Project No. sTP-7866(L) IDANO .y z` ~' c' EQ~ ~nON D WHEREAS, THE ITY OF RE%BiTRG intends to construct unAnwAY AND DRAINAGE Il~ROVIIrtENTS , under Federal-aid Highway Project No. STP-7866(100) and WHEREAS, federal funds for the improvement depend upon com- pliance with federal and state laws governing procurement of right of way; and WHEREAS, TRF CITY OF RE%BDRG has complied with the aforesaid laws and regulations in procuring right of way for Federal-aid Highway Project No. sTp-~~~~(ioo~ NOW, THEREFORE, BE IT RESOLVED: 1. That the MAYOR is authorized to execute a RIGHT OF WAY CERTIFICATE certifying that the afore- said laws have been complied with. 2. That copies of the executed certificate shall be furnished to the Idaho Transportation Department, Division of Highways. STP-7866(100) Location RE%BIIRG 7TH SOIITH County MADISON I hereby certify that all rights of way, material sources, permits, easements, and/or agreements necessary for the construction of the above named project have been acquired. I also certify to the Idaho Transportation Depart- ment, Division of Highways, that THE CITY OF RE%BIIRG the real property for this project has: in the acquisition of 1. Made every reasonable effort to acquire the real property by negotiation; 2. To the greatest extent practicable, scheduled the construction of this project so that no person lawfully occupying the real property has been re- quired to move from his home, farm, or business location without at least 90 days' written not ice; 3. Before initiating negotiations for the real property, established an amount considered to be just compensa- tion, under the law of the State, and made a prompt offer to acquire the property for the full amount so established; and 4. Has provided or will provide all required relocation payments and services and has relocated or has offered to .relocate all persons and occupants of the right of -way within this project to decent, safe and sanitary housing. It is further certified that in all cases where the property owner donated a portion of his, real property for highway right of way, he was fully informed of all the facts, including his right to full compensation in money for land and damages, if any, in accordance with the laws of the State of Idaho. INCIDENTAL PAYMENTS 1. Will expenses of transferring properties, such as recording fees, title insurance premiums, etc., be paid by the acquiring agency? yES If not, grantors will be reimbursed.. 2. Will grantors be required to pay any real property taxes on property acquired for any period after title passes to the acquiring agency? No If so, they will be reimbursed. 3. Grantors will be reimbursed for any penalty costs for pre- payment of a mortgage.
