ORDINANCE NO. 1327
Annexing Twelve (12) Enclaved Properties into the City of Rexburg, Madison, Idaho
AN ORDINANCE ANNEXING CERTAIN LANDS TO THE CITY OF REXBURG, IDAHO; DESCRIBING SAID LANDS AND DECLARING SAME A PART OF THE CITY OF REXBURG, IDAHO; AND PROVIDING WHEN THIS ORDINANCE SHALL
BECOME EFFECTIVE.
BE IT ORDAINED BY the City of Rexburg, Idaho:
WHEREAS, the lands hereinafter described are enclaved, contiguous, and adjacent to the City of Rexburg, Idaho, and have been laid off, subdivided or platted, and/or the City has been
requested to annex the same to the City of Rexburg, Idaho; and
WHEREAS, it appears to the Mayor and City Council of the City of Rexburg, Idaho, that the hereinafter described properties is subject to annexation to the City of Rexburg under and pursuant
to the provisions of Section 50-222 Idaho Code, and that said lands should be annexed to and become a part of the City of Rexburg, Idaho; and
WHEREAS, the City Council referred the zoning of the affected territory for report and recommendations to the Planning and Zoning Commission, and the Planning and Zoning Commission made
its report and recommendations for zoning classification of the hereinafter described properties proposed to be annexed; and
WHEREAS, the Council has determined that the proper classification under the Zoning Ordinance of the City of Rexburg, Idaho, for the properties to be annexed is as hereinafter set forth.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF REXBURG, AS FOLLOWS:
The depicted properties are in the Impact Area for the City of Rexburg.

These properties are hereby annexed to the City of Rexburg and are hereby declared to be a part of the City of Rexburg, Idaho (#24 00918).

Property #1 901 S 5th W: Commencing at a point that is 1453.5 feet South of the Northwest corner of Section 31, Township 6 North, Range 40 East, Boise, Meridian, Madison County, Idaho;
and running thence East 150 feet; thence South 88 feet; thence West 150 feet; thence North 88 feet to the point of beginning.
Property #2 909 S 5th W: Commencing at a point that is 1541.5 feet South of the Northwest corner
of Section 31, Township 6 North, Range 40 East of the Boise Meridian, Madison County, Idaho, and running thence East 150 feet; thence South 80 feet; thence West 150 feet; thence North

Madison County, Idaho. Said parcel being part of an entire tract, described as "Parcel 1" in Instrument No. 380846 on file in the office of the Madison County Recorder. Said parcel
more particularly described as follows:
COMMENCING at the southwest corner of said Section 24, a brass cap as per Corner Record
Instrument No. 392466; thence along the south line of the southwest quarter of said Section 24,
N.89°51'37"E. (Record East) 760.00 feet to the southwest corner of said entire tract at a point
2.96 feet left of Project Centerline Station 358+47.64 and the POINT OF BEGINNING.
Thence along the west line of said entire tract, N.00°08'23"W. (Record North) 65.99 feet to a
point 68.95 feet left of Project Centerline Station 358+48.54; Thence N.89°51'32"E. 206.50 feet, more or less, to the east line of said entire tract at a point 66.39 feet left of Project

Idaho (said point also being the SW corner of Government Lot 1); Thence North 995.92 feet, Thence S 46°58’05” E 317.91 feet, Thence S 26°55’22” E 748.56 feet, Thence S 61°56’48” E 237.19
feet, Thence West 780.64 feet to the point of beginning.
SECTION I: That the above described properties hereby annexed to the City of Rexburg be, and the same is hereby classified under the Zoning Ordinance of the City of Rexburg as above
set forth; that the Zoning shall be amended to show this annexation and classification of the above described properties so annexed and that said amendment shall be certified to and
declared to be the official Zoning Map of the City of Rexburg by a certificate of the Mayor and Council of the City of Rexburg endorsed thereon.
SECTION II: This ordinance shall be in full force and effect from and after its passage, approval and due publication.
