May 21, 2024, An application was received from Bron Leatham to rezone a part of a parcel from Mixed Use (MU) to Community Business Center (CBC). 2. May 28, 2024, At the request of Bron Leatham, James Holm was added to the application to rezone his parcel from Transitional Agriculture (TAG) to Community Business Center (CBC). 3. May 30, 2024, Payment was received from Bron Leatham for the application. 4. June 3, 2024, Payment was received from James Holm for the application. 5. June 4, 2024, Staff reviews were assigned. 6. June 18, 2024, Staff reviews were approved. 7. June 26, 2024, Staff Report was completed. 8. June 15, 2024, Notice was sent to the newspaper to be published July 19, 2024 and July 26, 2024. 9. June 15, 2024, Notice was mailed to surrounding property owners. 10. July 3, 2024, Notice was posted on the property. 11. July 18, 2024, the application was presented to the Planning & Zoning Commission. Public Hearing – (24-00418) 10 Twenty Two Main LLC & DSH Living Trust – Rezone from Transitional Agriculture (TAG) & Mixed Use (MU) to Community Business Center (CBC) – Located at approximately 1022 W Main St & 250 N 12th W, the application is to change the zoning of approximately 34.06 acres from Transitional Agriculture (TAG) & Mixed Use (MU) to Community Business Center (CBC). – Bron Leatham & James Holm (Action) Presentation: Alan presented, sharing it is the same parcels as the previous agenda item, and changing the zone to Community Business Center (CBC)/commercial. Staff has reviewed the application, there are some things that need done to service all of the area, but the city will have the capacity to service the area as they build. Alan showed the zoning on the map and the group discussed the application property, as well as surrounding properties. Vince shared his concern about the size of the intersection at Main Street and 12th West. Alan mentioned that the stop lights are being synchronized and 12th W will be widened to accommodate traffic. Vince reiterated that commercial fits in this area. Commissioner Discussion: Bruce asked about the Community Business Center (CBC) zone. Alan gave the example of 2nd East. MOTION: Motion to recommend that City Council approve the rezone from Transitional Agriculture (TAG) & Mixed Use (MU) to Community Business Center (CBC) because the proximity to the interchange and highway make this a good fit for commercial and it will be a great fit for the community. Owners of both parcels are wanting the zone change. Council Member C. Erickson moved to approve the rezone from Transitional Agriculture (TAG) and Mixed Use (MU) to Community Business Center (CBC) zone at 250 N 12th W and 1022 W Main St #24-00418. Designated as Ordinance No 1317 and considered first read if motion passes; Council Member Johnson seconded the motion; Council Member E. Erickson asked about the potential use of the land. City Planner Parkinson said the owners do have multiple plans but have not said what they are. It will most likely be used for commercial development, not residential. Council Member E. Erickson asked about the plat that will come forward and if they would have to approve that. Alan said yes and added that it will take additional infrastructure which the developers will be responsible for. Council Member E. Erickson is a little concerned that the commercial zones are spreading in all directions. Mayor Merrill commented that the developer’s ideas could change over time. He also added that having these commercial nodes is kind of nice because it brings needed amenities closer to the residents. Hwy 33 will need to be widened eventually by Valley Wide. Council Member Johnson asked about which zone has the most traffic. Planner Parkinson said mixed use would probably have more traffic.
