On or before April 14, 2005, The Planning and Zoning Administrator presented proposed changes to the City Clerk for inclusion into a "Notice for Public Hearing" to change or Amend Ordinance 926 know as the recently adopted Development Code for Rexburg. 2. The "Notice for Public Hearing" was published on April 19"' and April 30tt' in the Standard Journal to advertise a Public Hearing on May 05, 2005 before the Planning and Zoning Commission. A. The proposed changes identified in the "Notice for Public Hearing" are noted below: 1. Add chapter eight (8) for Area of City Impact. 2. Revise Section 3.17 — (CBC) Community Business Center to include all definitions and rights, associated with the former (HBD) Highway Business District Zone. 3. Transition the old (HBD) Highway Business District Zone on the Rexburg Zoning Map to be reflected as the new (CBC) Community Business Center Zone. 4. Revise the text in the (CBC) Community Business Center Zone to include the definitions and rights associated with the former (HBD) Highway Business District Zone. 5. Change the Rexburg Zoning Map to include the new (CBC) Community Business Center Zone in place of the old (HBD) Highway Business District Zone. 6. Amend the DEVELOPMENT CODE ORDINANCE 926 Section 6.5 to allow a Planning and Zoning Commissioner to serve on the Planning and Zoning Commission after two years residency in the CITY OF REXBURG rather that the current requirement of five years. 7. Provide for Administrative Authority for a Code Enforcement Officer. 8. Amend the Minimum Lot Size and Uses within the (NBD) Neighborhood Business District Zone. 9. Amend certain requirements relating to particular uses and associated parking within the new (CBC) Community Business Center Zone. 3. May 17, 2005, The Planning and Zoning Administrator presented a revised version of the Development Code to the City Clerk to include in the handout for the City Council to review in their packets for the Council meeting on the 18t1i of May. In preparing for the meeting packet, the City Clerk investigated the minutes for the Planning and Zoning meeting that was held on May 05, 2005. The finding was that there was not any indication that a Public Hearing was held on said date for the Development Code changes _ r or amendments. A. The minutes read as follows for May 05, 2005 for the Planning and Zoning meeting: Code Amendment Review Kurt Hibbert reported that he and Bill Hamlin have been going through and making amendments to the Code that were published and advertised for public hearing. They have also noticed several other things so they will have to have a secondary round of hearing and amendment process. An example is in Chapter 8, the criteria of defining the zones and the restrictions of the zones were added. He and Bill have also been taking out erroneous references to City Code that they do not have. The use tables have been amended, both uses given by right as well as conditional uses. Kurt Hibbert commented that one thing that was brought up last night was to get the design standards for benches, lighting, etc. Chairman Dyer asked if there were there certain provisions the commissioners need to be made aware of that might change where they are headed. Kurt Hibbert replied that there is nothing that the Commissioners have not discussed already. He said that Bob Sherry made the comment that Design Standards are wonderful, but it needs to be equally applied with standards in all of the zones. Kurt Hibbert and Bill Hamlin are also working on getting all of the loopholes eliminated. Randall Porter suggested that the man that came about six months ago who was interested in the lighting ordinance, Allen Morton, should be contacted to work with Kurt Hibbert in finishing the lighting standards. 4. May 18, 2005, the packets for City Council were prepared with the proposed changes to the Development Code included in the packet. The plan is to have a new hearing on June 16, 2005, before the Planning and Zoning Commission if the proposed changes can be identified in time to publish a new Public Hearing Notice for that date. NOTICE OF PUBLIC HEARING TO AMEND THE PLANNING AND ZONING ORDINANCE No. 926 TITLED: DEVELOPMENT CODE ORDINANCE 926 FOR THE CITY OF REXBURG NOTICE IS HEREBY GIVEN that a Public Hearing will be held May 05, 2005, at 7:05 p.m. before the Rexburg Planning and Zoning Commission of the City of Rexburg, Madison County, Idaho, to amend the current DEVELOPMENT CODE ORDINANCE 926. It is proposed to review the current DEVELOPMENT CODE ORDINANCE 926 and make amendments to the Plan as needed to standardize terms, land use codes, general house keeping items, and qualifications to serve on the Planning and Zoning Commission. Additions or modifications to the New DEVELOPMENT CODE ORDINANCE 926 include: 1. Add chapter eight (8) for Area of City Impact. 2. Revise Section 3.17 — (CBC) Community Business Center to include all definitions and rights, associated with the former (HBD) Highway Business District Zone. 3. Transition the old (HBD) Highway Business District Zone on the Rexburg Zoning Map to be reflected as the new (CBC) Community Business Center Zone. 4. Amend the DEVELOPMENT CODE ORDINANCE 926 Section 6.5 to allow a Planning and Zoning Commissioner to serve on the Planning and Zoning Commission after two years residency in the CITY OF REXBURG rather that the current requirement of five years. 7. Provide for Administrative Authority for a Code Enforcement Officer. 8. Amend the Minimum Lot Size and Uses within the (NBD) Neighborhood Business District Zone. 9. Amend certain requirements relating to particular uses and associated parking within the new (CBC) Community Business Center Zone. At such Public Hearing the Rexburg Planning and Zoning Commission will hear all persons and all objections and recommendations relative to the DEVELOPMENT CODE ORDINANCE 926 that will be proposed. This notice is given to the provisions of Section 67- 6508, Idaho Code and all amended thereof. The City Council encourages all City residents to participate in the process to amend the the DEVELOPMENT CODE ORDINANCE 926. Citizen's comments may be submitted to the City Clerk in writing or by email during the fact finding period. All interested persons are invited to offer their views on the DEVELOPMENT CODE ORDINANCE 926 for the City of 001876 Rexburg in writing to the Community Development Office at 19 East Main Street in Rexburg.
