October 14, 2024, An application was created to annex 12 parcels located near 1076 W Main St, 5th W and University Dr, and Eagle Park 2. October 14, 2024, Staff reviews were assigned. 3. October 28, 2024, Staff reviews were approved. 4. December 23, 2024, Staff Report was completed. 5. November 25, 2024, Notice was sent to the newspaper to be published December 6, 2024, December 17, 2024, January 3, 2025, and January 14, 2025. 6. December 5, 2024, Notice was mailed to surrounding property owners within 350’ for the Planning & Zoning hearing. 7. December 17, 2024, Notice was mailed to surrounding property owners within 350’ for the City Council hearing. 8. January 2, 2025, Notice was posted on the property for both hearings. 9. January 9, 2025, the application was presented to the Planning & Zoning Commission. Public Hearing – (24-00918) Annexation – Located at approximately 1076 W Main St, 5th W and University Dr, and Eagle Park, the application is to annex the properties into the City of Rexburg. – City of Rexburg (Action) Conflict of Interest/Ex parte Conversation: Chairperson Smith asked the Commissioners to disclose any conflicts of interest or conversations held outside of this meeting relative to this particular subject. Commissioner Haley asked if the properties must all be annexed together or if they can be approved separately. Planning and Zoning Administrator Parkinson and Attorney Rammell both confirmed it can be split into separate actions. Presentation: Planning and Zoning Administrator Parkinson explained that there are multiple parcels included in the annexation and showed the locations and zoning of the properties. He explained that while the Eagle Park parcel is a voluntary annexation because the city owns it, the other areas are involuntary but allowed to be annexed because they are islands and surrounded by city limits. He confirmed that there will be no zoning changes with the annexation. Administrator Parkinson (208) 359-3020 35 North 1st East Rexburg, ID 83440 Rexburg.org | Engage.Rexburg.org stated that City Staff have reviewed the annexation and all parcels are receiving city services other than sewer and water. Commissioner Haley asked how long the areas have been islands. Administrator Parkinson estimated that the 5th West area has been an island for 15-20 years, while the Main Street area is more recent within the last few years. He indicated that another island was created with the annexation of the Artco property and stated that the new island will be annexed in soon. Commissioner Haley inquired about the effects of the annexation on the property. Administrator Parkinson confirmed that the properties would be subject to city taxes but will be grandfathered in unless the use changes. He also explained that if the septic fails, the properties would be required to connect to city sewer. Chairperson Smith asked if any islands remain. Administrator Parkinson clarified only the newly created island near Artco. Commissioner Muir asked if the 5th West area was the only island with residents. Administrator Parkinson confirmed that was correct. Commissioner Francis inquired about the size of the city owned parcel. Administrator Parkinson answered 8.14 acres and shared that eventually 5th West will be built through towards Moody. Chairperson Smith opened the public input portion of the hearing at 6:44 pm. Favor: Ted Whyte shared that his property borders the parcels to be annexed and he expected the properties to be annexed long before now. He explained that he has held off developing his property, so he doesn’t create a weird spot where 5th West is widened. He shared that in his opinion, 5th West should be widened across University Blvd to be more of an open corridor. He is in favor of annexing the parcels to further expand services to that area. Neutral: none Opposed: Mark Garner, representing Alpine Propane, stated they are technically opposed to annexation and would prefer not to see any change, but acknowledged that being an enclave, it will be annexed eventually. He wanted to make sure it was on record that Alpine Propane intends to continue to operate as it always has, and they intend to continue to farm the land behind Alpine Propane and qualifying for ag land treatment. Commissioner Discussion: Commissioner Haley doesn’t see any reason not to move forward with the annexation. He commented that they have all been islands as long as he has been on the Planning & Zoning Commission the last 6-7 years. He continued that in the interest of being uniform and providing services to areas, he is in favor of the annexation. Commissioner Richards acknowledged the comments made by the propane company and pointed out that they will benefit from the updated intersection. He also noted that the island on 5th West will benefit from coming into the city. Commissioner Hanna asked if the ag exemption would continue. Administrator Parkinson confirmed that it can continue as it is. Commissioner Hanna inquired about the advantages or disadvantages of waiting to annex the properties. Administrator Parkinson acknowledged that the properties are already complying with City Ordinances and Codes since they are located within the impact zone. Commissioner Francis asked if things like sidewalks would be required. Administrator Parkinson answered that the properties are grandfathered until they redevelop or go through a major upgrade, but in the RR1 zone, sidewalks are not required. Commissioner Haley noted that the city worked with residents and waited as long as possible before annexing the properties, but it was a long time coming. MOTION: Motion to recommend City Council approve the annexation of these parcels, as listed, to remove the islands that currently exist and to bring the city property into the city as it should be. January 22, 2025, the application was presented to the City Council for a public hearing and to be considered first read. Public Hearing 6:30 P.M. Annexation of enclaved properties located at approximately 1076 W Main St, 5th W and University Blvd, and Eagle Park into the City of Rexburg #24-00918. Designated as Ordinance No 1327 if motion passes and considered first read – Alan Parkinson Planning and Zoning Administrator Parkinson reviewed the Planning and Zoning Staff Report and explained there are two areas within the city that are considered enclaves. Idaho State Statute allows the city to annex these properties because they are currently receiving some city services, such as access to public roads, sewer, and water. Currently, these properties are not receiving city sewer and water services; however, they have access to other city services. P&Z Administrator Parkinson said there was one landowner that spoke against the proposal because they would prefer to wait a couple more years before their property is annexed. P&Z Administrator Parkinson mentioned there is one parcel of the city’s Eagle Park that was never annexed into the city so that parcel is part of this annexation. Council President Walker opened the public hearing. They were under the impression that they would not be able to use their property in the manner that they are currently using their property. City staff informed them that the annexation would not force them to change the use of their property because it is grandfathered into the city. Council President Walker clarified the annexation of these properties into the city does not affect the property’s current zone. The request would bring approximately 25.63 acres into the city limits. The properties are currently enclaves of land that are not incorporated into the city, considered part of the area of impact, but surrounded by incorporated land. (See attached vicinity maps) The properties are zoned as Public Facilities; Rural Residential 1 (RR1); and Community Business Center (CBC) and Transitional Agriculture (TAG). The Comprehensive Plan designations are Open Space/Public Facility; Intermediate Residential; and Commercial. Neither the Comprehensive Plan designations nor the zoning will change at this time if the annexation is approved.
