June 12, 2025, An application was received for an ordinance amendment to the Daycare, Landscaping, Parking, Plat Names, and Family sections of Ordinance No. 1200 - Development Code. 2. May 23, 2024, Landscaping section of the application was discussed at Strategic Team Meeting. 3. July 25, 2024, Landscaping section of the application was discussed at Strategic Team Meeting. 4. August 27, 2024, Daycare section of the application was discussed at Strategic Team Meeting. 5. February 20, 2025, Landscaping section of the application was discussed at Strategic Team Meeting. 6. March 10, 2025, Family and Parking sections of the application were discussed at Strategic Team Meeting. 7. March 21, 2025, Family and Parking sections of the application were discussed at Strategic Team Meeting. 8. May 21, 2025, A joint work meeting with Planning & Zoning and City Council was held to discuss proposed changes. 9. August 13, 2025, Notice was sent to the newspaper to be published August 5, 2025, and August 12, 2025. 14. August 21, 2025, the application was presented to the Planning & Zoning Commission. Public Hearing – (25-00575) – Development Code Amendments – Proposed updates to the Development Code. – Alan Parkinson (Action) (208) 359-3020 35 North 1st East Rexburg, ID 83440 Rexburg.org | Engage.Rexburg.org Conflict of Interest/Ex parte Conversation: Vice Chairperson Kempton asked the Commissioners to disclose any conflicts of interest or conversations held outside of this meeting relative to this particular subject. Presentation: Administrator Parkinson shared that these are the same changes to the Development Code that have been reviewed at the last two City Council and Planning and Zoning Work Meetings. Only the changes requested during those work meetings have been made. The group discussed the process for the changes, including the official public hearing and the Commission’s ability to choose to vote on each section individually. Commissioner Kempton questioned why mid-sized daycares were not permitted in high density zones. Administrator Parkinson responded that it is hard to have a daycare in a small apartment, unless the complex sets aside a facility for the daycare. He explained that this does not prevent someone from babysitting the neighbors kids. Vice Chairperson Kempton opened the public input portion of the hearing at 6:50 pm. Commissioner Discussion: Commissioner Casper confirmed that the Commission was approving the final drafts of changes. Administrator Parkinson and Attorney Rammell corrected him, stating that the Commission is recommending the changes be approved by City Council. Commissioner Lawrence noted that while the materials were extensive, his review indicated everything appeared consistent with prior discussions from the work meetings and he had no concerns. Commissioner Thackeray expressed his confidence that any objections raised in the work meetings had been addressed and felt the changes were ready to go into effect. Commissioner Kempton and Commissioner Smith echoed the previous comments. The Commission discussed the process to update the code and confirmed that there would be additional code changes in the future. MOTION: Motion to recommend City Council approve the changes to the Development Code based on the fact that through the work meetings and (208) 359-3020 35 North 1st East Rexburg, ID 83440 Rexburg.org | Engage.Rexburg.org discussions that concerns have been addressed and it makes the language more clear and concise and addresses past issues. September 3, 2025, the application was presented to the City Council and considered first read. Planning & Zoning recommendation to approve an amendment to the current Development Code, Ordinance No 1200 for the City of Rexburg #25-00575. Designated as Ordinance No 1337 and considered first read if motion passes – Alan Parkinson Action Item P&Z Administrator Parkinson explained there were changes made in the following categories: Accessory Side Setbacks, Daycares, Landscaping, Family & Congregate Living, Parking, and Subdivision Names to the current Development Code, Ordinance No 1200 for the City of Rexburg. These items were previously reviewed in two separate City Council Work Meetings. The information was first presented, followed by discussion. Changes were then made based on the feedback from the first meeting and brought back to the City Council for further review. Additional suggestions were provided at the second meeting, and those changes were also made. No other revisions have been made since the second meeting. Council Member C. October 1, 2025, the application was presented to the City Council and considered third read. Ordinance No 1337 Amendment to the Rexburg Development Code, Ordinance No. 1200 #25-00575 – Katie Saurey CITY OF REXBURG ORDINANCE NO. 1337 DEVELOPMENT CODE ORDINANCE 1200 AMENDMENTS AN ORDINANCE AMENDING THE CURRENT DEVELOPMENT CODE (PLANNING AND ZONING ORDINANCE NO. 1200) CONCERNING SUBSTANTIVE AND NON-SUBSTANTIVE ITEMS; THE FOLLOWING CHANGES HAVE BEEN MADE: AMENDMENTS TO ACCESSORY SIDE SETBBACKS, DAYCARES, LANDSCAPING, FAMILY & CONGREGATE LIVING, PARKING, AND SUBDIVISION NAMES; PROVIDING FOR VIOLATION OF THE PROVISIONS OF THE ORDINANCE; PROVIDING FOR ENFORCEMENT OF THE ORDINANCE; AND PROVIDING FOR THE EFFECTIVE DATE OF THE ORDINANCE.
