CITY OF REXBURG ORDINANCE NO. 1340
DEVELOPMENT CODE ORDINANCE 1200 AMENDMENTS
AN ORDINANCE AMENDING THE CURRENT DEVELOPMENT CODE (PLANNING AND ZONING ORDINANCE NO. 1200) CONCERNING SUBSTANTIVE AND NON-SUBSTANTIVE ITEMS; THE FOLLOWING CHANGES HAVE BEEN MADE: ADOPTION
OF CHAPTER 3.9 SKYBRIDGES PERTAINING OF SUBSECTIONS; 3.09.010 PROVIDING FOR PURPOSE; 3.09.020 STANDARDS FOR ALL ZONES; 3.09.030 LOCATION AND CONSTRUCTION STANDARDS; 3.09.040 PERMITTED
USES; 3.09.050 SIGNS; AND 3.09.060 PUBLIC SKYBRIDGES; PROVIDING FOR VIOLATION OF THE PROVISIONS OF THE ORDINANCE; PROVIDING FOR ENFORCEMENT OF THE ORDINANCE; AND PROVIDING FOR THE EFFECTIVE
DATE OF THE ORDINANCE.
WHEREAS, The City of Rexburg is incorporated as an entity of the State of Idaho; and
WHEREAS, the State of Idaho Statutes are used by the City of Rexburg as the primary source of code compliance; and
WHEREAS, Rexburg City Codes are subordinate to Idaho State Code.
NOW THEREFORE, be it ordained by the Council of the City of Rexburg, in the State of Idaho, be established to read as follows:
SECTION 1: AMENDMENT “SIGN-T Definitions” of the Rexburg Development Code is hereby amended as follows:
Skybridge: An enclosed, elevated bridge extending from building face to building face that spans a public street, public alley, or is located within private property and provides an
uninhibited pedestrian walkway.
SECTION 2: ADOPTION “Chapter 3.9 SKYBRIDGES” of the Rexburg Development Code is hereby added.
SECTION 3: ADOPTION “Chapter 3.09.010 Purpose” of the Rexburg Development Code is hereby added as follows:
To establish appropriate locations for skybridges, maintain pedestrian safety, and ensure the design of skybridges contributes to the built and natural environment.
SECTION 4: ADOPTION “Chapter 3.09.020 Skybridge Standards For All Zones” of the Rexburg Development Code is hereby added as follows:
Skybridges are subject to administrative review and require an approved Conditional Use Permit (CUP) and Air Easement Agreement.
All skybridges shall:
A. Comply with the following standards and all other applicable regulations for the zone.
B. Comply with all Building Codes and Engineering Standards adopted by the City of Rexburg.
C. Be maintained and kept in good condition. The maintenance of heating, cooling, lighting, cleaning, repair, replacement, etc. are the responsibility of the building owner(s).
D. Be kept free of obstructions.
SECTION 5: ADOPTION “3.09.030 Skybridge Location And Construction Standards” of the Rexburg Development Code is hereby added as follows:
A. The location for any skybridge must be reviewed and approved by the Public Works Director or designee prior to its construction.
B. All skybridges shall:
1. Be fully enclosed.
2. Be constructed with approved systems for the discharge of all roof drainage.
3. Maintain a minimum clearance of sixteen (16’) feet six (6”) inches between the bottom of the skybridge and the public street or alley.
4. Have a minimum interior width of eight (8’) feet but not exceeding fourteen (14’) feet.
5. Meet a minimum required fenestration of twenty (20%) percent.
6. Be constructed with exterior glass that is anti-glare and impact resistant. All exterior glass in the skywalk structure shall be not less than one-quarter inch thickness tempered
glass set in metal frames. The use of double-paned insulated glazing and of metal frames with thermal breaks is encouraged.
7. Not contain a glass floor.
SECTION 6: ADOPTION “3.09.040 Skybridge Permitted Uses” of the Rexburg Development Code is hereby added as follows:
A. Skybridges are to be used as an unobstructed pedestrian way only.
1. Prohibited Uses. Commercial, Vending, Retail, or Residential uses within skybridges are prohibited.
SECTION 7: ADOPTION “3.09.050 Skybridge Signs” of the Rexburg Development Code is hereby added as follows:
Only directional signs relevant to pedestrian ways are allowed on or within skybridges.
SECTION 8: ADOPTION “3.09.060 Public Skybridges” of the Rexburg Development Code is hereby added as follows:
Public skybridges shall provide at a minimum one (1) access point to the street and include a vertical access facility.
SECTION 9: REPEALER CLAUSE Providing for other substantive and non-substantive changes in the Development Code as recommended and approved by the Planning and Zoning Commission
of the City of Rexburg, Idaho. Furthermore, any portion of the existing Development Code in conflict with this proposed amendment is hereby repealed.
SECTION 10: SEVERABILITY CLAUSE The provisions of this Ordinance shall be deemed severable and a finding by a court of law
that a provision of the Ordinance is unlawful shall have no effect on the remaining provisions.
SECTION 11: EFFECTIVE DATE The City of Rexburg, Idaho City Council shall enact this Ordinance (#25-00978) amending Ordinance 1200 otherwise known as the Development Code of the City
of Rexburg, Idaho upon its passage, approval and publication; and shall be in full force and effect from November 18, 2025, and after the required approval and publication according
to law.
