within the City of Rexburg”
Summary of Information to consider with this request:
• The CUP applies to approximately 11.8 of
the 25.5 acre parcel and is bordered by both
12th W and Highway 20, between Willow
Brook Estates and Widdison Subdivision.
• The property is currently a field.
• The adjacent parcel to the north is zoned as
Rural Residential 2 (RR2), the same parcel to
the east is zoned as Low Density Residential
2 (LDR2), the parcels to the south and west
are zoned Rural Residential 1 (RR1).
• A total of 26 hearing notifications were
mailed to surrounding property owners.
• Pending public testimony, staff asks that the
Planning & Zoning Commission consider
recommending that City Council approves
the application.

Project Description
The applicant is requesting that a school for grades K-12 be allowed in a Low Density Residential
1 (LDR1) zone. The request applies to approximately 11.8 of the 25.5 acre parcel which is
located at approximately 301 S 12th W. The property is currently a field.
Nearby zones include Rural Residential 2 (RR2) to the north, Low Density Residential 2 (LDR2) to
the east, and Rural Residential 1 (RR1) to the south and west. (See attached current zoning map)
The current zoning of Low Density Residential 1 (LDR1) allows for schools with an approved
Conditional Use Permit (CUP).

Considerations for Approval
The approving body shall review the particular facts and circumstances of each proposed
conditional use and shall find adequate evidence to show that the proposed use will comply
with the following:
1. Be Listed as Conditional Use. Constitute a conditional use as established in this
Development Code.
2. Comprehensive Plan. Be in accordance with a specific or general objective of the city’s
Comprehensive Plan and the regulations of this Ordinance.
3. Harmony with Adjacent. Be designed and constructed in a manner to be harmonious
with the existing character of the neighborhood and the zone in which the property is
located.
4. Nuisance. Not create a nuisance or safety hazard for neighboring properties in terms of
excessive noise or vibration, improperly directed glare or heat, electrical interference,
odors, dust or air pollutants, solid waste generation and storage, hazardous materials or
waste, excessive traffic generation, or interference with pedestrian traffic.
5. Public Facilities and Services. The use will be adequately served by essential public
facilities and services such as street access, police and fire protection, drainage
structures, refuse disposal, water and sewer service, and schools. (If existing facilities are

not adequate, the developer shall show that such facilities shall be upgraded sufficiently
to serve the proposed use.)
6. Traffic . Not generate traffic in excess of the capacity of public streets or access points
serving the proposed use and will assure adequate visibility at traffic access points.
7. Buffers. Be effectively buffered to screen adjoining properties from adverse impacts of
noise, building size and resulting shadow, traffic, and parking.
8. Slope and Soil. Be compatible with the slope of the site and the capacity of the soils and
will not be in an area of natural hazard unless suitably designed to protect lives and
property.
9. Historic Features. Not result in the destruction, loss or damage of a historic feature of
significance to the community of Rexburg.
Supplementary Conditions and Safeguards. In granting a Conditional Use Permit, the approving
body may prescribe appropriate conditions and safeguards. Such conditions to be attached to
the permit may include but not be limited to:
1. Minimizing adverse impact on other developments.
2. Controlling the sequence and timing of development.
3. Controlling the duration of development.
4. Assuring the development is properly maintained.
5. Designating the exact location and nature of development.
6. Requiring the provision for on-site or off-site public facilities of services.
7. Requiring more restrictive standards than those generally required in this Ordinance.
Land use impacts that may need to be mitigated by conditions include the following:
1. An increase in daily or peak hour traffic.
2. A change in circulation patterns on or around the property.
3. A significant increase in the demand for parking.
4. A change in the density of people on site.
5. Expansion of the hours of operation.
6. Any increased environmental impact, such as noise or air pollutions; offensive odors;
excessive illumination or glare, etc.
Analysis/Potential Impacts/Recommendation
1. Be Listed as Conditional Use. Constitute a conditional use as established in this
Development Code.

THE TESTING AGENCY'S FINDINGS AND RECOMMENDATIONS SHALL BE FURNISHED TO THE
OWNER'S REPRESENTATIVE BY THE CONTRACTOR. NO TOPSOIL SHALL BE DELIVERED IN A
FROZEN OR MUDDY CONDITION. ACIDITY/ALKALINITY RANGE - PH. 5.5 TO 7.6.
16. IMMEDIATELY CLEAN UP ANY TOPSOIL OR OTHER DEBRIS ON THE SITE CREATED FROM LANDSCAPE
OPERATIONS AND DISPOSE OF PROPERLY OFF SITE.
17. TREES SHALL NOT BE PLANTED WITHIN THE 10'-0" CLEAR ZONE OF ALL STORM DRAIN PIPE,

GENERAL OVERVIEW
THIS REPORT OUTLINES RECOMMENDED REVEGETATION AND SLOPE STABILIZATION MEASURES FOR DISTURBED CUT AND FILL SLOPES WITHIN THE PROJECT
LIMITS AS DEFINED ON THE ACCOMPANYING PLAN WHICH WILL BE SEEDED WITH THE DRYLAND SEED MIX AND NOT IRRIGATED. THESE RECOMMENDATIONS ARE
MADE TO PREVENT SHORT TERM AND LONG TERM SOIL EROSION AS WELL AS TO PROVIDE AN AESTHETIC REVEGETATION WHICH WILL BLEND WITH THE EXISTING
NATURAL SURROUNDING AREA. THE MEASURES INCLUDE REVEGETATION AND HYDROMULCHING PROCEDURES FOLLOWING TOPSOIL DISTRIBUTION AND FINE
GRADING. THE AREA TO BE REVEGETATED CONSISTS OF ALL DISTURBED AREAS RELATED TO GRADING FOR CONSTRUCTION AND ANY OTHER AREAS DISTURBED IN
THE PROCESS OF CONSTRUCTION. THE SLOPES TO BE AFFECTED VARY WIDELY IN DEGREE AND ASPECT.
GENERAL EARTHWORK
ALL WORK SHALL BE LIMITED TO THE AREA REQUIRED FOR CONSTRUCTION WITH MINIMAL, IF ANY, DISTURBANCE TO THE SURROUNDING NATURAL SLOPE OR
VEGETATION. ALL FINISHED GRADES SHALL BE SMOOTH AND ROUNDED TO ENSURE A NATURAL TRANSITION BETWEEN NEW AND EXISTING GRADES. REFER TO
GRADING AND DRAINAGE PLANS FOR ADDITIONAL REQUIREMENTS.
SITE PREPARATION
EARTHWORK PROCESS SHOULD BEGIN WITH CLEARING LARGE SHRUBS FROM THE AREAS TO BE DISTURBED. WOODY STEMS AND BRANCHES SHALL BE
CHIPPED ON SITE TO IMPROVE THE AMOUNT OF ORGANIC MATERIAL IN THE TOP SOIL. NATURAL TOPSOIL OCCURS AT VARYING DEPTHS ON THE PROJECT SITE. THE
TOPSOIL SHOULD BE EXCAVATED AND STOCKPILED AT DESIGNATED STORAGE AREAS PRIOR TO THE PROPOSED GRADING OPERATIONS.
TOPSOIL DISTRIBUTION
ONCE THE GENERAL EARTHWORK IS COMPLETE AND ROUGH GRADING HAS BEEN ACCOMPLISHED, THE TOPSOIL SHOULD BE REDISTRIBUTED OVER THE AREA
TO MINIMUM DEPTHS AS SPECIFIED. WHERE NEEDED, SLOPES SHOULD BE GRADED WITH SERRATION TO HOLD TOPSOIL ADEQUATELY. TOPSOIL SHOULD BE
SPREAD AND LIGHTLY COMPACTED UTILIZING A SMALL CLEATED TRACTOR MOVING PERPENDICULAR TO THE CONTOURS OR ANOTHER METHOD WITH EQUAL
CAPABILITY. IT IS OUR RECOMMENDATION THAT ANY NECESSARY MECHANICAL MEANS OF EROSION CONTROL BE IN PLACE PRIOR TO BEGINNING SITE
DISTURBANCE.
ONCE TOPSOIL HAS BEEN DISTRIBUTED AND GRADED, REVEGETATION SEEDING SHALL FOLLOW IMMEDIATELY. IN ORDER TO ELIMINATE SURFACE CRUSTING

NOTICE IS HEREBY GIVEN, that on June 5, 2025 at 6:30 pm a Public Hearing will be held
before the Planning & Zoning Commission of the City of Rexburg, Idaho, at City Hall located at 35
North 1st East, Rexburg, Idaho, regarding a Conditional Use Permit (CUP) (#25 00437) to allow a
school in Low Density Residential 1 (LDR1) zone, per the Rexburg Development Code as a
Conditional Use. The said parcel is located at approximately 301 S 12th W in Rexburg, Madison
County, Idaho, and more particularly described as follows:
Legal Description:
A parcel of land that lies fully within the Southwest quarter of the Northwest Quarter of Section 25,
Township 6 North, Range 30 East, Boise Meridian. Subject parcel being 13.864 acres of land as
described in the Warranty Deed Instrument Number 250423 as found in the Madison County
Recorder's Office. Basis of Bearing is North 89° 48' 29" East 2637.14 feet measured between the
found West Quarter Comer and the Center Quarter Comer of said Section 25. Subject parcel being
more particularly described as follows:
Beginning at a found brass cap marking the West Quarter Comer of said Section 25, said point being
the True Point of Beginning; Running thence North 00° 21' 57" West 660.13 feet along the section
line to the North line of the South Half of the South Half of the Northwest Quarter of said Section
25; Thence North 89° 49' 15" East 915.00 feet along the said North line to a point; Thence South
00° 21' 57" East 659.93 feet to the East-West Quarter Section line; Thence South 89° 48' 29" West

PUBLIC HEARING INSTRUCTIONS
1. Please sign the list in the lobby to ensure you are permitted to speak.
2. The applicant will come forward, providing his/her name and residential mailing address for
the record and the Commission will ask clarifying questions of the applicant.
3. The members of the Commission may ask Staff about anything they feel will help clarify the
proposal.
4. The public hearing will be opened by the chairman. At this time, the public may testify to
the Commission their views for this proposal.

8. The public hearing will then be closed. Once the hearing is closed, no public participation
can occur.
9. The Commission will ask Staff to present their report and findings.

12. The Commission will make a motion declaring the reason for their decision.
13. The Commission will deliberate on the motion.
