January 23, 2025, An application was received from Jared Killpack with New Peak Construction Company to rezone a parcel from Medium Density Residential 1 (MDR1) to Medium Density Residential 2 (MDR2). 2. January 23, 2025, Payment was received for the application. 3. January 24, 2025, Additional application documents were received. 4. January 24, 2025, Application paperwork was completed. 5. January 24, 2025, Staff reviews were assigned. 6. January 29, 2025, Staff reviews were approved. 7. February 19, 2025, Staff Report was completed. (See attached) 8. February 6, 2025, Notice was sent to the newspaper to be published February 18, 2025, and February 25, 2025. 9. February 18, 2025, Notice was mailed to surrounding property owners. 10. February 25, 2025, Notice was posted on the property. 11. March 6, 2025, The application was presented to the Planning & Zoning Commission. Public Hearing – (25-00039) Yellowstone Heights – Rezone from MDR1 to MDR2 – Located at approximately 238 & 243 Ella Ln, the application is to change the zoning map of 3.002 acres from Medium Density Residential 1 (MDR1) to Medium Density Residential 2 (MDR2). – Jared Killpack (Action) Conflict of Interest/Ex parte Conversation: Chairperson Smith asked the Commissioners to disclose any conflicts of interest or conversations held outside of this meeting relative to this particular subject. Presentation: Commissioner Johnson arrived at 6:33 Planning & Zoning Administrator Parkinson began by showing the property’s location on the map on the screen. He explained that the property was rezoned to MDR1 within the last few years. He shared that the original plan was to plat and build four 12-plexes, but the applicant modified their plans to conform to the MDR1 requirements. Commissioner Francis asked if the property was pre-planned. Administrator Parkinson confirmed that the property is already condo platted, but the applicant will need to amend the plat, if the zone change is approved. Commissioner Muir inquired about the number of structures on the parcel. Administrator Parkinson answered two structures that are platted as condos are located on the south side, and the amended plat will use the footprint of the condos on the north side. The applicant, Brandon Hall, confirmed that was correct. Attorney Rammell asked Administrator Parkinson to reiterate the brief presentation of the application for those who were late. Chairperson Kempton opened the public input portion of the hearing at 6:37 pm. Commissioner Discussion: Commissioner Haley reasoned that the area has had a lot of growth with large complexes and this fits with the growth the area has experienced. Commissioner Lawrence agreed. Commissioner Francis discussed the residential growth in the area, including Thomson Farms and the new Drive In development. He stated that this fits in well with the higher density area and that he doesn’t see any conflicts. MOTION: Motion to recommend City Council approve the zone change from MDR1 to MDR2 on the proposed property because of the surroundings of commercial and higher density residential, and it fits with the area and the Comprehensive Plan. Designated as Ordinance No 1329 if motion passes and considered first read – Alan Parkinson - Action Item P&Z Administrator Parkinson reviewed the rezone at approximately 238 and 243 Ella Lane from Medium Density Residential 1 (MDR1) to Medium Density Residential 2 (MDR 2). The developer is requesting MDR 2 to be able to add two 12 plexes on the north side of the property making it a total of 24 units instead of the 20 it was previously platted for; they will need to amend the plat later. The plat amendment requires City Council approval. The request applies to approximately 3.002 acres and is located at approximately 238 & 243 Ella Lane. The property has been platted for condominiums and currently consists of two 12-plex condominium buildings. The adjacent parcels to the east are zoned as Medium Density Residential 1 (MDR1). The areas to the north, south, and west are zoned as Community Business Center (CBC). (See attached current zoning map) The current zoning of Medium Density Residential 1 (MDR1) allows for a maximum density of 16 units per acre, consisting of attached single-family homes, multi-family, or a dormitory with a Conditional Use Permit (CUP). The proposed zoning of Medium Density Residential 2 (MDR2) allows for a maximum density of 20 units per acre, consisting of attached single-family homes, multi-family, or a dormitory with a Conditional Use Permit (CUP). Not considering parking, infrastructure, or permissible lot coverage requirements, a maximum of 60 units would be allowed on this property. The current Comprehensive Plan designation of Intermediate Residential supports the Medium Density Residential 2 (MDR2) zone request.
