RE: I.ETTER FROM. REX BARTON CONCERING ESTAIlLISHING A BUSINESS
Letter from Rex Barton asking for the council approval to establish
a one man business in his residental area on west main, the Business
being lock smith and making keys. Motioned by Barton Jensen
seconded by Richard L, Davis that limited commercial would be granted
.when a petition form 80% of the property owners had signed a petition
stating that they would give their consent, to Mr. Barton.

Albert Pieper moved that we make the block on 4th East betwecn .

study. Mayor Shirley led the discussion on a muIti-purpdse I. I Jl
for next summer. lie ask Richard L. Davis to investigate all area for
sewer needs and Albert Pieper to survey the town [or needed curh
gutters and surfacing streets. Also the annexing uf more land and
homes into the city limits was discussed,

Bills were read for 66,717.40 motioned by Barton Jensen, seconded hy
Ruth Smith that they be paid.
Kent JOlley, representing Sunrise Properties, appeared at the
council meeting to discuss selling the vacant property, next to
the City Hall, to the city. Jolley stated that an offer had been
made by a bu~iness, but the business would not enhance Main Street.
A miniature park would be considerably better than an undersirahle
hUli~ness, he noted that his firm was interested in selling beneficial
develqpment IHJ the prop~rty and was not trying to profiteer. Such
a P;ll'k'could',include playground equipment and rest rooms facilities,
and \tould be a restful spot in the center of the city. lie estimated
450000.00 would be the figure. Councilwoman Smith noted that if the
city wished to develop the area as a park, ~tate funds could be
made availabe to help to defray costs, both in purchase price and
in the development. It was agreed to investigate the matter further.
Also he presented an easement agreement for the area in back of the
present city hall. Motioned by Barton Jensen, sec. by Glenn
Peterson. All aye except Richard L, Davis abstained. That the
easement be granted.
Mayor Shirley signed the easement,

RE: MINIATURE PARK BY CITY HALL DISCUSSED
RE: DISCUSSION ON TIlE PENDING HIGHWAY ROUTE
Discussion on the pending Ilighway route. Mayor Shirley stated that
in answer to'queries concerning the route, Harry Day, district engineer
for the Dept, of Highways, had requested that a letter he sent the Mayor
a month ago be published to clarify the Dept.'s stand on the matter,
Richard L. Davis stated he thought publishing the letter would not he a
good step. Mayor Shirley stated that he intended to publisll the letter
and wondered if there was any comment from the council. Davis stated
that he would withdraw his motion. In the fallowing discussion Davis
stated tb~ majority favored continued investigation of a route west of
the canal route corridor, It was also noted that the decision lies with
the Dept. of Highways, and wished they would state their prefcrcncc
and then the council could work towards that.

RE .FALSE ARREST INSURANCE DISCUSSED
False Arrest Insurance was discussed, Mayor Shirley stated that the
AIC had advised that they were dropping their Insurance plan as the
coverage was out dated, and suggested that we go with ~em on Law
Enforcement Officers Llabl I Ity Program Insurance. Jensen stated
he would check with Dietrich, as he thought we were covered at
present,
RE: PARTY WALL AGREEMENT WITH BLOCKS

No actlc..n was taken on the party wall agreement with Block's Inc.
Davis, Jensen and Porter were to act on this and report back.

Jensen reported -that no act I on had been taken as yet with Rexburg
Lumber Company, as to the agreement on the property they wished
to purchase or lease.

City Attorney Mary Smith reported her findings from IRS, stating
that the City employees would not fall Into the 5,5 only Increase
on wages as of the dates June 3D, 1971, September 3D, 1971,
December 31, 1971, and March 31, 1972, because the City had less than
60 employees.

AN INTERIM ORDINANCE APPROPRIATING SUFfiCIENT FUNDS FOR PAYMENT OF EXPENSES
AND SALARIES BY THE CITY OF REXBURG, IDAHO, DURING THE 1973 FISCAL
YEAR PRIOR TO THE PASSAGE AND APPROVAL OF THE ANNUAL APPROPRIATION
ORDINANCE; PROVIDING WHEN THE ORDINANCE SHALL BECOME EFFECTIVE.
A motion was made by Barton Jensen, seconded by Albert Pieper
to suspend the rules and have said Ordinance placed upon its final
passage. The Mayor ordered the ro II ca I I pf the Counc Ilea II ed, and
the roll being called by the City Clerk for the suspension of the
rules was as follows:

The regular session of the City Council convened at 7:30 p, M. with
the following members present: Bart Jensen, Huth Smith, Albert Pelper,
Dick Davis and Warren Porter. Reporter Rick Ripley and Ron Clifford
were also present. Absent and excused were Mayor Henry Shirley,
Councilman Glen Peterson, Attorney Mary Smith and Clerk Beulah Johnson.
IE: PROFESSOR RICHARD BIRD PRESENTS BROCHURE ON REXBURG TO COUNCIL
Professor Ri-:hard BI rd of the Ricks College Art Department appeared
before the counc i I and presented a I ayout and copy of a proposed
brochure on Rexburg and the surrounding area which he was preparing
for the Chamber of Commerce. The brochure contained many pictures and
limited copy. Although no sales pitch was made by Mr. Bird, it was
known to most counci I members that the primary purpose of the presentation
was to sol icit City funds to help In the publication of the brochure,

Minutes of the meeting of January 3 were read by Pieper, and on motion
of Smith, seconded by Davis,were unanimously accepted.
"PARTY WALL" AGREEMENT WITH BLOCKS DISCUSSED 1/11/73.
Reporting on previous busln.ss, Jensen stated that a party wal I
agreement with Ross Reese representing Cy Block had been ~eached,
The City would be paid $1,000 for use of the wall with Cy Block
obligated to close all windows with 4" pumIce block on the South
side only. Other conditions were to be spelled out in a final
document prepared by Mary Smith.
IE: REPORT ON MEETING TO DISCUSS REMODELING OF COURTHOUSE
Dick Davis reported on a joint meeting held on January 4, with the
three 1972 county commissioners, Sherriff Ford Smith, Police
Chief Blair Slepert, Mayor Shirley, and Councilmen Pieper and Davis
to discuss remode ling of the courthouse for a new ja II and I aw enforcement
office', Both Smith and Slepert felt that office space provided
for them was woefu II y Inadequate. A proposa I had been made to add a
second story over the jai I for City pol Ice officers at an estimated
cost of $80,000, The commissioners asked the City to stand this
expense. A counter proposal was made by Pieper wherein the existing
offices on the ground floor west of the courtroom could be used as
police offices and the present police offices at City Hall would be
exchanged for certain departments presently housed In the Court
House. All agreed that this was an excellent suggestion and the
commissioners were asked to have the architects prepare some
preliminary plans.

Current bills totalling $17,347.85 were read by council members a~d
on motion of Jensen, seconded by Smith, were un9nlmously approved.
:1 SMITH PRESENTED A PROPOSAL FOR REGULAR CLEANING OF THE CITY HALL
Councilwoman Ruth Smith presented a proposal from Stanphi II &
_J Jensen's Cleaning Service offering to do regular cleaning of the
City Hal I for $125,00 per month. Smith felt that regular city
employees should not be asked to do janitorial service. Uther
council members disagreed. After some discussion It was generally
agreed that the possibi Ilty of hiring a college student to clean
the rest rooms should be Investigated. Beulah Johnson was to be
asked to pursue this problem.
IE: COMPLAINT ON A FINE LEVIED AGAINST YOUTHS FOR RIDING SNOWMOBILES ON STREETS
Davis reported that a citizen had called him concerning il Ilno levied
against two youths for riding snowmobiles on City streel.s, General
dlsc~s~ion of the complaint revealed that the fines were probably
justified, The current snowmobile laws we~e reviewed showing that
judicious crossing at a right angle was legal but that paralleling
the traffic was a violation.

Pieper led a brief discussion on possible uses of revenua sharing
funds. Purchase of a fire engine, Instal ling a sprinkler system
In Smith Park, sidewalk Improvements, and waterworks extensions
were mentioned as possibilities,

Regular meeting of the City Council of the City of Rexburg.. Idaho,
held at the City Hall February 7, 1973, at 7:30 P. M. Mayor Henry
Shirley was present and presiding. In the excused absence of t~e
City Clerk, the Mayor asked Mary Smith, the City Attorney,. to take
the 01 I nutes. The fo II ow i ng members of the Counc I I were pr'esent:
Richard Davis, Barton Jensen, Albert Pieper, Ruth Smith, and Glen
Peterson, Councilman Warren Porter was excused.
Minutes of the regular meeting held January 17, 1973, were read.
Moved by Barton Jensen, seconded by Albert Pieper and unanimously
carried that the minutes be approved as read.
t: MAYOR INQUIRES ABOUT BROCHURE PREMOTING RICKS COLLEGE
The Mayor Inquired as to whethe~ or not any figure had been given
by Richard Bird as to what he would expect from the City for the
brochure promoting Ricks COllege. Albert Pieper explained that no
figure was mentioned and that Mr. Bird was just doing the artistic
work.
'-: AMENDED OR MODIFIED PLAT OF THE PARK VIEW ADDITION PRESENTEU
Ross Reese and Charles Rasmussen presented an amended or modi f ieal Ion
plat of the Park View Addition, showing a continuation of a dead
end street into t~e Starllte Addition, and an Increase in the size
of the lots, and asked that the city accept and approve the amended
or modified plat, which had been signed by the City Engineer and
the County Commis~ioners, and had also been approved by the Planning
Board, The Mayor stated he thought there would be no problom and
the City would act upon It at the next meeting,

and Ross Reese was discussed. The Mayor staled that the agreement

Investigation as to whether or not such an agreement was In violation
of the Building Code; that the Council would bo having a budgot
meeting the following week and would act on 1.he matter then.

The Mayor stated t-hat I nsofar as the new County ja I I was concerned,
the Chief of Police, Mr. Slepert told him that the Archlt-ect had ruled
out the possibility of making the lower floor Into offices and -that-
the better plan would be to enlarge the present jal I by extending
to the back,
JANITORIAL SERVICES FOR CITY HALL DISCUSSED
The matter of janitorial services for the City Hall was discussed,
lhe Mayor stated he had received t-wo excellenl applications and
would discuss the matt-er further with the City Clerk,

RICKS COLLEGE ASKS FOR ASSISTANCE IN PROMOTING BROTHERHOOD WEEK
A delegation from Ricks COllege sophmore class, spokesman being
Perry Rush, asked the Counc I I ass I stance I nits attempt to promote
Brotherhood Week in Rexburg, March I I thru 18, Money raised would be
sent to L, 0. S, mission President in Mexico to set up a revolving
fund, to help young people In that area to continue their education.
Councilman Davis offered clean up work at the College building which
he now has under contract. Weather permitting the City may have projects
for Brotherhood Week, Mayor Shirley stated,
