HomeMy WebLinkAboutSTAFF REPORT SUMMARY - 25-00575 - Setbacks Daycares Landscaping Family Parking Subdivision Names - Development Code Amendments(208) 359-3020 35 North 1st East Rexburg, ID 83440 Rexburg.org | Engage.Rexburg.org Planning and Zoning Staff Report CASE NUMBER: 25-00575 SUBJECT: Accessory Setbacks, Daycares, Landscaping, Family & Congregate Living, Parking & Subdivision Names – Development Code Amendment APPLICANT: City of Rexburg PURPOSE: Amendment to Ordinance 1200: Development Code AUTHORITY: §1.03.010 (A) “The Commission shall have the authority to consider and recommend to the Council ordinances, amendments thereto, and repeal of ordinances affecting zoning, planning, and building within the City of Rexburg” Information to consider with this request: 1. Accessory Side Setbacks:  Added setback requirements for midsize sheds. 2. Daycares:  Added definitions for Commercial Daycare Centers, Daycare Facilities, and Family Home Daycares to better align with state definitions.  Updated Permitted Use table with new Daycare terminology.  Clarified Home Occupation and Home Business requirements and provided additional examples. 3. Landscaping:  Modified or added definitions for Landscaping, Pervious Surface and Screening.  Reorganized Screening and Landscaping, simplified landscaping requirements.  Added flexibility in landscaping when overhead powerlines exist and along the Highway 20 Corridor for commercial uses with a front yard display.  Standardized buffer width and landscaping requirements. 4. Family & Congregate Living:  Updated the definition of family and added a definition for Congregate Living.  Added Congregate Living to the Permitted Uses Table 5. Parking:  Reorganized, simplified and solved conflicting sections.  Added Visitor and/or Employee Parking requirements to certain uses.  Clarified parking space and drive aisle dimensions.  Increased the proximity of parking lots to buildings. 6. Subdivision Names:  Refined unique name requirements for streets and subdivisions. Applicable Laws and Codes State Statutes: §67-6512, §67-8003 City of Rexburg Ordinance 1200 Development Code Decision Options The Planning & Zoning Commission may recommend Approval of the application, recommend Approval with Conditions or Modifications, or recommend Denial of the application.
