Hello Andrew,
With all do respect, I understand your frustration, however that does not have the effect of shifting ultimate
responsibility for locating immovable objects within the public rights-of-way.
I’m not clear on your references to documents being removed. We are looking into the process at the City’s level,
but your sign permit application still has the aerial view as part of it, and on the aerial, it clearly shows a dimension
of 11 feet ¼ inch between the back of curb for the parking lot and the property line. The application also shows the
placement of the proposed sign as being centered on the owners property between the parking lot back of curb and
the property line. Given the 9 feet dimension of the sign you proposed, that would place it approximately 1 foot
from the top back of curb for the parking lot, not the nearly 4 feet that is what exists.
Your vague reference to the arbitrary 40 feet from the non-specific line on the asphalt is simply not relevant in the
opinion of the City. Your workers placed the sign base after the parking lot was in place, and had no reason not to
refer to the existing landmarks as shown on your application. As constructed, the sign that you erected on behalf of
your customer is located within the right-of-way and must be moved or it will be removed.
The permit 20-00760 was approved based upon the specifics contained on the application, which absolutely require
the sign being completely located on Henry Fork Surgery Center’s property, as shown in the site plan you
submitted. The owner of the facility will be notified of the need to have the sign re-located and the findings on the
part of the City that your company appears to have placed it within the public right-of-way.
If you feel it necessary to have any further discussions relative to this matter, please let me know when your
schedule would allow for a meeting with city representatives and I will work to schedule such a meeting as soon as
possible.

Hi Natalie,
With all do respect, prior to applying for this permit I was told by you that the property line was 40’ back from the edge
of the street (white line). Going off of that information, we submitted an overhead drawing showing the property line
40’ back from the edge of the street. You approved this permit and plans for this sign – See the attached AE-Review
Report.
After you approved this overhead drawing showing that the sign will be at least 40’ back from the edge of the road, we
installed the sign giving ourselves an extra 3’ just to be sure. The sign is installed 43’ 6” from the white line on the street
or 40’ from the curb (that didn’t exist when this sign was installed).
Because we submitted an overhead drawing showing the proposed location of this sign and the fact that it was
approved and the permit issued, we will not move this sign at our expense.
On a side note, after visiting the site yesterday I don’t understand what moving this sign back 1’ is going to achieve.
Nevertheless, if you want this sign moved back 1’ we can provide an estimate on how much that will cost the City of
Rexburg.
We also noticed today that you removed the attached overhead document as well as the drawings for the monument
sign from the permit website (Permit 20-00760). You also added a note today 09/8/21 (nearly one year after the permit
was issued) stating “This approval only applied to City of Rexburg requirements. Please check with ITD, Rocky Mtn Power
and all other utilities for their specific requirements.” We find that very unethical to say the least.
Let me know who I need to forward this to at ITD.
