PARADE AND PUBLIC ASSEMBLY ORDINANCE AND PARK
RESERVATION AMENDMENTS
ORDINANCE OF THE CITY OF REXBURG, MADISON COUNTY,
IDAHO AMENDING ORDINANCE NUMBER 8io KNOWN AS
THE "PARADE AND PUBLIC ASSEMBLY ORDINANCE" TO
PROHIBIT PERSONAL PROPERTY PLACED ON THE PUBLIC
RIGHT OF WAY PRIOR TO 6:oo P.M. THE DAY BEFORE AN
EVENT; SETTING AREAS AROUND PARK SHELTERS AND
FACILITES FOR RESERVATION; PROVIDING FOR
SEVERABILITY; REPEALING ALL ORDINANCES AND PARTS OF
ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN
EFFECTIVE DATE HEREOF.
WHEREAS, the City of Rexburg has had difficulties preparing
the public right of way for parade events due to personal property
placed in the public right of way prior to the event; and
WHEREAS, the City of Rexburg will include designated areas
around park shelters and facilities that are available for reservation
by the public.
NOW THEREFORE, be it ordained by the Council of the City
of Rexburg, in the State of Idaho, as follows:
SECTION is AMENDMENT "12.o6.1oo Prohibitions And
Regulations" of the Rexburg Municipal Code is hereby amended as
follows:
12.o6.1oo Prohibitions And Regulations
A. A permittee hereunder shall comply with all permit conditions and
with all federal, state and local laws. (Ord. 810 §9,1998)•
B. No personal property maybe placed on the public right-of-way
before 6:oo P.M. the day prior to the event.
C. Any personal property placed on the public right-of-way before 6:oo
P.M. the day prior to the event will be removed.
SECTION 2: ADOPTION "12.04.045 Reservations" of
the Rexburg Municipal Code is hereby added as follows:
12.04.045 Reservations (Added)
Park shelters and facilities may be reserved for private gatherings in the
City's parks. Fees for reservations are set by resolution and can be
found in the City's Master Fee List.
Areas around the shelters/facilities included in the reservation are depicted in
the maps below:
Eagle Park:
• Eagle Park Shelter
Evergreen Park:
• Evergreen Park Shelter
Nature Park:
• Nature Park Northeast Shelter
• Nature Park Northwest Shelter

• Nature Park Southeast Shelter
Porter Park:
• Porter Park North Shelter
• Porter Park Beehive Stage and South Shelter (Depiction
of the separate facility reservations/areas)
Smith Park:
• Smith Park Gazebo
• Smith Park East (North) Shelter
• Smith Park South Shelter
SECTION 13: REPEALER CLAUSE All ordinances or
resolutions or parts thereof, which are in conflict herewith, are
hereby repealed.
SECTION 14: SEVERABILITY CLAUSE Should any part or
provision of this Ordinance be declared by the courts to be
unconstitutional or invalid, such decision shall not affect the validity of
the Ordinances a whole or any part thereof other than the part so
declared to be unconstitutional or invalid.
SECTION 15: EFFECTIVE DATE This Ordinance shall be in
full force and effect from May 1, 2024, and after the required
approval and publication according to law.
