CONTAINING 0.26 ACRES MORE OR LESS. South Lot Utility Easement The City of Rexburg retains a 20 ft wide utility easement through the lot, further described as follows: FROM THE SOUTHWEST CORNER OF THE RICKS-PALMER SUBDIVISION DIVISION 1, SAID POINT BEING NORTH, 1642.79 FT ALONG THE ¼ SECTION LINE FROM THE SOUTHEAST CORNER OF THE SOUTHWEST ¼ OF SECTION 20, T.6N., R.40E., B.M., MADISON COUNTY, IDAHO, THENCE RUNNING NORTH, 18.0 FT, TO THE POINT OF BEGINNING; THENCE NORTH, 20.0 FT; THENCE NORTH 88°05’36” EAST, 139.58 FT; THENCE SOUTH, 20.0 FT; THENCE SOUTH 88°05’36” WEST, 139.58 FT TO THE POINT OF BEGINNING. The easement allows the City to install and maintain a sewer pipeline and other City utilities. No structures are permitted to be constructed by the landowner within the easement except for a fence at the west property line. When the City completes work within the easement, the City will not be responsible for restoration of landscaping within the easement except for sod, sprinklers, and concrete driveway/sidewalks. South Lot Path Easement The City of Rexburg retains a 15 ft wide path easement along the south edge of the lot, further described as follows: FROM THE SOUTHWEST CORNER OF THE RICKS-PALMER SUBDIVISION DIVISION 1, SAID POINT OF BEGINNING BEING NORTH, 1642.79 FT ALONG THE ¼ SECTION LINE FROM THE SOUTHEAST CORNER OF THE SOUTHWEST ¼ OF SECTION 20, T.6N., R.40E., B.M., MADISON COUNTY, IDAHO; THENCE NORTH, 15.0 FT; THENCE NORTH 89°55’28” EAST, 139.5 FT; THENCE SOUTH, 15.0 FT; THENCE SOUTH 89°55’28” WEST, 139.5 FT TO THE POINT OF BEGINNING. The easement allows the City to install and maintain a pathway for public use. No structures are permitted to be constructed by the landowner within the easement. South Lot Ditch Easement The City of Rexburg retains a 17.5 ft wide ditch easement along the west edge of the lot, further described as follows: FROM THE SOUTHWEST CORNER OF THE RICKS-PALMER SUBDIVISION DIVISION 1, SAID POINT OF BEGINNING BEING NORTH, 1642.79 FT ALONG THE ¼ SECTION LINE FROM THE SOUTHEAST CORNER OF THE SOUTHWEST ¼ OF SECTION 20, T.6N., R.40E., B.M., MADISON COUNTY, IDAHO; THENCE NORTH, 82.18 FT; THENCE EAST, 17.5 FT; THENCE SOUTH, 82.16 FT; THENCE SOUTH 89°55’28” WEST, 17.5 FT TO THE POINT OF BEGINNING. The easement allows the City to install and maintain an irrigation ditch and other City utilities. No structures are permitted to be constructed by the landowner within the easement except for fences at the property lines. The only landscaping allowed within the easement is sod and a sprinkler system. The City may remove and replace the fence as needed to access the easement. CONTAINING 0.24 ACRES MORE OR LESS.
