HomeMy WebLinkAboutRes 94.14- Funds, Idaho Community Block GrantsRESOLUTION NO. 94-14 CITIZEN PARTICIPATION PLAN IDAHO COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM CITY OF REXBURG Pursuant to the citizen participation requirements of Section 508 of the Housing and Community Development Act of 1987, as amended, the City of Rexburg will undertake the following actions to ensure compliance with said requirements as an applicant for or recipient of Idaho Community Development Block Grant Funds. The City of Rexburg shall provide for and encourage participation, particularly by low- and moderate- income persons who reside in slum or blighted areas, and areas in which CDBG funds are proposed to be used. 1. Conduct at least one public hearing on the ICDBG activities proposed in the ICDBG application submitted to Idaho Department of Commerce (IDC) and at least one public hearing on the status of funded activities. The application hearing, at minimum, must include a review of: (a) how proposed activities will address community development need(s) in the community, particularly for low- and moderate-income persons, (b) how the proposed activities will be funded and sources of funds, (c) date application will be submitted, (d) amount of ICDBG funds requested, (e) estimated portion of the ICDBG funds requested that will benefit persons of low and moderate income, (f) where the proposed activities will be conducted, (g) plans to minimize displacement of persons and businesses as a result of funded activities, if applicable, (h) plans to assist persons actually displaced, if applicable. The application and related documents must be available for review and reflected in hearing minutes. The public hearing on the status of funded activities, at minimum, must include a review of (a) a general description of accomplishments to date, (b) a summary of all expenditures to date, (c) a general description ofthe remaining work, and (d) a general description of changes made to the ICDBG project budget, performance targets, activity schedules, project scope, location, objectives, or beneficiaries. 2. Publish notices of hearing(s) consistent with the requirements of the Idaho Code, Section 60-109. Public hearings shall be conducted in a manner to meet the needs ofnon-English speaking residents where a significant number of non-English speaking residents can reasonably be expected to participate. 3. Ensure the public reasonable and timely access to all local meetings, project records, and information relating to the proposed and actual use of ICDBG funds. Hearings must be held at times when most citizens can attend, i.e. after regular work hours. All information presented in the hearings shall also be available, upon advance request, and in a form usable by persons with hearing or visual impairments. This shall be stated in the public notice. 4. Conduct all ICDBG-related public meetings or hearings in public buildings or facilities that are accessible to the handicapped. The public notice shall state the hearing will be held in a handicapped accessible facility. 5. Provide citizens the name and address of: (a) the person(s) authorized to receive and respond to citizen proposals, questions, and complaints concerning proposed or funded activities; (b) the person(s) that will be available and able to provide technical assistance to groups representative of persons of low and moderate income in preparing and presenting their proposals for the request and use of ICDBG funds. This plan shall become effective Nov. 16, 1994 A copy of the public notice and/or affidavit of publication must also be submitted by applicants. CERTIFICATION REGARDING LOBBYING The undersigned certifies, to the best of his or her knowledge and belief, that: (1) No federal appropriated funds have been paid or will be paid, by or on behalf of the undersigned, to any person for influencing or attempting to influence an officer or employee of any agency, a member of Congress, an officer or employee of Congress, or an employee of a member of Congress in connection with the awarding of any federal contract, the making of any federal grant, the making of any federal loan, the entering into of any cooperative agreement, and the extension, continuation, renewal, amendment, or modification of any federal contract, grant, loan, or cooperative agreement. (2) If any funds other than federal appropriated funds have been paid or will be paid to any person for influencing or attempting to influence an officer or employee of any agency, a member of Congress, an officer or employee of Congress, or an employee of a member of Congress in connection with this federal contract, grant, loan, or cooperative agreement, the undersigned shall complete and submit Standard Form-LLL, "Disclosure Form to Report Lobbying," in accordance with its instructions. (3) The undersigned shall require that the language of this certification be included in the award documents for all sub-awards at all tiers (including subcontracts, sub-grants and contracts under grants, loans, and cooperative agreements) and that all sub-recipients shall certify and disclose accordingly. This certification is a material representation of fact upon which reliance was placed when this transaction was made or entered into. Submission of this certification is a prerequisite for making or entering into this transaction imposed by section 1352, title 31, U.S. Code. Any person who fails to file the required certification shall be subject to a civil penalty of not less than $10,000 and not more than $100,000 for each such failure. ignature Nile L. L,r~~~ ICDBG PUBLIC HEARING MINUTES City of Rexburg November 16, 1994 City Hall Rexburg, Idaho THE PUBLIC HEARING was called to order at 7:10 P.M. by Mayor Boyle. Ted Hendricks, of East-Central Idaho Planning & Development Association, gave some background information on the Business Park project, an Economic Development project estimated to cost $2.5 million, and listed the activities to be undertaken and the necessity for these activities. In addition, the guidelines and regulations regarding the Idaho Community Development Block Grant and the process of submitting the application to the State were discussed. Ted indicated that the Application and Application Handbook were available for all to review and then answered questions and addressed possible changes that could be made to the Application. Ted indicated the community qualified with 64% of the City residents being LMI per the 1990 Census. The amount of funds available for local community development and public facilities was discussed, as well as how the funding will take place and the source of the funds provided. Ted commented on the impact which the project will have on the community, and the benefits to low- and moderate-income persons. Views on the project were discussed at this time, as well as citizen participation over the past year. The meeting was held in ahandicapped-accessible facility.
