HomeMy WebLinkAboutResolution 2014 -15 Mayor Disaster DeclarationC I T Y O P REXBURG Atnerlcai Family Community RESOLUTION NO.: 2014-15 A RESOLUTION OF CITY OF REXBURG, MADISON COUNTY, IDAHO, DECLARING THAT A LOCAL DISASTER EMERGENCY EXISTS WITHIN THE CORPORATE LIMITS OF THE CITY OF REXBURG, WHICH STATE OF EMERGENCY WAS VERBALLY DECLARED ON JULY 15, 2014 AND IS ANTICIPATED TO CONTINUE THROUGH JULY 22, 2014, OR UNTIL OTHERWISE TERMINATED BY RESOLUTION OF THE CITY OF REXBURG. WHEREAS, Idaho Code §46-1011 grants general powers and duties, subject to the restrictions of law, to the Mayor and City Council in their jurisdictions; and, WHEREAS, Idaho Statutes grant the City authority "to do and perform all other acts ... which may be necessary to the full discharge of the duties of the chief executive authority of the local government"; and, WHEREAS, Idaho Code §46-1011 provides that the Mayor may declare a local disaster emergency, which may be continued in excess of seven days with consent of the City Council; and, WHEREAS, Idaho Code §46-1002(3) provides, in part that a "disaster" includes the imminent threat of widespread or severe damage or loss of property resulting from any natural or manmade cause; and, WHEREAS, Idaho Code §46-1002(4) provides, in part, that an "emergency" includes the imminent threat of a disaster" or condition threatening property which requires state emergency assistance to supplement local efforts to protect property or to avert or lessen the threat of "disaster"; and, WHEREAS, due to excessive rainstorms on or about Tuesday, July 15, 2014, widespread flooding occurred throughout Madison County causing excessive damages; and, WHEREAS, the Mayor orally declared a state of disaster during the evening hours of Tuesday, July 15, 2014; and, BE IT NOW RESOLVED that good cause having been shown, that the Mayor hereby formalizes said declaration and orders and ratifies the same. BE IT FURTHER RESOLVED that this resolution shall be in full force and effect immediately after its passage.
