THIS INDENTURE is made this ay of Xe�r 2023, by and between
ALD HOLDINGS LLC ("Grantor") and the STATE OF IDAHO, IDAHO TRANSPORTATION BOARD, by
and through the IDAHO TRANSPORTATION DEPARTMENT ("Grantee"), whose address is 3311
West State Street, Boise, Idaho 83703.
WITNESSETH: That Grantor, for value received, does, by these presents, grant, bargain,
sell and convey unto Grantee the following described real property situated in the County of
MADISON, State of Idaho, to -wit:
SEE EXHIBIT A ATTACHED HERETO
AND BY THIS REFERENCE MADE A PART HEREOF.
Containing approximately 0.131 acres.
Highway Station Reference: 358+47.64 to 360+54.71
Together with all appurtenances, easements and rights of way.
TOGETHER WITH all rights of access between the right of way of SH-33, Highway Survey,
as shown on the plans of SH 33, JCT US 20 (IC333), REXBURG, Project No. A021(798), Highway
Survey, and the remaining property of Grantor that is contiguous with the SH-33 right of way.

TO HAVE AND TO HOLD the said property with its appurtenances unto said Grantee, and
Grantee's successors and assigns forever. Grantor does hereby covenant to and with Grantee,
that Grantor is the owner in fee simple of said property; that said property is free from all
encumbrances, EXCEPT those to which this conveyance is expressly made subject and those
made, suffered or done by Grantee; and subject to reservations, restrictions, dedications,
easements, right of way and agreements (if any) of record, and general taxes and assessments
(including irrigation and utility assessments, if any) for the current year, which are not yet due
and payable, and that Grantor will warrant and defend the same from all lawful claims
whatsoever.

COMMENCING at the southwest corner of said Section 24, a brass cap as per Corner Record
Instrument No. 392466; thence along the south line of the southwest quarter of said Section 24,
N.89°51'37"E. (Record East) 760.00 feet to the southwest corner of said entire tract at a point
2.96 feet left of Project Centerline Station 358+47.64 and the POINT OF BEGINNING.
