HomeMy WebLinkAboutOrd 1338 ROW Vacation Approx 1233 & 1215 Stocks Ave/ ORDINANCE NO. 1338 Right of Way Vacation at Approximately 1233 and 1215 Stocks Ave in the City of Rexburg, Idaho AN ORDINANCE VACATING THE RIGHT OF WAY AT APPROXIMATELY 1233 STOCKS AVE AND 1215 STOCKS AVE IN THE CITY OF REXBURG, MADISON COUNTY, IDAHO; AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE. BE IT ORDAINED BY the City of Rexburg, Idaho: SECTION I: That the Right-of-Way for approximately 1233 and 1215 Stocks Avenue in the City of Rexburg, Idaho is hereby vacated and discontinued for the exclusive use of the owners of the adjacent real estate as provided by the statutes of the State of Idaho and allowing the City to maintain current and future utility easements in the abandoned right-of-way. Title to said portion of the rightofway so vacated adjacent to the described North Parcel, shall be conveyed the adjoining property owner except for the utility easements, and the Mayor and City Clerk are directed to execute to said owners in the name of the City of Rexburg, a Quitclaim Deed to the portion of said rightofway so vacated and closed as provided by law upon the following conditions being met. Any and all existing and future easements for public utilities located in the portion of the vacated right-of-way shall remain as public easements and are not vacated. Property owner for the North Parcel described in the Legal Description, Lot 7 of Block 1, shall be responsible for all adjustments needed to restore Stocks Avenue to Artco Business Park street standard, to be completed prior to completion of the development of property. The legal descriptions of the said properties in Rexburg, Madison County, Idaho, is as follows: Legal Description: South Parcel Part of the Artco Business Park Subdivision, located in SECTION 17, Township 6 North, Range, 40 East, В.М. MADISON COUNTY, IDAHO, Commencing at the Southeast Corner of Lot 7 of Block 1; Thence N00°11’11”E, 77.31 ft to the POINT OF BEGINNING; Thence along a curve to the left, with chord bearing N13°40’37”W, chord length 44.33 ft, and radius 92.50 feet to a point; Thence N27°32’24”W, 8.12 ft to a point; Thence along a curve to the right with chord bearing N21°43’55”W, chord length 11.62 ft, and radius 57.45 ft to a point; Thence S89°47’14”E, 18.73 ft to a point; Thence S00°11’11”W, 60.99 ft to the POINT OF BEGINNING. MADISON COUNTY, IDAHO, Commencing at the Southeast Corner of Lot 7 of Block 1; Thence N00°11’11”E, 77.31 ft to the point of beginning; Thence along a curve to the left, with chord bearing N13°40’37”W, chord length 44.33 ft, and radius 92.50 feet to a point; Thence N27°32’24”W, 8.12 ft to a point; Thence along a curve to the right with chord bearing N21°43’55”W, chord length 11.62 ft, and radius 57.45 ft to THE POINT OF BEGINNING, Thence along a curve to the right with chord bearing N07°53’20”W, chord length 16.13 ft, and radius 57.5 ft to a point; Thence N00°11’11”E, 98.29 ft to a point; Thence along a curve to the left with chord bearing N44°50’45”W, chord length 42.45 ft, and radius 30.00 ft to a point; Thence S89°49’54”E, 21.00 ft to a point; Thence along a curve to the right with chord bearing S44°50’45”E, chord bearing of 42.45 ft, and radius of 30.00 ft; Thence S00°11’11”W, 114.29 ft to a point, Thence N89°47’14”W, 18.73 ft to the POINT OF BEGINNING. The utility easement remains in effect as shown on the plat. SECTION II: The vacation of such portion of the Right-of-Way on Stocks Ave is deemed expedient for the public good as it will promote the orderly development of said area. SECTION III: This ordinance shall take effect and be in full force and effect upon its passage, approval and publication as provided by law.
