HomeMy WebLinkAboutRes 97.01- Urban Renewal AgencyRESOLUTION 97.1 COUNCIL RESOLUTION IMPLEMENTING THE STATUTORY CRITERIA OF AND )WERING THE REXBURG URBAN RENEWAL AGENCY, MAKING CERTAIN INGS OF FACT, AND DETERMINING WASHINGTON SCHOOL PROPERTY AND ;R MAIN STREET AREAS TO BE A DETERIORATED AREA RESOLUTION A OLUTION IMPLEMENTING THE STATUTORY CREATION OF AND EMP WERING THE REXBURG URBAN RENEWAL AGENCY MAKING CERTAIN FIN GS OF FACT, AND DETERMINING THE WASHINGTON SCHOOL PROPERTY ANDi OTHER MAIN STREET AREAS TO BE A DETERIORATING AND DETERIORATED ARE AS DEFINED BY IDAHO CODE, SECTIONS 50-2018 (I) AND 50-2903 (6) (b ). WH AS, the City of Rexburg desires to implement and empower an Urban Renewal Agency by th Idaho Urban Renewal Law of 1965 (codified at Chapter 20, Title 50, Idaho Code); ~S, it is anticipated that the Urban Renewal Agency intends to prepare an Urban Plan containing a revenue allocation financing provision, pursuant to the local Development Act (codified at Chapter 29, Title 50, Idaho Code); WH AS, the City recognizes that there are certain factual prerequisites to the empowerment of th Agency and the ultimate adoption of an Urban Renewal Plan containing revenue allocation finan ing provisions; WH REAS, the City has obtained an eligibility report, which examines the Washington School Prop ~ty and Main Street Area for the purpose of determining whether such area is a dete rating area and deteriorated area as defined by Idaho Code, Sections 50-2018 (I) and 50- 2903 6) (b); WHFAS, the eligibility report dated March 10, 1997, has been submitted to the Mayor and City ouncil, a copy of which is attached hereto as Exhibit 1. OF 'THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY I~XBURG AS FOLLOWS: That there are one or more areas within the City of Rexburg which are deteriorating or deteriorated areas as defined by Idaho Code, Sections 50-2018 (I), and 50-2903 (6) (b). 2 ~~ That one such area is the Washington School Property and Main Street Area. That the rehabilitation, conservation, and redevelopment, or a combination thereof, of such area is necessary in the interest of the public health, safety, and welfare of the residents of the City. 4. ~ I That there is a need for an Urban Renewal Agency to function in the City. 5. I Based on the March 10, 1997 report of the Area, the City Council make the findings that: a. The area is determined to be a deteriorating area as defined by Idaho Code, Section 50-2018 (I) and a deteriorated area as defined by Idaho Code, Section 50- 2903 (6) (b); b. The area is determined to appropriate for an urban renewal project. 6. I That this Resolution shall be in full force and effect immediately upon its adoption and approval.
