MUIR Fee: 0.00 „ex.cl" ficio Recorder Deputy C I T Y O F REXBURG America' Family Community RESOLUTION FOR AMENDING VISION 2020 REXBURG COMPREHENSIVE PLAN MAP Resolution 201-2 - 03 WHEREAS, on the 07`h day of MARCH, 2012, the City Council for the City of Rexburg was duly convened upon notice properly given and a quorum was duly noted; and WHEREAS, in a Rexburg Planning and Zoning Commission meeting on the 1't day of March, 2012, the Planning and Zoning Commission held a public hearing, taking public comment for and against the proposal to amend the Comprehensive Plan Map. The public hearing ended without coming to a decision due to a tie vote; therefore, no recommendation to amend the Comprehensive Plan Map's "Land Use" designation was presented to City Council; and WHEREAS, a comprehensive plan is a living document; an ongoing planning participation effort by the citizens of the community is encouraged to ensure changing conditions meet the needs of the community; and WHEREAS, proposed changes to comprehensive plan map can change land use designations; and WHEREAS, the following approved Land Use designation changes to the Comprehensive Plan Map are hereby set forth at 250 West Main & 52 North 3`d West from Moderate -High Density Residential (52 North Td West) and Light Industrial (250 West Main) to Neighborhood Commercial/Mixed Use and more particularly described as follows: Parcels of land situated in Madison County, Idaho, Township 6 North, Range 40 East, Section 19, more particularly described as follows: Beginning at the Southwest Corner of Lot 3 Block 30 of the Original Townsite of Rexburg: thence N90°E 150.00 feet to the true point of Beginning; thence N00°E 330.00 feet to the South line of Lot 2 of said Block 30; thence S90°W 150.00 feet to the Southwest Corner of said Lot 2; thence N00°E 165.00 feet to the Northwest Corner of the South Half (S1 /2) of said Lot 2; thence N90°E 330 feet to the Northeast Corner of the South Half (S1/2) of said Lot 2; thence S00° W 12.00 feet; thence N90°E 131.08 feet; thence S00°W 82 feet to the Westerly Right -of -Way line of the Oregon Short Line Railroad; thence S15°58'40"W along said Right -of -Way 228.09 feet; thence S30°20'00"W along said Right -of -Way 135.23 feet to the East line of Lot 3, Block 30; thence S00° W 13.86 feet to the Westerly Right —of-Way line of the Oregon Short Line Railroad; thence S30°20"00'W along said Right -of -Way 59.26 feet; thence S90°W 150.07 feet to the True Point of Beginning; Containing 3.44 Acres More or Less. Subject to: Easements and Right -of -Ways for highways, roads, ditches, canals, power poles, and transmission lines as they exist. WHEREAS, the changes shown on the Comprehensive Plan Map dated March 07, 2012 have been approved by the City Council; NOW THEREFORE, by resolution duly adopted on the date first above written, be it resolved by the Mayor and the City Council the following: The City of Rexburg does hereby accept and adopt the said Comprehensive Plan Map Land Use Designations in the City ofRexburg Vision 2020 Comprehensive Plan.
