EXTRACT FROM THE MINUTES OF A REGULAR MEETING
OF THE CITY COUNCIL OF THE CITY OF REXBURG, IDAHO
HELD ON April 7 , 1993.
The following Resolution was introduced by Councilman Nyle Fullmer ,
read in full, considered and adopted:
RESOLUTION NO. 93-6 OF THE CITY OF REXBURG, IDAHO ACCEPTING THE
AIRPORT TIEDOWN AGREEMENT OF THE STATE OF IDAHO THROUGH THE IDAHO
TRANSPORTATION DEPARTMENT (DIVISION OF AERONAUTICS) FOR TEN (10)
SETS OF TIEDOWN CHAINS TO BE USED IN THE DEVELOPMENT OF THE
REXBURG-MADISON COUNTY AIRPORT; and
Be it resolved by the Mayor and Council of the City of Rexburg,
Idaho as follows:
Sec. 1. That the City of Rexburg shall accept the Airport
Tiedown Agreement of the State of Idaho for ten (10) sets of
tiedowns.
Sec. 2. That the Mayor of the City of Rexburg is hereby
authorized and directed to sign the statement of acceptance of said
Airport Tiedown Agreement on behalf of the City of Rexburg and the
City Clerk is hereby authorized and directed to attest the
signature of the. Mayor to impress the official seal of the City of
Rexburg on the aforesaid statement of acceptance; and
Sec. 3. A true copy of the Airport Tiedown Agreement is
attached hereto and made a part thereof.

do hereby certify that the foregoing (and attached copy) is a full,
true, and correct copy of Resolution No. 93-6 adopted at a regular
meeting of the Council of the City of Rexburg held on the 7th day
of April 7 1993, and that the same is now in full force and
effect.

AIRPORT TIEDOWN AGREEMENT
WHEREAS, the State of Idaho, represented by the Idaho
Transportation Department, Division of Aeronautics, hereinafter referred
to as the "State", and the City of Rexburg, hereinafter referred to as
the "Sponsor"; and,
WHEREAS, the State has received a request from the Sponsor for
assistance in providing for ten (10) prefabricated aircraft tiedowns for
installation at the Rexburg-Madison County in Madison County at fifty
percent (50$) of the State's cost; and,
WHEREAS, the Sponsor agrees to install such kits within forty five
(45) days from the effective date of this Agreement; and,
WHEREAS, the Sponsor has selected the tiedown location and agrees
to locate such tiedowns in accordance with an approved airport layout
plan or to meet current geometric standards acceptable to the State;
THEREFORE, the State and the Sponsor do mutually agree as follows:
For and in consideration of the State, having furnished to the
Sponsor ten (10) tiedown kits, the Sponsor agrees to keep at least two
(2) of these tiedowns available for use by transient aircraft. The
Sponsor also agrees to inspect and maintain all tiedowns furnished under
this Agreement in good condition at all times.
The Sponsor further agrees to save harmless and hold free from
liability the State from and for any and all losses, claims, actions,
judgements for damages, or injury to persons or property, and losses and
expenses caused or incurred by the Sponsor, its servants, agents or
employees in connection with or arising out of the performance of this
Agreement, and during the term and life of this Agreement and any
extension thereof.
The Sponsor agrees that it has been authorized by Resolution duly
adopted by its City Council to enter into this Agreement with a copy for
said Resolution attached hereto and made a part hereof.
