January 22, 2024, An application was received for a plat from Travis Payne at Connect Engineering. 2. January 22, 2024, Application paperwork was complete. 3. January 22, 2024, Payment was received for the application. 4. January 22, 2024, Infrastructure plans were submitted. 5. January 22, 2024, Plat reviews were initiated. 6. March 4, 2024, Infrastructure plans were approved by staff. 7. March 18, 2024, Plat reviews were approved and send to applicant. 8. March 18, 2023, Plat was submitted to the County Surveyor for review. 9. April 8, 2024, The County Surveyor approved the plat. 10. April 8, 2024, Staff Report was completed. 11. April 4, 2024, the application was presented to the Planning & Zoning Commission. Plat – (24-00053) Alpine Heights Division 1 – Plat – Located at approximately 501 E 7th S, the plat consists of approximately 25.36 acres and will contain 65 lots. - Travis Payne (Ac�on) Presentation: The applicant, Travis Payne, began the presentation by pointing out that the parcel is located within a Low Density Residential 1 (LDR1) zone and falls below the maximum density allowed. He indicated that the city reported that there is sufficient water and sewer for the development. The group discussed the location and access to the plat. Aaron inquired about the platted road. Alan stated that they must develop a significant portion of the road to ensure it is viable for two way traffic, but that the developer is not responsible for curb, gutter or sidewalks on the north side of the road. Attorney Zollinger confirmed that the road is required to be developed a little more than half way to ensure it drains properly. Vince inquired about the lot size. Alan informed the commission that this application falls under the old code for lot size. Sally stated she likes the plat and inquired about the draft of covenants. Travis Morris with Hamlet Homes answered with their potential plans. McKay clarified that the plans should not affect this decision. Alan confirmed it would not. Sally asked about short term and long term rentals being excluded from the covenants. McKay asked if the plat has met staff requirements. Alan confirmed. Vince reflected on previous proposals for this area and commented that this plat makes sense and the smaller lots meet the current market demand. Conflict of Interest/Ex parte Conversation: Chairperson Smith asked the Commissioners to disclose any conflicts of interest or conversations held outside of this meeting relative to this particular subject. Commissioner Discussion: none MOTION: Motion to recommend City Council approve the Alpine Heights Division 1 Plat as the plat meets the requirements of the zoning and staff. Action: Approve, Moved by Aaron Richards, Seconded by Bruce Casper. Commissioner Discussion on the Motion: none VOTE: Motion carried. (Summary: Yes= 8, No= 0, Abstain = 0). April 17, 2024, the application was presented to City Council. Planning & Zoning recommendation to approve Alpine Heights Division 1 Plat located at approximately 501 E 7th S #24-00053 - Alan Parkinson P&Z Administrator Parkinson reviewed the Alpine Heights Division 1 Plat located at approximately 501 E 7th S. Council Member E. Erickson said he has a conflict of interest and will abstain from voting on this plat. (208) 359-3020 35 North 1st East Rexburg, ID 83440 Rexburg.org | Engage.Rexburg.org Council Member C. Erickson asked for clarification regarding the road that would only be halfway built. P&Z Planner Baldwin explained to the north of this plat there is another subdivision that is already platted and on the southern end there is city right of way. City Attorney Zollinger said the developer will build the road for two lanes of traffic. Council Member C. Erickson expressed his concerns about only building half the road. He wondered if the city could build the entire road and then claw back fees to future development. Public Works Director Davidson said it would be ideal to build out the road (208) 359-3020 35 North 1st East Rexburg, ID 83440 Rexburg.org | Engage.Rexburg.org completely instead of having to patch in the remaining road later; however, funding is not always available to build the entire road. There is another issue with not knowing when the subdivisions are going to be developed; for example; there was a subdivision that was platted in 1989 and only now being developed. Council Member Johnson moved to approve the Alpine Heights Division 1 Plat located at approximately 501 E 7th S; Council Member C. Erickson seconded the motion; Mayor Merrill asked for a vote: Those voting aye Those voting nay Council Member Johnson none Council Member Chambers Council Member C. Erickson Council Member E.
