HomeMy WebLinkAboutRes 94.01- Boards, ADA Transiton PlanRESOLUTION: 94-1 Resolution Adopting 509,/ADA Transition Plan "A Resolution by the City of Rezburg, formally adopting a 504/ADA Transition Plan" WHEREAS, on the 6th day of April, 1994, the Council of the City of Rexburg was duly convened upon notice properly given and a quorum was duly noted: WHEREAS, ADA requirements for local governments have been in effect since January 26, 1992 and the Congress of the United States has passed Section 504 of the Rehabilitation Act of 1973 which requires that "No otherwise qualified individual with handicaps in the United States...shall, solely on the basis of his or her handicap, be excluded from participation in, be denied the benefits of, or be subject to discrimination under any program or activity receiving federal financial assistance"; and, WHEREAS, the City of Rexburg has received an Idaho Community Development Block Grant and is required to comply with Section 504 of the Rehabilitation Act of 1973; and, WHEREAS, the city has designated a 504/ADA Responsible Employee, Adopted and Published a Policy on Nondiscrimination and a 504/ADA Grievance Procedure and established a Section 504/ADA Citizen Review Committee; and, WHEREAS, it is the policy of the City to make all of it's programs and activities accessible to, and usable by, qualified persons with disabilities; and, WHEREAS, the City 504 Review Committee has completed a Local Self Evaluation of programs, policies, procedures and facilities to determine those areas where discrimination may occur and have developed a Transition Plan to bring the City into Compliance; and, WHEREAS, the failure to comply with the terms and conditions of Section 504 of the Rehabilitation Act may cause the City to lose its present grant or eligibility for future grants; NOW THEREFORE, by resolution duly adopted on the date first written above, be it resolved by the Mayor and the Council of the City of Rexburg, Idaho, the following: -The City of Rexburg does Accept and does hereby Adopt the recommendations of the 504/ADA Committee as outlined in the Prepared Transition Plan. -That the City of Rexburg shall make recommended revisions, modifications, or other changes to their physical facilities so as to fully comply with the letter and intent of Section 504. Further, the City of Rexburg shall, in a timely manner eliminate structural barriers to citizens with disabilities. -The City of Rexburg will publish the City Non-Discrimination policy (or a summary) in the local newspaper, at least annually.
