts, lots, and lands benefitted by the Improvements according to the method of assessment, as provided by Section 50-1707, Idaho Code. Section 6: Wednesday, the 19th day of February, 2003, at the hour of eight o'clock P.M. (8 pm), at the Rexburg City Hall, 12 N Center, Rexburg, Idaho, is hereby fixed as the time and place when and where the owners of the property to be assessed may appear before the Council and be heard as to the propriety and advisability of acquiring the Improvements, and which is the time and place when and where the Council will consider the creating of the proposed LID 33 and constructing the proposed Improvements, and hear all complaints, protests, and objections which may be made in writing and filed with the City Clerk on or before said time, by any owner of any parcel of land to be assessed. Section 7: Written protests and objections to the creation of LID 33 or to the manner of assessment or inclusion of property therein may be filed with the City Clerk at or before four o'clock P.M. (4 pm) on Wednesday, the 19th day of February, 2003, by any owner of any parcel of land to be assessed. Section 8: Notice of Hearing substantially in the form attached hereto and hereby made a part hereof shall be given as follows: (A) By publication of such notice in the official newspaper of the City of Rexburg, Idaho, a newspaper of general circulation within the City, which notice shall be published once a week for two consecutive weeks of the first publication being at least ten (10) days prior to the date of said hearing. (B) By mailing, at least ten (10) days prior to the date of said hearing, a copy of such notice to each owner of property, if known, or his agent, if known, within the limits of the proposed LID 33 addressed to such person at his post office address, if known, or if unknown, to the post office in Rexburg, Idaho. Ownership of property shall be determined as of the date of the adoption of this Resolution. Section 9: This Resolution shall take effect and be in full force from and after its passage and approval. NOTICE OF HEARING ON CREATION OF LOCAL IMPROVEMENT DISTRICT NUMBER 33 CITY OF REXBURG, IDAHO NOTICE IS HEREBY GIVEN that Wednesday, the 19th day of February, 2003, at the hour of eight o'clock p.m. (8:00 pm), at the Rexburg City Hall, 12 N. Center, Rexburg, Idaho, has been fixed, pursuant to Resolution No. 2003-02, as the time and place for public hearing at which the owners of property to be assessed within proposed Local Improvement District No. 33, ("L.I.D. No. 33") may appear before the City Council (the "Council") of the City of Rexburg, (the "City") and be heard as to the propriety and advisability of creating L.I.D. No. 33 and acquiring and constructing the Improvements, as hereinafter described, and as the time and place when and where the Council will consider the creating of the proposed L.I.D. No. 33 and the acquisition and construction of the proposed improvements, and hear all complaints, protests, and objections which may be made in writing and filed with the City Clerk on or before said time by any owner of any parcel of land to be assessed. Your particular property to be assessed for the costs of the improvements benefitting it within the proposed L.I.D. No. 33 is within the city limits and is described below as "Address:". A general description of the improvements to be constructed (the "Improvements") is as follows: the installation and/or replacement of streets, curbs, gutters, sidewalks, driveway approaches, water lines, sanitary sewer lines, storm sewer lines, retaining walls and other improvements as necessary, together with related improvements and costs of engineering, legal services, publication, interest on borrowed funds during construction, bond issuance costs and reserves, and other related expenses. The estimated total cost of the Improvements is approximately $300,000. Approximately $100,000 will be paid by the City, representing the amount of benefit to the general public resulting from the Improvements. The balance of the cost will be paid by a levy of special assessments on the property benefitted, calculated according to a front foot method or a square foot method, whichever is applicable, in proportion to the benefits derived to such property by said improvements. During recent annexation hearings, affected neighborhoods in the annexation proposal were offered to participate in the LID for 2003. Anyone who elects to connect to the City sewer or water systems will be allowed to participate in the current LID. Residents living within the City of Rexburg have the option of financing the costs associated with connecting to City sewer and/or water through this LID. The costs that may be included in the LID are as follows: (1) Construction of lines to connect to the sewer and/or water main line, (2) front footage fees and (3) sewer and/or water connection fees. Please contact Richard Horner at City Hall, if you would like to use City financing to participate in this LID. The loan will be amortized over a 10 year period at a rate of 5%. The billings can be paid monthly on the water bill or at the end of each year. Time is short for this request. The sewer line is expected to be in service by May 31, 2003. The LID will close in June of 2003. To participate in this LID, please provide Richard with a copy of your Warranty Deed that shows the legal address and the name of the owner of the property. No. 33. My property is located at 457 West Main Street and the estimated cost for my portion of this improvement is $2,050.94 (Parcel #RPRRXB10430160A). This property is listed under the name of "BARYON JOHN W ETUX." This property no longer belongs to John W. Barton. Mr. Barton and I were recently divorced and the property is now my responsibility. I recently had to refinance the loan on this property in order to keep it after our divorce. To have my loan go through, I had to be, essentially, out of debt for anything other than my house. I presently work for Madison School District but am looking for other or additional employment in order to "make ends meet." As anyone who has looked for employment in Eastern Idaho knows, finding a job with more pay than what I am presently making is not an easy task. I am objecting to this improvement partly because it is unclear in the notification letter exactly what improvements are to be made for sure, where those improvements are to be made, and how they will directly affect my property. I know that with the growth of Rexburg, many changes are taking place and I am sure that some improvements are going to be necessary. I do not object to residents being responsible for financially assisting in improvements that will benefit their property; however, $2,050.94 seems extremely excessive to me! The bottom line is: I do not and will not have funds of that magnitude to contribute! I also feel that the City of Rexburg sometimes gets high bids on jobs to be done. If you are considering Zollinger Construction, for instance, I feel that they are way over-priced in their bids for sidewalk and gutter improvements. Thank you for considering my objection. It is simply a request for information and, depending upon the nature of that information, perhaps also a request for reconsideration. I do not know exactly how the assessments for the proposed LID were calculated and so when I compare my assessment against my neighbors, what stricks me as inequity might well have a perfectly logical explanation. The observations which I would like you to consider, along with the questions which they generate, are as follows: a) If the assessment is proportional to the linear feet of frontage along main street, then how come Mela- leuca, which has twice my frontage, comes away with a lower assessment? b) if the assessment also takes into account the square footage of sidewalk and curb to be replaced, then is the assessor aware that approximately 73 percent of the my sidewalk and curb along Main Street has been replaced within the last 5 years? Part of that replacement (that at the corner of 1st West and Main) occurred when 1st West north of Main street was improved with the building of Broulim's. The bulk of that 73% was replaced in 1998 by us at a cost of $3964, with no city participation. Does the city intend to replace that which has just recently been laid down? And if not, and the diminished amount of sidewalk and curb to be replaced has been taken into account, then my mathematics leads me to the conclusion (when I compare my assessment to Melaleuca's) that curb and sidewalk replacement is about 4.5 times more expensive than street and utility line improvements. Obviously I am lacking some piece of informa- tion; or an error has been made. I would appreciate having the formula(s) used for making the assessments available at the Wednesday night meeting. Whether either of these observations have any merit, of course you will need to decide. There are companies that are interested in linking into the fiber optics system to provide services in this community. David reviewed the need to have a good communication system in place for the community. The airport's needed improvements were reviewed by David. He indicated that there are times when the airport is too short. Pilots can not have insurance with the Rexburg Airport. David reviewed life flight restrictions for landing at the Rexburg Airport. They can not land at the airport when the weather is too hot. He mentioned extending the runway by diverting the river back to its original location before the flood. David would like the City to plan for necessary airport improvements. Mayor Sutherland mentioned that the City is working towards having fiber optics on the entire length of Maim. Street. Kurt Hibbert has worked on a fiber optics plan that would loop the City. A Department of Commerce and EDA grant did not materialize for this fiber optics loop. David Taylor mentioned that there are companies willing to put fiber optics services into the community. Paul Pugmire -Inquired on relocating the airport to another location. David would prefer to keep the airport where it is currently located. It is close to the City business district. The airport would loose tenants if they were required to relocate. David mentioned the convenience ofhaving the airport close to the business district. `,Vor;iers Compensation and Safety Programs -Richard Horner reviewed the proposed changes in the Safety Program. He indicated that claims have risen in the year 2002. Reportable accidents include a spi der bite and a police officer that was hit by a out of control vehicle. Richard recommended allowing one more year to help the safety program take effect with City employees. The safety program cost about $12,000 with an additional $10,000 in incxeased costs for claims. Discussion on the requirements for safety meetings in the program. Shawn Larsen -Inquired on options available to the City for changing or canceling the program. New Business• Approval of Resolution 2003-02 to create LID 33 for Street Infrastructure Improvements Richard Horner reviewed the LID proposal. Discussion on the location of the LID. Mast locations are on Main Street and 2nd East. The Public Hearing is planned for the 19th of February, 2003. Glen Pond moved to approve the resolution to create LID 33; Nyle Fullmer seconded the motion; Discussion en the locations that are affected by u'1e LID. John mentioned that this project i.s tied into the State's Main Street and 2nd East project scheduled for this summer. The State project will start after the first week in July. Richard Horner recommended that a Public Notice of the project to let the public know when the street will be torn up. Businesses will be affected with some disruption of traffic. Donna asked John to coordinate with the Chamber of Commerce on the timing of the project. Donna requested John to notify the Chamber in the morning to meet the March publication deadline. 2 The Mayor called for a vote on Glen's motion: All voted aye, none opposed. The motion carried Discussion on adding locations to the LID 33 if the Council waives the hearing notice. The project will start at one end of Main Street and go to the other end before turning North on 2nd East. Public Hearin: 7:35 p.m. Rezone a neighborhood from LDRl to LDR which includes properties South of 3rd South to properties facing North on 5th South. The West properties are on the East side of Harvard Avenue, going to the East properties on the West side of 4th East. Properties adjoining 3xd East, Yale Avenue and the West side of 4th East going South to 4th South are affected. See map for details. Mayor Sutherland reviewed the proposal to yap zone the neighborhaod to a more restrictive zone. Shawn Larsen -Commented on the Planning and Zoning Public Hearing for this request. He mentioned that the neighborhood was well represented in support of this request. The Public Hearing was opened on the rezone request. David Peck - 323 South 3rd East -The Planning and Zoning Commission unanimously voted to approve this request to rezone the neighborhood. They organized into the 3rd East Neigh boyhood Association iu May of 2002. They are consistent with the City's neighborhood organizations. Many homeowners have come into compliance with the zoning laws before this proposal was concluded. David reviewed the petition and meetings that led up to the neighborhood making this request to rezone their neighborhood to an LDR zone. This will send a message to comply with the Comprehensive Flan. He recommended passage of the proposal. Public Hearing was closed Donna Benfield -Reviewed the number of participants in the 3rd East Neighborhood Association. David Peck mentioned that 19 homes are part of the actual 3rd East Neighborhood Association. They have all voiced agreement for this request. Property owners living outside of the area ~,~Tere not contacted by the Association. Marsha Bjornn -Inquired of David why some of the lots were not on the list to be changed to LDR. David indicated that existing apartments on 4th South were not part of the rezone request.
