Annexing 36o Stationery Rd in the Impact Area for the City of
Rexburg into the City of Rexburg, Madison, Idaho
AN ORDINANCE ANNEXING CERTAIN LANDS TO THE CITY OF
REXBURG, IDAHO; DESCRIBING SAID LANDS AND DECLARING SAME A
PART OF THE CITY OF REXBURG, IDAHO; AND PROVIDING WHEN THIS
ORDINANCE SHALL BECOME EFFECTIVE.
BE IT ORDAINED BY the City of Rexburg, Idaho:
WHEREAS, the lands hereinafter described are contiguous and
adjacent to the City of Rexburg, Idaho, and have been laid off, subdivided or
platted, and/or the City has been requested to annex the same to the City of
Rexburg, Idaho; and
WHEREAS, it appears to the Mayor and City Council of the City of
Rexburg, Idaho, that the hereinafter described properties is subject to annexation
to the City of Rexburg under and pursuant to the provisions of Section 50-222
Idaho Code, and that said lands should be annexed to and become a part of the
City of Rexburg, Idaho; and
WHEREAS, the City Council referred the zoning of the affected
territory for report and recommendations to the Planning and Zoning
Commission, and the Planning and Zoning Commission made its report and
recommendations for zoning classification of the hereinafter described properties
proposed to be annexed; and
WHEREAS, the Council has determined that the proper classification
under the Zoning Ordinance of the City of Rexburg, Idaho, for the properties to
be annexed is as hereinafter set forth.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY
COUNCIL OF THE CITY OF REXBURG, AS FOLLOWS:
The property located at approximately 36o Stationery Rd in the Impact Area for
the City of Rexburg. This property is hereby annexed to the City of Rexburg and
are hereby declared to be a part of the City of Rexburg, Idaho (#24 oo663).
The property is described as follows on the updated Annexation Map:
Legal Description:
Commencing at the N 1/4 Corner of section 17, Township o6 North Range 4o East,
Boise Meridian, in Madison County, Idaho; thence South 257.75 feet; thence S
30029'00" W 401.6 feet along the east right of way of Hwy 33 to the point of
beginning. Thence N 89053'57" W 179.76 feet; thence S 89043'55" W 1447.77
feet; thence S 00°09'15 W 487.66 feet; thence N 89050'45 W 318 feet; thence S
00044'05" W 71.89 feet to the Artco Business Park Subdivision boundary; thence
following the Artco Business Park boundary the following (4) calls: S 89052'42" E
166.81 feet; thence S 45°03'07" E 115.07 feet; thence S 21033'30" W 211.43 feet;
thence S oo01o'o6" W 217.1 feet to the Northwest corner of the Rexburg Business
Park Div. 2 subdivision; thence following the Rexburg Business Park Div. 2
boundary the following (3) calls: S 71057'27" E 140.82 feet; thence N 88020'19" E
158.05 feet; thence S 89°49'54" E 664.39 feet to the west railroad right-of-way

line; thence continuing S 89049'54" E 190 feet to the east right-of-way line of
Hwy 33; thence following the east right-of-way line of Hwy 33 for the next (6)
calls: N 30°23'50" E 135.71 feet along the City of Rexburg corporation Line;
thence N 28023'39" E 2o6.84 feet; thence N 51025'30" E 27.45 feet; thence N
30016'29" E 111.21 feet; thence N 28043'31" E 299.62 feet; thence N 29038'04" E
491.42 feet to the point of beginning.
SECTION I: That the above described property hereby annexed to the City of
Rexburg be, and the same is hereby classified under the Zoning Ordinance of the
City of Rexburg as above set forth; that the Zoning shall be amended to show this
annexation and classification of the above described property so annexed and
that said amendment shall be certified to and declared to be the official Zoning
Map of the City of Rexburg by a certificate of the Mayor and Council of the City of
Rexburg endorsed thereon.
SECTION II: This ordinance shall be in full force and effect from and after its
passage, approval and due publication.
PASSED BY THE CITY COUNCIL AND APPROVED BY THE MAYOR on this
