Chairperson Kempton opened the meeting at 6:30 PM.

4. Approval of the P&Z Minutes for February 6, 2025 (Action)
MOTION: Motion to approve the Planning & Zoning minutes as recorded for
February 6, 2025 (Action)
Action: Approve, Moved by Bruce Casper, Seconded by Vern Muir.

PUBLIC HEARING
5. Public Hearing – (25-00039) Yellowstone Heights – Rezone from MDR1 to MDR2 –
Located at approximately 238 & 243 Ella Ln, the application is to change the zoning map
of 3.002 acres from Medium Density Residential 1 (MDR1) to Medium Density
Residential 2 (MDR2). – Jared Killpack (Action)

Conflict of Interest/Ex parte Conversation: Chairperson Smith asked the
Commissioners to disclose any conflicts of interest or conversations held outside of this
meeting relative to this particular subject.

Commissioner Johnson arrived at 6:33
Planning & Zoning Administrator Parkinson began by showing the property’s location on the
map on the screen. He explained that the property was rezoned to MDR1 within the last few years.
He shared that the original plan was to plat and build four 12-plexes, but the applicant modified their
plans to conform to the MDR1 requirements. Administrator Parkinson explained that the zone
change would allow the applicant to put the additional units on the parcel and is consistent with the
original plan of the area.
Commissioner Francis asked if the property was pre-planned. Administrator Parkinson
confirmed that the property is already condo platted, but the applicant will need to amend the plat, if
the zone change is approved. Commissioner Muir inquired about the number of structures on the
parcel. Administrator Parkinson answered two structures that are platted as condos are located
on the south side, and the amended plat will use the footprint of the condos on the north side. The
applicant, Brandon Hall, confirmed that was correct.
Attorney Rammell asked Administrator Parkinson to reiterate the brief presentation of the
application for those who were late.

Commissioner Discussion:
Commissioner Haley reasoned that the area has had a lot of growth with large complexes and this
fits with the growth the area has experienced. Commissioner Lawrence agreed.
Commissioner Francis discussed the residential growth in the area, including Thomson Farms
and the new Drive In development. He stated that this fits in well with the higher density area and
that he doesn’t see any conflicts.

MOTION: Motion to recommend City Council approve the zone change from MDR1 to MDR2
on the proposed property because of the surroundings of commercial and higher density
residential, and it fits with the area and the Comprehensive Plan.
Action: Approve, Moved by Vince Haley, Seconded by Vanessa Johnson.

Commissioner Training
Administrator Parkinson introduced the video as being part of the training videos put together by
the Association of Idaho Cities and American Planning Association.
The group reviewed the video training then discussed the overlay’s relevant to the City of Rexburg
and the Form Based code. Commissioner Kempton related the permitted uses topic of the video
to the recent code changes that grouped similar services and simplified the uses. Administrator
Parkinson shared that the next proposed changes to the code would be landscaping, daycares,
and parking.
Commissioner Muir asked how home businesses are regulated within the city. Administrator
Parkinson discussed Home Occupations and Home Businesses and their requirements.
Discussion moved on to the challenges of representing the city as a whole, and not just personal
interests or the few who attend a hearing.
