His response is attached below. It looks like the test by UL did not allow these batteries to be installed in habitable locations. Unfortunately the batteries will have to move out of a habitable space so we can keep in compliance with the UL standards of this product. For an ESS to be listed as “Suitable for Use in Residential Habitable Spaces” the ESS must past the cell level test in UL 9540A. To pass the cell level test the cell must not be induced into thermal runaway and the cell can’t vent flammable gas. In the report provide on Page 3 in the section on the cell level test it indicates that the cell was driven into thermal runaway and the vent gas was flammable so it did not pass the cell level test and can’t be installed in the habitable spaces in a dwelling unit. Also make sure that the ESS is listed and labeled in accordance with UL 9540 by a NRTL. A UL 9540A Large Scale test report should not be used in lieu of UL 9540 Certification. Please let me know if I can be of further assistance. These batteries are already installed in a habitable location of a residential dwelling (they are on the plant shelf in a kitchen). They are lithium ion batteries and the homeowner is told by the salesman they do not off-gas. My question to you is this, is this battery listed to be installed in a habitable location? Does the battery off-gas and if it does, is this gas noxious (will it cause health issues to the residents)? The document that Pytes sent in answer to my question about off-gassing and fire and explosion is attached to this email. I don;t see anything about off-gassing but only what I heard verbally that they are sealed units and cannot off-gas. Anyway, please take a look at the attached and let me know what you think.
