Those representing Ricks College: President Steve Bennion, Dean
Sorensen, Jim Smith, Brent Kinghorn, and Mack Shirley.
Mayor re-opened the Hearing on Closure of viking Drive. During the
week the only written testimony that was received was from Gerald
Taylor that was given to the council and he was in favor of closing
Viking Drive. The mayor called for a motion.
A motion was made by Glen Pond. THAT THE CITY OF REXBURG ABANDON THE
ONE (1) BLOCK PORTION OF VIKING DRIVE (4th SOUTH) THAT LIES BETWEEN THE
EAST SIDE OF THE INTERSECTION OF VIKING DRIVE (4th South) and CENTER
STREET, AND THE WEST SIDE OF THE INTERSECTION OF VIKING DRIVE (4th
South) and 1st EAST SUBJECT TO THE FOLLOWING STIPULATIONS: (attached)
The motion was seconded by Jim Flamm. The mayor asked if there was any
discussion.
Brad explained on #3 and #4 The way it is worded, Ricks College would
sell to the city the right-a-way and in turn donate that amount back to
the city rather than just donating the right-a-way. The reason for
that is in order to qualify for matching funds, we can't just accept a
donation of land. If we pay for the land and then accept a donation at
a later time, that amount of money can qualify for our local match.
Jim Flamm explained there is one more part that this does not resolve,
the traffic that does move to 2nd South. We feel that most of the
traffic that does not go through Viking Drive will end up on 2nd
South. We don't know how much, we think it will be more than the study
showed. We will have to study that out when it happens and we may need
to replace some parking, if we have to utilize some of the parking to
make room for extra traffic.
President Bennion - Stated that the College people at the meeting
could not speak for the Board. He would have to check with them.
The mayor told them we got a letter from the Idaho Department of
Transportation which stated that in a couple of years we would have a
positive balance and they would consider us for financing. We would
have a positive balance in 1995 a little bit, but for fiscal year 1996
which starts July of 1995, we would have in excess of $300,000 in the
positive balance. There is nothing that can be done as far as the city
is concerned until either 1995, some could be done in 1994.
Brad explained we are committing to close the road based on the
stipulations so the college can move forward with their plans. At the
same time it does not preclude us from temporary measures if the
buildings are built before 7th South is in. If we don't get 7th South
in for a year or two after your buildings are in, we could look at the
safety issues, such as putting barricades up on 4th South during the
day for the safety of the students until 7th South is built and at that
t~e the road will be closed. The mayor stated we would have to close
the south side of Viking Drive during construction.

The mayor stated that those funds are quite limited. If we did the
road sooner, it would require more financial help from the College.
Brad stated as he understands the way this is planned, we can design
the whole South Arterial Project and apply for state funding and have a
good chance of getting the whole thing funded. If we don't do it that
way it would require more money from the college up front. We would
then take a chance of getting a portion of it funded by the state.
Bruce stated that we have safety and road concerns allover the city.
We have one and half million dollars worth of repairs we should do this
year on existing streets and only $435,000 to do it. The mayor said the
only way it could be done this year is if the college wanted to put in
those first four blocks at their expense.
President stated they would take it to the board, but they have not set
a precedence of building roads.
The mayor said the way it is now is we will have to leave Viking Drive
the way it is now for two years.
Jim Smith asked for clarification on the drainage of the parking lot.
The mayor stated that the drainage that comes down Viking Drive right
now, is already over loaded and it surcharges down around the 2nd and
9th Ward church.
Brent Kinghorn asked on #6 where it says the college agrees to install
curb, gutter and storm drainage on 7th, he assumed it was between 2nd
East and 2nd West or is the assumption that the city would like curb
and gutter? The mayor said he did not think for sure that
determination had been done, because there had not been any engineering
done.
Brad stated that we have an ordinance right now that states that any
roads within the city limits are curbed and guttered. As part of this
project we should look at a road with curbs and gutters, particularly
if we can use state funding on this whole project. It makes sense to
do it right the first time. If we don't get state funding on that
portion, what it says to him is we go back to an LID and the property
owners will participate. The mayor stated that under the money from the
Highway Department, they would pay 80% even with the curb and gutter.
President Bennion asked if by 1995 they would have money, if they are
talking about four blocks or the whole South Arterial? The mayor
stated he did not know for sure if they would let us go back in the red
again if they don't, we would only be able to do four blocks, if they
let us go in the red we might be able to do the whole thing.
Brad said he would like to see it designed as the whole South Arterial
project and do it in phases and the first four blocks would be the
first phase.
The mayor asked for a vote. All Councilmembers voted Aye.
The mayor stated that we would work with the college.
Brad stated that he felt the discussion had been positive and the city
appreciated the college's participation.
