I visited with Stephen, if your daughter lives in the house and you do not exceed the 12
children, we can proceed with the CUP. Just be aware that the neighborhood and Code
enforcement will keep an eye on any changes that happen. This could cause you to
lose your ability to operate the daycare.
We will proceed with the CUP and get you on an agenda as early as possible.

Brittnees response shows that she has her daughter living in the residence and they
would keep enrollment at 12 or less. This should qualify her to proceed right?

Thank you Alan. We are currently only caring for 12 children. So if I didn't enroll any more
than that would I be able to move forward? My 18 yr old daughter is also living in the home
and using it as residential. I want to do everything I can to make this work. My overall goal
is just to be able to provide child care for low income families that cannot afford to take the
children to the other daycares in rexburg because they can not afford it.

I am so sorry about this. We thought it would qualify until it was pointed out to us
that the use of a daycare in residential areas requires that you must reside in the
building for this to qualify, also the number of students would have to remain below
12 to qualify also.
In moving forward you will need to identify locations in Community Business Center
(CBC), MIxed Use (MU), Regional Business Center (RBC) which are permitted without
a CUP and then in Light industrail (LI), Heavy Industrial (HI) and University District
(UD) with a CUP.
If you need help please stop by and I can show you how to search these on the GIS
map by zone.

Hi Alan,
This is Brittnee McMinn. Christy just forwarded the email stating that 100 N. 5th W.
Doesn't qualify for a CUP. I was wondering if you could provide me the information as to
why that building doesn't qualify and possibly areas in the city that would qualify. I have
poured my heart and soul, as well as tears and hard work into that building and just would
like to be more educated on the reasoning behind it.
