April 15, 2025, An application was received to annex the property located at 1036 McJon Ln. 2. April 15, 2025, Payment was received for the application. 3. April 15, 2025, Application paperwork was completed. 4. April 15, 2025, Staff reviews were assigned. 5. April 28, 2025, Staff reviews were approved. 6. May 19, 2025, Staff Report was completed. 7. May 2, 2025, Notice was sent to the newspaper to be published May 2, 2025, May 16, 2025, and May 23, 2025, and June 13, 2025. 8. May 19, 2025, Notice was mailed to surrounding property owners within 350’ for the Planning & Zoning hearing. 9. May 19, 2025, Notice was mailed to surrounding property owners within 350’ for the City Council hearing. 10. May 22, 2025, Notice was posted on the property for both hearings. 11. June 5, 2025, the application was presented to the Planning & Zoning Commission. Public Hearing – (25-00318) McFarland – 1036 McJon Ln – Annexation – Located at 1036 McJon Ln, the application is to annex the property into the City of Rexburg. – James McFarland (Action) Conflict of Interest/Ex parte Conversation: Chairperson Smith asked the Commissioners to disclose any conflicts of interest or conversations held outside of this meeting relative to this particular subject. Presentation: Planning and Zoning Administrator Parkinson explained that the location of the parcel is north of Pine Brook Subdivision. A new house is being built, and the Health Department is not allowing the owner to connect to the existing septic system and is requiring connection to city services since it is within 300’ of the line. The City requires a property be annexed if services are being provided. Chairperson Smith opened the public input portion of the hearing at 6:34 pm. Commissioner Discussion: The Commission further discussed the reason for the annexation, and Commissioner Richards asked if the main line was located on McJon Ln. Administrator Parkinson confirmed the location. Commissioner Muir inquired about the zoning. Administrator Parkinson answered the zone would stay the same as there was no request to change it. MOTION: Motion to recommend City Council approve the annexation request of 1036 McJon Ln due to county sewer requirements and its adjacency to existing city sewer infrastructure. Action: Approve, Moved by Aaron Richards, Seconded by Sally Smith. Commissioner Discussion on the Motion: none VOTE: Motion carried. (Summary: Yes= 8, No = 0, Abstain = 0). June 25, 2025, the application was presented to the City Council for a public hearing and to be considered first read. Public Hearing 6:30 P.M. Planning & Zoning recommendation to approve the annexation of 1036 McJon Ln into the City of Rexburg #25-00318. Designated as Ordinance No 1332 if motion passes and considered 1st read– Alan Parkinson Action Item Planning and Zoning Administrator Parkinson explained that the property in question is located north of the Pine Brook Subdivision. The homeowner is building a new home on the back portion of the lot and planning to remove the existing home from the front of the property. In the process, he needed to replace the sewer system. The homeowner consulted with District 7 Health Department to determine what steps were necessary. District 7 Health Department informed him that, due to the property's proximity to city services, they would not permit the installation of a septic system. Instead, he was required to connect to the city sewer system. The homeowner agreed to request annexation so that the city could move forward with providing sewer service to his property. Council Member E. Erickson inquired whether the adjoining property owners had been notified and given the opportunity to annex as well. P&Z Administrator Parkinson responded that most of the neighboring property owners were not interested in annexation at this time. Mayor Merrill opened the public hearing. Erickson Council Member E. Erickson Council President Walker The motion carried. 13. July 2, 2025, the application was presented to the City Council for a second read.
